PLEASE READ THIS AGREEMENTCAREFULLY.Garmin Ltd. and its subsidiaries (“Garmin”) grant you a limitedlicense to use the software embedded in this device (the “Software”)in binary executable form in the normal operation of the product.Title, ownership rights, and intellectual property rights in and to theSoftware remain in Garmin and/or its third-party providers.You acknowledge that the Software is the property of Garmin and/orits third-party providers and is protected under the United States ofAmerica copyright laws and international copyright treaties. Youfurther acknowledge that the structure, organization, and code ofthe Software, for which source code is not provided, are valuabletrade secrets of Garmin and/or its third-party providers and that theSoftware in source code form remains a valuable trade secret ofGarmin and/or its third-party providers. You agree not to decompile,disassemble, modify, reverse assemble, reverse engineer, orreduce to human readable form the Software or any part thereof orcreate any derivative works based on the Software. You agree notto export or re-export the Software to any country in violation of theexport control laws of the United States of America or the exportcontrol laws of any other applicable country.Limited WarrantyTHIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGALRIGHTS, AND YOU MAY HAVE OTHER LEGAL RIGHTS, WHICHVARY FROM STATE TO STATE (OR BY COUNTRY ORPROVINCE). This Limited Warranty does not apply to: (i)cosmetic damage, such as scratches, nicks and dents; (ii)consumable parts, such as batteries, unless product damage hasoccurred due to a defect in materials or workmanship; (iii) damagecaused by accident, abuse, misuse, water, flood, fire, or other actsof nature or external causes; (iv) damage caused by serviceperformed by anyone who is not an authorized service provider ofGarmin; (v) damage to a product that has been modified or alteredwithout the written permission of Garmin, or (vi) damage to aproduct that has been connected to power and/or data cables thatare not supplied by Garmin. In addition, Garmin reserves the right torefuse warranty claims against products or services that areobtained and/or used in contravention of the laws of any country.Garmin navigation products are intended to be used only as a travelaid and must not be used for any purpose requiring precisemeasurement of direction, distance, location or topography. Garminmakes no warranty as to the accuracy or completeness of mapdata.This Limited Warranty also does not apply to, and Garmin is notresponsible for, any degradation in the performance of any Garminnavigation product resulting from its use in proximity to any handsetor other device that utilizes a terrestrial broadband networkoperating on frequencies that are close to the frequencies used byany Global Navigation Satellite System (GNSS) such as the GlobalPositioning Service (GPS). option: (i) repair the device using new parts or previously used partsthat satisfy Garmin's quality standards, (ii) replace the device with anew device or a refurbished device that meets Garmin's qualitystandards, or (iii) exchange the device for a full refund of yourpurchase price. SUCH REMEDY SHALL BE YOUR SOLE ANDEXCLUSIVE REMEDY FOR ANY BREACH OF WARRANTY.Repaired or replaced devices have a 90 day warranty. If the unitsent in is still under its original warranty, then the new warranty is90 days or to the end of the original 1 year warranty, whichever islonger.Before seeking warranty service, please access and review theonline help resources available on support.garmin.com. If yourdevice is still not functioning properly after making use of theseresources, contact a Garmin Authorized service facility in theoriginal country of purchase or follow the instructions on support.garmin.com to obtain warranty service. If you are in theUnited States, you can also call 1-800-800-1020.If you seek warranty service outside of the original country ofpurchase, Garmin cannot guarantee that the parts and productsneeded to repair or replace your product will be available due todifferences in product offerings and applicable standards, laws andregulations. In that case, Garmin may, in its sole discretion andsubject to applicable laws, repair or replace your product withcomparable Garmin products and parts, or require you to ship yourproduct to a Garmin Authorized service facility in the country oforiginal purchase or to a Garmin Authorized service facility inanother country that can service your product, in which case youwill be responsible for complying with all applicable import andexport laws and regulations and for paying all custom duties, V.A.T.,shipping fees and other associated taxes and charges. In somecases, Garmin and its dealers may be unable to service yourproduct in a country outside of the original country of purchase orreturn a repaired or replaced product to you in that country due toapplicable standards, laws or regulations in that country.Online Auction Purchases: Products purchased through onlineauctions are not eligible for rebates or other special offers fromGarmin warranty coverage. Online auction confirmations are notaccepted for warranty verification. To obtain warranty service, anoriginal or copy of the sales receipt from the original retailer isrequired. Garmin will not replace missing components from anypackage purchased through an online auction.International Purchases: A separate warranty may be provided byinternational distributors for devices purchased outside the UnitedStates depending on the country. If applicable, this warranty isprovided by the local in-country distributor and this distributorprovides local service for your device. Distributor warranties areonly valid in the area of intended distribution.Australian Purchases: Our goods come with guarantees thatcannot be excluded under the Australian Consumer Law. You areentitled to a replacement or refund for a major failure and forcompensation for any other reasonably foreseeable loss ordamage. You are also entitled to have the goods repaired orreplaced if the goods fail to be of acceptable quality and the failuredoes not amount to a major failure.
