THIS LIMITED WARRANTY CONTAINS IMPORTANT INFORMATION ABOUT
YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND
EXCLUSIONS THAT MAY APPLY TO YOU.
1. WHAT THIS LIMITED WARRANTY COVERS;
PERIOD OF COVERAGE
Nest Labs, Inc. (“Nest Labs”), 3400 Hillview Avenue, Palo Alto,
California USA, warrants to the owner of the enclosed product that the
product contained in this box (“Product”) will be free from defects
in materials and workmanship for a period of one (1) year from the date
of delivery following the original retail purchase (the “Warranty Period”).
If the Product fails to conform to this Limited Warranty during the
Warranty Period, Nest Labs will, at its sole discretion, either (a) repair
or replace any defective Product or component; or (b) accept the return
of the Product and refund the money actually paid by the original
purchaser for the Product. Repair or replacement may be made with
a new or refurbished product or components, at Nest Labs’ sole
discretion. If the Product or a component incorporated within it is no
longer available, Nest Labs may, at Nest Labs’ sole discretion, replace
the Product with a similar product of similar function. This is your sole
and exclusive remedy for breach of this Limited Warranty. Any Product
that has either been repaired or replaced under this Limited Warranty
will be covered by the terms of this Limited Warranty for the longer
of (a) ninety (90) days from the date of delivery of the repaired Product
or replacement Product, or (b) the remaining Warranty Period.
This Limited Warranty is transferable from the original purchaser
to subsequent owners, but the Warranty Period will not be extended
in duration or expanded in coverage for any such transfer.
2. TOTAL SATISFACTION RETURN POLICY
If you are the original purchaser of the Product and you are not satisfied
with this Product for any reason, you may return it in its original condition
within thirty (30) days of the original purchase and receive a full refund.
3. WARRANTY CONDITIONS; HOW TO GET SERVICE IF YOU WANT TO
CLAIM UNDER THIS LIMITED WARRANTY
Before making a claim under this Limited Warranty, the owner of the
Product must (a) notify Nest Labs of the intention to claim by visiting
nest.com/support during the Warranty Period and providing
a description of the alleged failure, and (b) comply with Nest Labs’
return shipping instructions. Nest Labs will have no warranty
obligations with respect to a returned Product if it determines, in its
reasonable discretion after examination of the returned Product, that
the Product is an Ineligible Product (defined below). Nest Labs will
bear all costs of return shipping to owner and will reimburse any
shipping costs incurred by the owner, except with respect to any
Ineligible Product, for which owner will bear all shipping costs.
4. WHAT THIS LIMITED WARRANTY DOES NOT COVER
This Limited Warranty does not cover the following (collectively
“Ineligible Products”): (i) Products marked as “sample” or “Not for
Sale”, or sold “AS IS”; (ii) Products that have been subject to:
(a) modifications, alterations, tampering, or improper maintenance
or repairs; (b) handling, storage, installation, testing, or use not
in accordance with the User’s Guide or other instructions provided
by Nest Labs; (c) abuse or misuse of the Product; (d) breakdowns,
fluctuations, or interruptions in electric power or the
telecommunications network; or (e) Acts of God, including but
not limited to lightning, flood, tornado, earthquake, or hurricane;
or (iii) any non-Nest Labs branded hardware products, even
if packaged or sold with Nest Labs hardware. This Limited Warranty
does not cover consumable parts, including batteries, unless
damage is due to defects in materials or workmanship of the
Product, or software (even if packaged or sold with the product).
Nest Labs recommends that you use only authorized service
providers for maintenance or repair. Unauthorized use of the
Product or software can impair the Product’s performance and
may invalidate this Limited Warranty.
5. DISCLAIMER OF WARRANTIES
EXCEPT AS STATED ABOVE IN THIS LIMITED WARRANTY, AND TO THE
MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEST LABS
DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES
AND CONDITIONS WITH RESPECT TO THE PRODUCT, INCLUDING THE
IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR
A PARTICULAR PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY
APPLICABLE LAW, NEST LABS ALSO LIMITS THE DURATION OF ANY
APPLICABLE IMPLIED WARRANTIES OR CONDITIONS TO THE
DURATION OF THIS LIMITED WARRANTY.
6. LIMITATION OF DAMAGES
IN ADDITION TO THE ABOVE WARRANTY DISCLAIMERS, IN NO
EVENT WILL NEST LABS BE LIABLE FOR ANY CONSEQUENTIAL,
INCIDENTAL, EXEMPLARY, OR SPECIAL DAMAGES, INCLUDING ANY
DAMAGES FOR LOST DATA OR LOST PROFITS, ARISING FROM OR
RELATING TO THIS LIMITED WARRANTY OR THE PRODUCT, AND
NEST LABS’ TOTAL CUMULATIVE LIABILITY ARISING FROM OR
RELATED TO THIS LIMITED WARRANTY OR THE PRODUCT WILL NOT
EXCEED THE AMOUNT ACTUALLY PAID FOR THE PRODUCT BY THE
ORIGINAL PURCHASER.

7. LIMITATION OF LIABILITY
THE NEST LABS ONLINE SERVICES (“SERVICES”) PROVIDE YOU
INFORMATION (“PRODUCT INFORMATION”) REGARDING YOUR NEST
PRODUCTS OR OTHER PERIPHERALS CONNECTED TO YOUR
PRODUCTS (“PRODUCT PERIPHERALS”). THE TYPE OF PRODUCT
PERIPHERALS THAT MAY BE CONNECTED TO YOUR PRODUCT MAY
CHANGE FROM TIME TO TIME. WITHOUT LIMITING THE GENERALITY
OF THE DISCLAIMERS ABOVE, ALL PRODUCT INFORMATION IS
PROVIDED FOR YOUR CONVENIENCE,“AS IS”, AND “AS AVAILABLE”.
NEST LABS DOES NOT REPRESENT, WARRANT, OR GUARANTEE THAT
PRODUCT INFORMATION WILL BE AVAILABLE, ACCURATE, OR RELIABLE
OR THAT PRODUCT INFORMATION OR USE OF THE SERVICES
OR PRODUCT WILL PROVIDE SAFETY IN YOUR HOME. YOU USE ALL
PRODUCT INFORMATION, THE SERVICES, AND THE PRODUCT AT YOUR
OWN DISCRETION AND RISK. YOU WILL BE SOLELY RESPONSIBLE
FOR (AND NEST LABS DISCLAIMS) ANY AND ALL LOSS, LIABILITY,
OR DAMAGES, INCLUDING TO YOUR WIRING, FIXTURES, ELECTRICITY,
HOME, PRODUCT, PRODUCT PERIPHERALS, COMPUTER, MOBILE
DEVICE, AND ALL OTHER ITEMS AND PETS IN YOUR HOME, RESULTING
FROM YOUR USE OF THE PRODUCT INFORMATION, SERVICES,
OR PRODUCT. PRODUCT INFORMATION PROVIDED BY THE SERVICES
IS NOT INTENDED AS A SUBSTITUTE FOR DIRECT MEANS OF
OBTAINING THE INFORMATION. FOR EXAMPLE, A NOTIFICATION
PROVIDED THROUGH THE SERVICE IS NOT INTENDED AS A
SUBSTITUTE FOR AUDIBLE AND VISIBLE INDICATIONS IN THE HOME
AND ON THE PRODUCT, NOR FOR A THIRD PARTY MONITORING
SERVICE THAT MONITORS ALARM STATE.
8. YOUR RIGHTS AND THIS LIMITED WARRANTY
This Limited Warranty gives you specific legal rights. You may also
have other legal rights that vary by state, province, or jurisdiction.
Likewise, some of the limitations in this Limited Warranty may not
apply in certain states, provinces or jurisdictions. The terms of this
Limited Warranty will apply to the extent permitted by applicable
law. For a full description of your legal rights you should refer to the

EXCLUSIONS QUI PEUVENT S’APPLIQUER À VOTRE CAS.
1. OBJET DE CETTE GARANTIE LIMITÉE; PÉRIODE DE COUVERTURE
Nest Labs, Inc. (« Nest Labs »), 3400 Hillview Avenue, Palo Alto,
Californie, États-Unis, garantit au propriétaire du produit joint que le
produit présent dans cette boîte (« Produit ») sera exempt de tout défaut
de matériaux et de fabrication pendant une période de un (1) an à
compter de la date de livraison suivant l’achat d’origine (la « Période
de garantie »). Si le Produit s’avère non conforme à la présente Garantie
limitée pendant la Période de garantie, Nest Labs procédera, à son
entière discrétion, soit (a) à la réparation ou au remplacement de tout
Produit ou composant défaillant; soit (b) à l’acceptation du retour du
Produit et au remboursement du montant payé par l’acheteur d’origine
du Produit. La réparation ou le remplacement peuvent avoir lieu avec
un produit ou un composant neuf ou reconditionné, à l’entière discrétion
de Nest Labs. Si le Produit ou un composant intégré à celui-ci n’est plus
disponible, Nest Labs pourra, à son entière discrétion, remplacer le
Produit par un produit similaire ou une fonction similaire. Il s’agit de votre
unique recours en cas de rupture de la présente Garantie limitée. Tout
Produit qui a fait l’objet d’une réparation ou d’un remplacement dans
le cadre de la présente Garantie limitée sera couvert par les conditions
de la présente Garantie limitée pendant la période la plus longue entre
(a) quatre-vingt-dix (90) jours à compter de la date de livraison du Produit
réparé ou du Produit de remplacement, ou (b) la durée restante de la
Période de garantie. La présente Garantie limitée peut être transférée
entre l’acheteur d’origine et les propriétaires ultérieurs, mais la Période
de garantie ne sera pas prolongée et sa couverture ne sera pas étendue
pour un tel transfert.
2. POLITIQUE DE RETOUR EN VUE D’UNE SATISFACTION TOTALE
Si vous êtes l’acheteur d’origine du Produit et si vous n’êtes pas
satisfait(e) de celui-ci, quelle qu’en soit la raison, vous pouvez le
retourner dans son état d’origine dans un délai de trente (30) jours
à compter de l’achat d’origine afin d’obtenir son remboursement
complet.
3. CONDITIONS DE LA GARANTIE; COMMENT OBTENIR UNE
RÉPARATION DANS LE CADRE DE CETTE GARANTIE LIMITÉE
Avant d’effectuer une réclamation dans le cadre de la présente Garantie
limitée, le propriétaire du Produit doit (a) informer Nest Labs de son
intention d’effectuer une réclamation à l’adresse nest.com/ca/fr/support
durant la Période de garantie et fournir une description de la défaillance
alléguée, et (b) respecter les instructions d’expédition de retour de
Nest Labs. Nest Labs ne sera soumise à aucune obligation de garantie
quant à un Produit retourné si la société détermine, à sa discrétion
raisonnable après examen du Produit retourné, que ce dernier est un
Produit non admissible (d’après la définition ci-dessous). Nest Labs
assumera la totalité des frais d’expédition de retour au propriétaire
et remboursera tous les frais d’expédition encourus par le propriétaire,
à l’exception des frais liés à tout Produit non admissible, pour lequel le
propriétaire assumera la totalité des frais d’expédition.
4. EXCLUSIONS DE CETTE GARANTIE LIMITÉE
La présente Garantie limitée ne couvre pas les produits suivants
(collectivement désignés « Produits non admissibles ») : (i) les
Produits marqués comme « échantillon » ou « Non destiné à la vente »,
ou vendus « EN L’ÉTAT »; (ii) ou les Produits qui ont fait l’objet : (a) de
modifications, d’altérations, de transformations, ou d’entretiens ou
de réparations incorrects; (b) d’une manipulation, d’un stockage,
d’une installation, de tests ou d’une utilisation non conformes au
guide de l’utilisateur ou à d’autres instructions fournies par Nest Labs;
(c) de mauvais traitements ou d’une mauvaise utilisation du Produit;
(d) de pannes, de fluctuations ou d’interruptions de l’alimentation
électrique ou du réseau de télécommunications; ou (e) de cas de force
majeure, notamment, mais s’y limiter, la foudre, une inondation, une
tornade, un tremblement de terre ou un ouragan; ou (iii) tout appareil
ne portant pas la marque Nest Labs, même emballé ou vendu avec un
appareil Nest Labs. La présente Garantie limitée ne couvre pas les
pièces consommables, notamment les piles, sauf en cas de
dommages dus à des défauts de matériaux ou de fabrication du
Produit, ni les logiciels (même si de telles pièces consommables ou de
tels logiciels sont emballés ou vendus avec le produit). Nest Labs vous
recommande de recourir uniquement aux fournisseurs de service
autorisés pour tout entretien ou toute réparation. Une utilisation non
autorisée du Produit ou du logiciel peut détériorer la performance du
Produit et invalider la présente Garantie limitée.
5. EXONÉRATION DE GARANTIES
À L’EXCEPTION DE CE QUI EST INDIQUÉ PRÉCÉDEMMENT DANS LA
PRÉSENTE GARANTIE LIMITÉE, ET DANS LES LIMITES DU DROIT
APPLICABLE, NEST LABS REJETTE LA TOTALITÉ DES GARANTIES ET
DES CONDITIONS EXPRESSES, IMPLICITES ET LÉGALES QUANT AU
PRODUIT, NOTAMMENT LES GARANTIES IMPLICITES DE QUALITÉ
MARCHANDE ET D’APTITUDE À UN EMPLOI PARTICULIER. DANS LES
Sécurité
LIMITES AUTORISÉES PAR LE DROIT APPLICABLE, NEST LABS
LIMITE ÉGALEMENT LA DURÉE DE TOUTE CONDITION OU GARANTIE
IMPLICITE APPLICABLE À LA DURÉE DE LA PRÉSENTE GARANTIE

6. LIMITATION DES DOMMAGES

SERVICES OU DU PRODUIT (ET NEST LABS REJETTE CES PERTES,
RESPONSABILITÉS OU DOMMAGES). LES RENSEIGNEMENTS SUR
LES PRODUITS FOURNIS PAR LES SERVICES NE SONT PAS DESTINÉS
À REMPLACER LES MOYENS DIRECTS D’OBTENTION DES
RENSEIGNEMENTS. PAR EXEMPLE, UNE NOTIFICATION FOURNIE PAR
LES SERVICES N’EST PAS DESTINÉE À REMPLACER DES INDICATIONS
SONORES OU VISUELLES DANS LE DOMICILE ET SUR LE PRODUIT, NI
UN SERVICE DE SURVEILLANCE TIERS QUI SURVEILLE L’ÉTAT DE

8. VOS DROITS ET LA PRÉSENTE GARANTIE LIMITÉE
La présente Garantie limitée vous accorde des droits particuliers
reconnus par la loi. Il est également possible que vous disposiez
d’autres droits reconnus par la loi, en fonction de votre État, de votre
province ou de votre juridiction. De même, certaines des limitations
contenues dans la présente Garantie limitée ne s’appliquent pas dans
certains États, certaines provinces ou certaines juridictions. Les

COBERTURA
Nest Labs, Inc. (en adelante, “Nest Labs”), 3400 Hillview Avenue, Palo Alto,
California USA, garantiza al propietario del producto contenido en esta
caja que dicho producto (en adelante, el “Producto”) no tendrá defectos
de materiales ni de fabricación durante un período de un (1) año contado
desde la fecha de entrega posterior a la compra minorista original
(el “Período de garantía”). Si el Producto no cumple con esta Garantía
limitada durante el Período de garantía, Nest Labs, ya sea por su propia
cuenta o por medio de su distribuidor autorizado, en caso de que
su información de contacto se encuentre en una etiqueta adhesiva
en el exterior del empaque del Producto, y según su exclusivo criterio:
(a) reparará o reemplazará cualquier Producto o componente defectuoso;
o bien (b) aceptará la devolución del Producto y reembolsará el dinero

se pueden efectuar con productos o componentes nuevos o
remanufacturados, según el criterio exclusivo de Nest Labs. Si el
Producto o un componente que este contenga ya no está disponible,
Nest Labs, según su exclusivo criterio, puede reemplazar el Producto
por uno similar que tenga una función parecida. Esta es absolutamente
la única solución con la que usted cuenta en caso de incumplimiento
de esta Garantía limitada. Cualquier Producto que haya sido reparado

comprador original a los propietarios subsiguientes, pero el Período
de garantía no se extenderá en duración ni se ampliará en cobertura
en ningún caso de transferencia.
2. POLÍTICA DE DEVOLUCIÓN DE SATISFACCIÓN TOTAL
Si usted es el comprador original del Producto y no está conforme
con él por alguna razón, puede devolverlo en las condiciones
originales dentro de los treinta (30) días de la compra original y
recibirá un reembolso completo.
3. CONDICIONES DE LA GARANTÍA; CÓMO OBTENER SERVICIO
SI QUIERE HACER UNA RECLAMACIÓN EN EL MARCO DE ESTA
GARANTÍA LIMITADA
Antes de efectuar una reclamación en el marco de esta Garantía
limitada, el propietario del Producto debe (a) notificar a Nest Labs de
la intención de reclamar a través de nest.com/support durante el
Período de garantía y proporcionar una descripción de la supuesta
falla y (b) cumplir con las instrucciones de envío para la devolución
de Nest Labs. Nest Labs no tendrá obligación alguna en el marco
de la garantía con respecto a un Producto devuelto si determina,
según un criterio razonable y después de examinar el Producto
devuelto, que el Producto no es elegible (esto se define a continuación).
Nest Labs se hará cargo de todos los costos de envío para la
devolución por parte del propietario mediante reembolso, salvo que
el Producto no sea elegible, en cuyo caso el propietario tendrá que
hacerse cargo de todos los costos de envío.
4. LO QUE NO CUBRE ESTA GARANTÍA LIMITADA
Esta Garantía limitada no cubre lo siguiente (en conjunto, “Productos
no elegibles”): (i) Productos identificados como “muestra” o “No apto
para la venta”, o aquellos vendidos “TAL CUAL” están; (ii) Productos
que hayan sido objeto de: (a) modificaciones, alteraciones,
adulteraciones o mantenimiento o reparaciones inapropiados;
(b) manipulación, almacenamiento, instalación, pruebas o uso no
acorde con la Guía del usuario u otras instrucciones proporcionadas
por Nest Labs; (c) maltrato o uso indebido del Producto; (d) averías,
fluctuaciones o interrupciones en el servicio de energía eléctrica o en
la red de telecomunicaciones; o (e) casos fortuitos, incluidos, entre
otros, rayos, inundaciones, tornados, terremotos o huracanes;
ni (iii) ningún otro producto de hardware cuya marca no sea Nest Labs,
aunque venga en el mismo empaque o se venda con el hardware de
Nest Labs. Esta Garantía limitada no cubre las piezas consumibles,
incluidas las baterías, a menos que se hayan dañado debido a
defectos de materiales o fabricación del Producto, ni el software
(aunque dichas piezas consumibles o software vengan en el empaque
del producto o se vendan con él). Nest Labs le recomienda que solo
use proveedores de servicios autorizados para el mantenimiento o la
reparación. El uso no autorizado del Producto o el software puede
afectar el rendimiento del Producto e invalidar esta Garantía limitada.
5. EXCLUSIÓN DE GARANTÍAS
A EXCEPCIÓN DE LO ESTABLECIDO ANTERIORMENTE EN ESTA
GARANTÍA LIMITADA, Y EN LA MÁXIMA MEDIDA PERMITIDA POR LA
LEY VIGENTE, NEST LABS NO SE HARÁ RESPONSABLE DE NINGUNA
GARANTÍA NI CONDICIÓN EXPRESA, IMPLÍCITA NI ESTATUTARIA CON
RESPECTO AL PRODUCTO, INCLUIDAS LAS GARANTÍAS IMPLÍCITAS DE
COMERCIABILIDAD O APTITUD PARA UN FIN DETERMINADO. EN LA
MÁXIMA MEDIDA PERMITIDA POR LA LEY VIGENTE, NEST LABS
TAMBIÉN LIMITA LA DURACIÓN DE CUALQUIER GARANTÍA O CONDICIÓN
IMPLÍCITA APLICABLE A LA DURACIÓN DE ESTA GARANTÍA LIMITADA.
6. LIMITACIÓN DE DAÑOS
ADEMÁS DE LAS EXCLUSIONES DE LAS GARANTÍAS MENCIONADAS
ARRIBA, NEST LABS EN NINGÚN CASO SE HARÁ RESPONSABLE DE
NINGÚN DAÑO INDIRECTO, FORTUITO, TIPIFICADO O CUANTIFICABLE,
INCLUIDO CUALQUIER DAÑO POR PÉRDIDA DE DATOS O PÉRDIDA
DE RENTABILIDAD QUE SE DESPRENDA DE ESTA GARANTÍA LIMITADA
O SE RELACIONE CON ELLA O CON EL PRODUCTO. ADEMÁS,
LA RESPONSABILIDAD ACUMULADA TOTAL DE NEST LABS QUE
SE DESPRENDA DE ESTA GARANTÍA LIMITADA O SE RELACIONE
CON ELLA O CON EL PRODUCTO NO SUPERARÁ LA CANTIDAD
REALMENTE PAGADA POR EL PRODUCTO POR PARTE DEL
COMPRADOR ORIGINAL.
7. LIMITACIÓN DE LA RESPONSABILIDAD
LOS SERVICIOS EN LÍNEA DE NEST LABS (EN ADELANTE, LOS
“SERVICIOS”) LE BRINDAN INFORMACIÓN (“INFORMACIÓN DEL
PRODUCTO”) RESPECTO A SUS PRODUCTOS NEST U OTROS
PERIFÉRICOS CONECTADOS A SUS PRODUCTOS (“PERIFÉRICOS DE
LOS PRODUCTOS”). EL TIPO DE PERIFÉRICOS DE LOS PRODUCTOS
QUE SE PUEDE CONECTAR A SU PRODUCTO PUEDE CAMBIAR DE VEZ
EN CUANDO. SIN LIMITAR LAS GENERALIDADES DE LAS EXCLUSIONES
ANTERIORES, TODA LA INFORMACIÓN DE LOS PRODUCTOS SE
PROPORCIONA PARA SU CONVENIENCIA “TAL CUAL ESTÁ” Y “SEGÚN
ESTÉ DISPONIBLE”. NEST LABS NO MANIFIESTA, ASEGURA NI
GARANTIZA QUE LA INFORMACIÓN DE LOS PRODUCTOS ESTÉ
DISPONIBLE NI QUE ESTA SEA PRECISA NI CONFIABLE, NI QUE LA
INFORMACIÓN DE LOS PRODUCTOS O EL USO DE LOS SERVICIOS O
DEL PRODUCTO PROPORCIONE SEGURIDAD EN SU HOGAR. USTED
USA TODA LA INFORMACIÓN DE LOS PRODUCTOS, LOS SERVICIOS Y EL
PRODUCTO POR CUENTA Y RIESGO PROPIOS. USTED SERÁ EL ÚNICO
RESPONSABLE Y NEST LABS NO SE HARÁ CARGO DE NINGUNA
PÉRDIDA, OBLIGACIÓN O DAÑO, INCLUIDOS AQUELLOS QUE AFECTEN
A SU CABLEADO, SUS ARTEFACTOS, SUS INSTALACIONES
ELÉCTRICAS, SU CASA, SU PRODUCTO, SUS PRODUCTOS
PERIFÉRICOS, SU COMPUTADORA, SU DISPOSITIVO MÓVIL NI NINGÚN
OTRO ELEMENTO O MASCOTA DE SU CASA QUE RESULTE DEL USO
QUE USTED HAGA DE LA INFORMACIÓN DEL PRODUCTO, LOS

PROPORCIONADA POR LOS SERVICIOS NO TIENE LA INTENCIÓN DE
SER UN SUSTITUTO DE LOS MEDIOS DIRECTOS DE OBTENER LA
INFORMACIÓN. POR EJEMPLO, UNA NOTIFICACIÓN SUMINISTRADA A
TRAVÉS DEL SERVICIO NO TIENE LA INTENCIÓN DE SER UN
SUSTITUTO DE LAS INDICACIONES AUDIBLES Y VISIBLES DE LA CASA
Y DEL PRODUCTO, NI DEL SERVICIO DE MONITOREO DE UN TERCERO
QUE CONTROLE EL ESTADO DE LA ALARMA.
8. SUS DERECHOS Y ESTA GARANTÍA LIMITADA
Esta Garantía limitada le otorga derechos legales específicos. Usted
también puede tener otros derechos legales que varían en función del
estado, la provincia o la jurisdicción. Asimismo, es posible que
algunas de las limitaciones de esta Garantía limitada no se apliquen
