Application by theappellant for a writof error coram nobis to vacate, on theground

of ineffective assistance of appellate counsel, a decision and order of this Court dated December 2,

2008 (People vNadal, 57 AD3d 574), modifying two judgments of theSupreme Court, Westchester

County, both rendered January 6, 2004.

ORDERED that the application is denied.

The appellant has failed to establish that he was denied the effective assistance of

appellate counsel (see Jones v Barnes, 463 US 745; People v Stultz, 2 NY3d 277).
