LIMITED WARRANTY

Brasilia USA Imports warrants its' new Product(s) to be free from defect in material and workmanship for the period of one (1) year

from the date of original installation and not to exceed 15 months from the original date of shipment from our warehouse. Equipment sold

or used for residential use is excluded from this warranty. Some products have limited warranties with respect to on-site service and are

detailed below. Equipment provided by our authorized distributors is covered under the distributors warranty provisions and are excluded

from coverage under this warranty document.

All warranty repairs must be authorized by our SO manager, Brasilia USA will not be responsible for any deviation from this

policy.

This warranty is limited to Product(s) sold to the original commercial user. This liability of Brasilia USA Imports under the Warranty is

limited to, at Brasilia USA Imports' option, the repair, or replacement of any part found by Brasilia USA Imports to be warranted herein.

Brasilia USA Imports shall bear the normal labor charges incurred in such repair or replacement to the extent that such is performed

within fifty (50) miles from an office of an authorized service agency of Brasilia USA Imports, except that such obligation to bear labor

charges shall not apply to products or parts installed outside of the continental United States.

In the event a distance of more than 25 miles shall be required to be traveled to perform such service, the person or firm requesting

such service shall be required to travel to perform such service, the person or firm requesting such service shall bear the normal

charge of the personnel performing the service for time and travel beyond the 50 mile limit. If service is required during overtime

periods the difference between overtime and standard labor rates shall be paid by the person or firm requesting such service. Any

defective part subject to a claim under this warranty must be shipped freight prepaid to Brasilia USA Imports for warranty inspection.

Brasilia USA Imports shall have no obligation as to any Product(s) which have been misapplied, mishandled, abused, misused,

subjected to harsh chemical action, modified by unauthorized service personnel, damaged by flood, fire or other acts of nature

or which have the serial number removed or altered.

Adjustments such as calibrations, leveling, quality of water (calcium) or utility connections normally associated with original installation

are the responsibility of the dealer or installer and not that of Brasilia USA Imports. Improper installation includes, but is not limited to, use

of inadequate electrical wiring, undersized gas lines, insufficient or improper voltage or gas pressure, and improper ventilation.

Replacement parts which are replaced in the field by Brasilia USA Imports authorized service agencies will be limited to 360

days warranty effective from the date of installation. All replacement parts covered under this warranty are shipped standard

UPS ground; any special handling or express shipping charges is the sole responsibility of the end user. Rubber seals, light

bulbs, and gaskets are warranted for 90 days from the date of installation. Plastic/Glass are not covered by warranty.

THE FOREGOING WARRANTY IS IN LIEU OF ANY AND ALL OTHER WARRANTIES EXPRESSED OR

IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS, AND

CONSTITUTES THE ENTIRE LIABILITY OF Brasilia USA IMPORTS. IN NO EVENT DOES THE LIMITED

WARRANTY EXTEND BEYOND THE DURATION OF ONE YEAR FROM SAID WARRANTY.

RETURNS AND CANCELLATIONS

Brasilia USA Imports products cannot be returned without prior written factory authorization. The restocking charge is 30% plus any costs

to recondition the equipment. No returns accepted after 30 days from date of invoice.

Returns for credit must be freight prepaid. Orders cancelled or changed after production has started are subject to a charge of up to 30%.

Any special merchandise built to buyer’s specifications may not be returned or cancelled.

SHIPMENTS & FREIGHT DAMAGE

Title passes to the consignee when the merchandise is accepted by the carrier and thereafter travels at the risk of the purchaser. In case

of freight damage, call this to the attention of the carrier and make note of damages on delivery receipt before accepting shipment. File

claim for damages with the freight company (all claims must be filed by consignee with carrier, not by or with Brasilia USA Imports). In

case of concealed damage, save all packaging, immediately notify carrier of your findings and intention to file claim. All orders of

replacement parts or equipment due to freight damage will be invoiced under our regular terms. Any reimbursements or credit must come

from the freight company. CARRY-IN WARRANTY COVERAGE

Coverage under these carry-in warranty provisions begins and is concurrent with the on-site portion of this agreement. Warranty claims

for equipment no longer covered under our on-site warranty provisions may be brought to one of our authorized service agents. You

must contact our warranty service department in advance to obtain a warranty authorization and location of the nearest agent.

Rosito Bisani may—at its sole discretion—allow the end user to return the item to any of our regional or national service facilities provided

that a Return for Warranty Service Number is obtained prior to shipping and the item arrives freight prepaid. Rosito Bisani will pay for the

shipping expenses from our warehouse to the end user only.

ADDENDUMS OR MODIFICATIONS TO THIS DOCUMENT

Any modifications, addendums, or extensions to these warranty provisions must be generated by Brasilia USA Imports. Such documents

must be signed by the end user and faxed or sent to our Warranty Service Department for inclusion in the end user’s file.
