I/we acknowledge that should I/we fail to comply with the terms of sale any money paid, partly paid or deposited shall be forfeited. Any item not removed within the time prescribed may at the option of Slattery Auctions Australia Pty Ltd or the Vendor’s option be either stored at the defaulting purchasers risk and expense or resold. In which case, any deficiency whatsoever shall be made good by the defaulting purchaser, without prejudice to any rights or remedies of the Vendor of Slattery Auctions Australia Pty Ltd. 3. I/we further understand that the Plant & Equipment is offered on an “as is where is” basis. Buyers are warned to inspect all lots before submitting any offer. No warranty whatsoever is given with any item of equipment and the Vendor and Slattery Auctions Australia Pty Ltd shall not be responsible for incorrect description or for the correctness of any statement concerning any item in any catalogue or otherwise, for any fault, defect or damage to any item. Each of the items offered for sale will be taken with all faults and will be at the buyers risk on the submission of an offer to purchase. The purchaser on lodging an offer expressly agrees that they have inspected the items bid for, and in making this offer relied entirely on its own judgement and not on any statements or representations made by Slattery Auctions Australia Pty Ltd or the Vendor. 4. The Occupational Health And Safety Act 1984 and Regulations impose obligations in respect of safety for workers arising out the DESIGN, MANUFACTURE AND SUPPLY of plant for use in a workplace. 5. Slattery Auctions Australia Pty Ltd and the Vendor warn all buyers THAT ALL PLANT OR EQUIPMENT OFFERED FOR SALE MAY NOT BE FIT FOR USE IN A WORKPLACE and it is the BUYER’S RESPONSIBILITY to ensure that it is brought to a standard necessary to comply with the Occupational Health and Safety Act 1985, and is safe and fit for use in a workplace. Breaches of the Occupational Health and Safety Act 1984 carry onerous penalties for people who PURCHASE and OPERATE UNSAFE EQUIPMENT, without conducting a thorough safety inspection. Plant MUST be given a safety inspection prior to operation when it is purchased. 6. Subject to conditions and warranties prescribed by statute which cannot be excluded, Slattery Auctions Australia Pty Ltd and the Vendor shall not be liable for any loss damage or injury of any kind whatsoever, whether arising from the performance, description, misdescription or identification of Goods, the entry of persons onto premises or otherwise (including without limitation, loss damage or injury caused by the default or negligence of or misdescription by Slattery Offer Invited Response Form : Page 3 of 15 Auctions Australia Pty Ltd or the Vendor and any incidental or consequential loss, damage or injury) to any person or property. 7. Title to an item shall remain with the Vendor until the full purchase price and all other sums payable in respect of the item(s) are paid in full. 8. An item shall be held at all times after purchase at the purchasers risk and expense in respect of loss or damage from any cause whatsoever, including Slattery Auctions Australia Pty Ltd or the Vendor’s or any other persons negligence and taxes and charges of any kind. 9. The purchaser shall remove purchased items with reasonable professional skill, care and attention and shall bear the cost of making good any damage or injury caused as a result of removing any purchased item. 10. A provision of or a right created under these terms and conditions may not be waived except in writing signed by the party granting the waiver. 11. I/we totally indemnify Slattery Auctions Australia Pty Ltd and the Vendor, directors, officers and employees from any actions arising from the purchase of any item whether consequential or otherwise. 12.
