SPRING INTO FITNESS SWEEPSTAKES NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. The "Spring Into Fitness Sweepstakes” is sponsored by Omron Healthcare, Inc., (“Sponsor”). This Sweepstakes is governed by these official rules (“Official Rules”). By participating in the Sweepstakes, each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the sweepstakes, as determined by Sponsor and its agents, are final in all respects. The sweepstakes is subject to all federal, state and local laws and regulations and is void where prohibited by law. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Any questions, comments or complaints regarding the promotion will be directed to Sponsor, not Facebook. ELIGIBILITY The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia, who are eighteen (18) years of age or older at the time of entry, who have Internet access and a valid e-mail account . Void where prohibited by law. Sponsor has the right to verify the eligibility of each entrant. SUBMISSION PERIOD The submission period begins March 15, 2013 at 8:00 a.m. CST and ends April 15, 2013 at 11:59 a.m. CST. (“Submission Period”). All entries (submissions) must be received during the Submission Period. Sponsor reserves the right to extend or shorten the Submission Period in its sole discretion. HOW TO ENTER You can enter the Sweepstakes through the Sponsor Facebook Page (www.Facebook.com/OmronFitness). You can find the application on the Spring Sweeps Sweepstakes tab on the Sponsor's Facebook Page. Entrants must fill out all required fields on the entry form to participate in the sweepstakes. After submitting the required information on the entry form, the entrant will receive one (1) entry into the drawing. Entrants may enter once a day during the Submission Period. WINNER SELECTION All eligible entries received during the Submission Period will be gathered into a database at the end of the Submission Period. Five (5) winners will be chosen at random. The winners will be announced on or about April 30, 2013 on or about noon CST. Announcement and instructions for prize winners will be sent to the e-mail address supplied on the potential prize winner’s entry form. Each entrant is responsible for monitoring his/her e-mail account for prize notification and receipt or other communications related to this sweepstakes. If a potential prize winner cannot be reached by Administrator (or Sponsor) within fifteen (15) days, using the contact information provided at the time of entry, or if the prize is returned as undeliverable, that potential prize winner shall forfeit the prize. Upon the request of the Sponsor, the potential winner may be required to return an Affidavit of Eligibility, Release and Prize Acceptance Form and IRS W-9 form. If a potential winner fails to comply with these official rules, that potential winner will be disqualified. Prizes may not be awarded if an insufficient number of eligible entries are received. PRIZES: Five (5) prize packs including one (1) Omron HBF-306C Fat Loss Monitor (value $49.99), one (1) Bob Greene Book “20 Years Younger” (value $27.99) and one (1) Bob Greene “20 Years Younger Daily Journal” (value $15.99). Maximum value is $93.97 per prize pack. General Conditions: Participation in the Sweepstakes constitutes full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor, which are final and binding. Winning a prize is contingent on fulfilling all requirements set forth herein. By entering, information collected from entrants in connection with these Official Rules is subject to Omron’s privacy policy available at http://www.omronhealthcare.com/privacy/ and prize winner’s name may be released to the public. Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered, or garbled, entries; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes, including any error that may result in an erroneous appearance of qualification for a prize or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the web site. Persons who tamper with or abuse any aspect of the Sweepstakes or website or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. In the event Sponsor is prevented from continuing with this Sweepstakes, or the integrity and/or feasibility of the Sweepstakes is undermined by any event including but not limited to virus, worms, bugs, non-authorized human intervention, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel, or terminate the Sweepstakes without further obligation and, if cancelled or terminated, Sponsor reserves the right, but not the obligation, to award the prize(s) from among all non-suspect valid and eligible entries received up to the time of such cancellation or termination. Entrants (and, if eligible minors, their parents or legal guardians), by participating, agree that Sponsor, and its parent affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of a prize or participation in this Sweepstakes. Winners, by acceptance of a prize, except where legally prohibited, grant permission for Sponsor and its designees to use his/her name, address (city and state), photograph, performance, voice and/or other likeness for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval. In the event of a dispute regarding entries received from multiple users having the same email account, such persons may be required to provide proof that he/she is the authorized account holder of the identified email account, and Sponsor’s decision will be final. The laws of the State of Illinois (USA), without regard to its conflict of law rules, will govern these Official Rules. Any action relating to this Sweepstakes shall be initiated only in the state and federal courts located in Cook County, Illinois (USA). WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Incidental expenses and all other costs and expenses which are not specifically listed as part of a prize in these Official Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded prize are solely the responsibility of the respective prize winner. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE IS SOLELY THE RESPONSIBILITY OF THE WINNER. ADDITIONAL LIMITATIONS Prize is non-transferable. No substitution or cash equivalent of prizes is permitted. Any attempt to damage the content or operation of this Sweepstakes is unlawful and subject to possible legal action by Sponsor. Sponsor reserves the right to terminate, suspend or amend the Sweepstakes, without notice, and for any reason, including, without limitation, if Sponsor determines that the Sweepstakes cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Sweepstakes. In the event any tampering or unauthorized intervention may have occurred, Sponsor reserves the right to void suspect entries at issue. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.
