GERBER PLUMBING FIXTURES LLC

Gerber Plumbing Fixtures LLC (“Gerber”) warrants to the original consumer purchaser that all Gerber branded kitchen and bath faucets, valves, and other related accessories or part thereof to be free from defects in material and workmanship, for as long as the original consumer purchaser owns it.

Electronic Parts Warranty

All electronic parts are warranted to the original consumer purchaser to be free from defects in material and workmanship for a period of five (5) years. Batteries are not included.

Exclusions

This limited warranty does not apply to normal wear of washers, O-rings and O-ring seats, sealant, and lubricants.

Any damage as a result of improper installation, misuse, accident, neglect or any use that violates the instructions furnished by Gerber, WILL VOID WARRANTY IMMEDIATELY. This warranty is only valid to the original consumer purchaser and excludes industrial, commercial or business use of the product. Use of abrasive cleaners will void the warranty. Avoid abrasive cleaners, steel wool, and harsh chemicals. This will dull the finish and void your warranty.

Remedies

Gerber will replace, free of charge, during the warranty period, any product or part thereof that upon inspection proves defective in material and/or workmanship under normal residential application. If replacement of the original part is not practical, GERBER may elect to replace it with an equivalent part or refund the purchase price in exchange for the return of the product. These are your exclusive remedies.

Commercial and International Warranty

This warranty excludes all industrial, commercial, and business usage. Purchasers in these categories are extended a five (5) year limited warranty for non-electronic parts and one (1) year limited warranty for electronic parts from the date of purchase, with all other terms of this warranty applying except the duration. This warranty also excludes installation outside of the United States of America, Canada or Mexico (North America). Purchasers in these regions are extended a one (1) year limited warranty from the date of purchase, with all other terms applying except the duration.

Limitation of Implied Warranties and Liability

TO THE EXTENT PERMITTED BY LAW, ANY IMPLIED WARRANTY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR PURPOSE, IS LIMITED TO THE STATUTORY PERIOD OR THE DURATION OF THIS WARRANTY, WHICHEVER IS SHORTER. GERBER PLUMBING FIXTURES LLC SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING LABOR CHARGES TO REPAIR, REPLACE, INSTALL OR REMOVE THIS PRODUCT), WHETHER ARISING OUT OF BREACH OF ANY EXPRESS OR IMPLIED WARRANTY, BREACH OF CONTRACT, TORT, OR OTHERWISE. GERBER PLUMBING FIXTURES LLC SHALL NOT BE LIABLE FOR ANY DAMAGE RESULTING FROM REASONABLE WEAR AND TEAR, MISUSE, ABUSE, NEGLECT OR IMPROPER OR INCORRECTLY PERFORMED INSTALLATION, MAINTENANCE OR REPAIR, INCLUDING FAILURE TO FOLLOW THE APPLICABLE INSTALLATION, CARE AND CLEANING INSTRUCTIONS. NOR DOES IT COVER OR INCLUDE DAMAGES FOR PERSONAL INJURY, PROPERTY DAMAGE OR ECONOMIC LOSS. IN NO EVENT SHALL LIABILITY EXCEED THE PURCHASE PRICE OF THE FAUCET. WARRANTY PARTS ORDERS MAY BE SUBJECT TO SHIPPING & HANDLING CHARGES.

Consumer Rights

Some states/provinces do not allow limitations of how long an implied warranty lasts or the exclusion or limitation of such damages, so these limitations and exclusions may not apply to you. This warranty gives the consumer specific legal rights. You may also have other rights that vary from state to state, province to province.
