This User Guide contains information on GoPhone Pay As You Go and using the features of this service. Please consult the GoPhone Pay As You Go brochure or call Automated Customer Service for detailed information regarding the charges and fees associated with your service. Note your phone number and passcode here: Passcode: - Terms of Service Your Phone Number Is: 23 Account Passcode Your initial account passcode is the last four digits of your wireless phone number. You will be required to change this password to access online customer service. For your security, we recommend you change your passcode to a secure code other than the last four digits of your wireless phone number. You can change your passcode at any time through online customer service (att.com/mygophone) or by speaking with a customer service representative. If you forget your passcode, you can use online customer service to have it text messaged to your phone free of charge. A fee may be charged for calls to add funds using a live representative. • Pay by cash by visiting an AT&T store or one of more than 200,000 authorized retail locations in the U.S. and purchase a refill card or PIN Refilling Your Account Refill before your current balance expires, and the balance carries over to the new expiration date. You can refill when your balance is depleted or low in one of the following ways: Account Passcode GoPhone Pay As You Go service allows you to pay in advance for your airtime. The cost of every call you make or receive will be deducted from your account in full-minute increments. The deduction may be delayed if AT&T experiences a system interruption or other downtime. Take the hassle out of refilling by enrolling in Auto Refill Enroll your account in Auto Refill, and the airtime value you choose will be automatically charged to your credit or debit card on the date you specify. Enroll in one of the following ways: • Visit att.com/mygophone and select the link to “Refill Your Minutes with a Credit or Debit Card,” then “Manage My Account.” Log in, then select the option “Set Up Auto Refill.” • Call 611 and from the Main Menu, select “Manage My Account” and then the option to “Set Up Auto-Pay.” Auto Refill plans to choose from include: Weekly Plan, Pay Day Plan, Monthly Plan or Expiration Protection Plan. 5 Refilling Your Account How to refill your account by purchasing a Pay As You Go card STEP 1 25 REFILL YO U R ACCO U N T $ Then save by adding Feature Packages: TEXT MESSAGING — UNLIMITED, 1000 OR 200 NIGHT & WEEKEND MINUTES DATA — UNLIMITED — 1 MB OR 100 MB Purchase a Pay As You Go card at one of AT&T’s stores. STEP 2 Prepaid PIN # Locate the PIN number associated with the prepaid card. In many cases the PIN will be on the back of your card SCRATCH OFF or printed on your receipt. GRAY BOX STEP 3 Follow instructions on back of card or printed on PIN receipt to add PIN value to account. With most refill cards, you can add PIN value using your prepaid phone keypad; enter 888 followed by PIN number, then the # key (e.g., 888 PIN NUMBER#) and press SEND. Or go to att.com/mygophone or dial 611 and select the option to “Add Money.” * * * * Once you have entered your prepaid card number, you will be informed of your new balance and expiration date. In many locations, GoPhone Pay As You Go cards may be returned to the place of purchase within 30 days if the scratch-off strip has not been removed. Electronic PINs printed on a sales receipt are not returnable. Refund policy may vary depending on the place of purchase. 6 Tracking Your Balance & Expiration Date * With these notifications, you will receive refill options. You can bypass these options, if funds are available, by pressing “#” to continue the call. Although AT&T will send you timely refill messages, delivery cannot be guaranteed. Tracking Your Balance & Expiration Date The Pay As You Go system will notify you to refill your account when: • Your account balance is low • Your account has 10 days left before it expires • Your account balance is too low to pay for a call Refilling Your Account TRACKING YOUR BALANCE & EXPIRATION DATE: At the end of each call you place or receive, the cost of the call will be deducted from your account in full-minute increments. • A text message indicating your current balance will be sent to the display of your phone following each charged call you place or receive • You may dial 777# and press SEND to receive a text message indicating your account balance and expiration date • Or you may call 611 at any time and follow the prompts to hear your current balance and expiration date. There is no charge for calls to Automated Customer Service (611). 7 Start Talking Coverage area Please review the coverage map in the sales brochure or go to att.com/gophone and select “Learn about Pay As You Go,” which shows the scope of your calling plan area as well as information on coverage when roaming in Mexico. The map depicts an approximation of outdoor coverage. The map may include areas covered by unaffiliated carriers and may depict their licensed area rather than an approximation of the coverage. The actual coverage area may differ substantially from the area shown on the map, as coverage may be affected by terrain, weather, foliage, buildings and other construction, signal strength, customer equipment and other factors. AT&T does not guarantee coverage or network availability. Charges will be based on the location of the site receiving and transmitting the call, not your location. Rates apply to calls to and from the GoPhone coverage area. Your phone’s display does not indicate the rate you will be charged. Placing a call Place calls with your GoPhone Pay As You Go service while within your coverage area to: • Other wireless phones • Landline phones • Long distance and out-of-state domestic telephone numbers • International numbers (visit att.com/gophone for additional information) • Toll-free numbers (airtime charges apply) • Directory Assistance (per-call charge plus airtime charges apply) You can use your GoPhone service just as you would any other wireless phone; however, calls to premium-rate numbers (e.g., 900, 976) and collect calls are not available with GoPhone service. (In some areas, conference calling is available, which lets you talk with up to five people at the same time. This feature is available only on select phones.) CALLER ID: Lets you know who’s calling. CALL WAITING1: Lets you know when you have another call and gives you the option of placing the first call on hold. CALL HOLD1: Keeps one caller on the line while you place or receive another call. Also acts as a mute button. CALL FORWARDING1: Forwards calls to another number. INTERNATIONAL LONG DISTANCE1: Dial directly from your wireless phone to friends, family and business associates around the world. DIRECTORY ASSISTANCE1: Dial 411 on your wireless phone, get the phone numbers you need and be automatically connected to them. You’ll get Directory Assistance, driving directions and much more. 1 Additional airtime and other charges apply to feature usage. Setting up voicemail may trigger daily access fee on applicable plans. See your GoPhone Pay As You Go brochure for details. 10 Enhanced Features INTERNATIONAL ROAMING IN MEXICO: You can now use your Pay As You Go service when you travel to Mexico. No additional feature is required to roam in Mexico – all Pay As You Go customers are automatically eligible. Roaming charges apply. See sales brochure for rates. For coverage information, go to att.com/gophone. When roaming outside the U.S., most phones allow you to reach voicemail by holding down the “1” key. If you are unable to reach voicemail this way, dial your own wireless number (inserting a +1 before the number) and press the ” “ key during the voicemail greeting. You will need to know your voicemail passcode. Calls to voicemail when roaming internationally are billed at the roaming rates. Enhanced Features While roaming outside the U.S., be sure to make all international calls using the international format (+ country code, phone number). For example, to place an international call back to the United States, dial +1, then the area code and phone number (the U.S. country code is “1”). In most GSM devices, holding down the “0” key will cause the “+” sign to appear. To make a call in Mexico, dial the 10-digit number, including the area code and local number. Basic Features You can reach Automated Assistance or Customer Service while roaming in Mexico by calling 611 (from your wireless phone) or +1 (408) 962-1025 (from any landline phone). * 11 TEXT MESSAGING1: With Text Messaging, you can send and receive short messages directly from your wireless phone to any other wireless phone, regardless of the service provider. It’s a quick, easy and discreet way to communicate. Messaging packages available. See section “PAY AS YOU GO FEATURE PACKAGES” and brochure for more details. INTERNATIONAL TEXT MESSAGING2: Send and receive text messages to and from wireless phones in over 100 countries worldwide. • International messages should be dialed using the following format: 011 + country code + wireless number (example: 0114412345678) • You can also send an international message by replacing 011 with a “+” (example: +4412345678) RINGTONES, RINGBACK TONES, GAMES AND WALLPAPERS1,2: Personalize your phone with its own ringtones, screensaver or wallpaper. Download a variety of games. From your wireless phone, select AppCenter from the main menu. Or go to att.com/rings to select your favorite. DATA1,2: Connect to the Mobile Web, search, email, apps and more. Get directions, download ringtones and games. Get access to your favorite websites like CNN, ESPN, Facebook, Google and more. MOBILE WEB PARENTAL CONTROLS: Allows parents the ability to restrict access to content on the Mobile Web that may be inappropriate for younger viewers, plus block access to the Mobile Web search function. 12 Controlling Content: Set Content Filters to “On” or “Off.” “On” restricts access to sites with mature content on MEdia™ Net (Mobile Web) and shuts off access to the broader Mobile Web via the search function. “Off” has no restrictions, and all content is visible and accessible. The default is set to “Off.” Controlling MEdia Net (Mobile Web) Purchases: Set Purchase Blocker to “On” or “Off.” “On” prevents your children from purchasing premium content, including ringtones, downloads, games and graphics. “Off” allows all purchases. The default is set to “Off.” (Note: Turning Purchase Blocker on will cancel any existing subscriptions you have, as well as prevent future one-time and subscription purchases.) How to Set Parental Controls: Go to MEdia Net (Mobile Web) Home on your wireless phone, select “Customize MEdia Net (Mobile Web)” and then select “Parental Controls.” Change “Content Filters” and/or “Purchase Blocker” setting to “On.” Enhanced Features Pricing: There is no charge to use MEdia Net (Mobile Web) Parental Controls. The only charge is for the brief data usage needed to set the controls if done from the handset. You can also manage Mobile Web Parental Controls free of charge by contacting customer service at 611 from your handset or 1-800-901-9878 from any landline phone. You will be required to establish a PIN code and provide your email address. (Email address will be used for verification purposes only, and if you need to reset your PIN.) Settings can be easily changed anytime by using your PIN code by contacting customer service. No filtering is 100% accurate, and AT&T does not guarantee filtering accuracy. 13 INSTANT MESSAGING1,2: With GoPhone Pay As You Go, you can receive and reply to AOL® instant messages or Yahoo!® instant messages. With Mobile Instant Messaging, available on select phones, you can chat with anyone from the Buddy List® on your wireless phone. It keeps you connected, even when you’re on the go. How can I keep my current phone number? A: Do not terminate your service with your existing company before initiating service with AT&T. Complete activation of new service, then dial 611 and press “4” for “More Options,” then “0” to talk to a Customer Care Representative who can assist you with porting your current wireless phone number. (Port-in rules apply). Q: What happens if I run out of funds in my account? A: • Purchase a new card or PIN at any AT&T retail location or participating authorized dealer • To pay by credit card, debit card or checking account, dial 611 from your wireless phone and select the “Add Money” option from the menu OR • Refill online at att.com/mygophone Q: How do I check my expiration date? A: You may dial 777# and press SEND to receive a text message indicating your account balance and expiration date, or dial 611 from your wireless phone and select the “Get My Account Balance” option, or go to att.com/mygophone and get additional details about your account. * Q: What happens to the balance in my account if I don’t use all the funds before they expire? A: Funds would be forfeited, and the account would begin a 60-day grace period before it is deactivated. However, refill your account before your current balance expires and the balance carries over to the new expiration date. 16 Q: How do I make a call? A: To make a domestic call on your wireless phone: • Press the POWER key to turn on your phone • Dial the phone number by entering the area code first and then the 7-digit number • Press the SEND key. This button may contain a green icon. • To end the call, press the END button. This button may contain a red icon. Frequently Asked Questions Q: Where can I get information about new GoPhone offers or updates about my service? A: Register your account at att.com/mygophone to receive updates about your service. Or you can call Automated Customer Service (611) and get information about changes to your service, your promotions or rate plan. Q: My phone will not power on. What should I do? A: Make sure your battery is charged. To turn on some phones, for at least five you must press and hold the POWER key to seven seconds. If you are still unable to turn on your phone, take it back to the place of purchase for further assistance. Q: What is Directory Assistance (411)? A: AT&T Directory Assistance provides telephone numbers and addresses of business, government and residential listings throughout the United States. Additional charges apply. Note: This service is provided by AT&T and may not be available while roaming outside the AT&T wireless network. Q: Why can’t I download ringtones from a non-AT&T website? A: AT&T service does not support downloadable ringtones from external sites. You must use ringtones available for download at att.com/rings. 17 Q: Can I download all of the content that is available on the AT&T website? A: No. Content availability varies with each handset. Q: Is there a cost to use Data Services? A: Yes. There is a premium cost for content such as ringtones, games and wallpapers. Additionally, data usage charges will apply to download the content. Charges also apply to texting and web browsing, unless you have purchased a feature package. Pay-per-use rates apply without a feature package or if the feature package is depleted or expired. Q: Why was I charged when calling voicemail? A: Per-minute charges and daily-access-fee charges (if applicable) apply to voicemail retrievals. Q: Why was I charged more than the timer on my phone? A: Voice usage is deducted in full-minute increments with partial minutes rounded up to the next full minute at the end of each call. The timer on your phone may indicate usage of one minute and 15 seconds (1:15). Because AT&T bills in full-minute increments, you will actually be charged for a total of two full minutes. For answers to other FAQs, call Automated Customer Service by dialing 611 from your Pay As You Go phone and selecting the option for “Frequently Asked Questions.” 18 Customer Service Customer Service Handset Exchange by Mail: • Warranty repairs for your GoPhone are as simple as dialing 1-800-801-1101 Frequently Asked Questions ONLINE CUSTOMER SERVICE: You can also access and manage your account online at att.com/mygophone. Your wireless number and account passcode are required to access online customer service. With online account management, you can: • Add funds to your account • Check your balance and expiration date • Review recent account activity • Review the details of your rate option • Check the status and balance of any active feature package(s) you have purchased • Sign up for feature packages • Set up automatic feature package renewal every 30 days • Change your passcode • Enter/modify your personal profile • Request that your passcode be sent to your phone free of charge if you forget it 19 MY ACCOUNT: With My Account, GoPhone customers can access account management services from their handsets. You can use My Account to purchase airtime with a credit or debit card, add funds from a Pay As You Go Card or PIN, view your account balance and expiration date, check your feature package balance, add feature packages, set up automatic renewal on your feature packages and reset your account passcode or voicemail password – all right from your phone, 24/7. Some handsets feature an instant link to My Account by pressing the left navigation key. The My Account screen will display, showing your balance and expiration date. Follow the on-screen instructions to refill your account or access other options. There is no charge for using My Account. If your handset does not include this feature, you may access My Account by connecting to MEdia™ Net (Mobile Web) from your device. Once you reach the MEdia Net (Mobile Web) Home page, scroll to the bottom of the page and select the “My Account” link. You will need your four-digit account passcode to purchase airtime. There is no charge for using “My Account,” however you will be charged for kilobyte usage while navigating through the MEdia Net (Mobile Web) entryway to access the “My Account” link. In addition, you must have a $5 minimum account balance to access MEdia Net (Mobile Web). To avoid these charges and the minimum balance requirement, simply bookmark the “My Account” link/url so that you can access it directly. To set up a bookmark, refer to the instructions in your handset owner’s manual. Please note, to refill with a credit or debit card from your phone, you must first call 611 and complete a credit/debit card refill to set up your payment card. 20 Terms of Service GOPHONE TERMS OF SERVICE: “AT&T” or “we,” “us” or “our” refers to AT&T Mobility LLC, acting on behalf of its FCC-licensed affiliates doing business as AT&T. “You” or “your” refers to the person or entity that is the customer of record and/or purchases or uses the Equipment or Device (as defined below). This GoPhone Terms of Service is an agreement between AT&T and you (“Agreement.”) PLEASE READ THIS AGREEMENT CAREFULLY TO ENSURE THAT YOU UNDERSTAND EACH PROVISION. PLEASE NOTE: This Agreement requires the use of arbitration on an individual basis to resolve disputes, rather than jury trials or class actions, and also limits the remedies available to you in the event of a dispute. Terms of Service Customer Service Terms of Service CHARGES: You are responsible for paying all charges for or resulting from services provided under this Agreement. Charges may include, without limitation: airtime, roamer, recurring monthly service, activation, administrative, returned-check and late-payment charges; network and other surcharges; optional feature charges; toll, collect-call and directory-assistance charges; any other charges or calls charged to your phone number; and applicable taxes, surcharges and governmental fees, whether assessed directly upon you or upon AT&T. AT&T may add its own charges to those charged by third parties. Payment for all charges is made in advance and there is no proration of such charges. You agree to pay for incoming and outgoing calls to and from your phone. AIRTIME AND OTHER MEASURED VOICE USAGE (“CHARGEABLE TIME”) IS BILLED IN FULL-MINUTE INCREMENTS AND IS ROUNDED UP TO THE NEXT FULL-MINUTE INCREMENT AT THE END OF EACH CALL FOR CHARGING PURPOSES. AT&T CHARGES A FULL MINUTE OF AIRTIME USAGE FOR EVERY FRACTION OF THE LAST MINUTE OF AIRTIME USED ON EACH WIRELESS CALL. DATA TRANSPORT IS BILLED IN FULL-KILOBYTE INCREMENTS, AND ACTUAL TRANSPORT IS ROUNDED UP TO THE NEXT FULL KILOBYTE INCREMENT AT THE END OF EACH DATA SESSION FOR CHARGING PURPOSES. AT&T CHARGES A FULL KILOBYTE OF DATA TRANSPORT FOR EVERY FRACTION OF THE LAST KILOBYTE OF DATA TRANSPORT USED ON EACH DATA SESSION. NETWORK OVERHEAD, SOFTWARE UPDATE REQUESTS, AND RE-SEND REQUESTS CAUSED BY NETWORK ERRORS CAN INCREASE MEASURED KILOBYTES. If you select a rate plan or additional features that include a predetermined allotment of services (for example, a predetermined amount of airtime, megabytes or text messages), unless otherwise specifically provided as part of such rate plan, any unused allotment of services from one monthly period will not carry over to the next monthly period. Additional charges may apply for detailed information about your usage of services. Charges for usage 21 of services on networks maintained by other carriers or on networks acquired by AT&T after August 31, 2004, may be delayed. Chargeable Time begins for outgoing calls when you press SEND (or similar key) and for incoming calls when a signal connection from the caller is established with our facilities. Chargeable Time ends after you press END (or similar key), but not until your wireless telephone’s signal of call disconnect is received by our facilities and the call disconnect signal has been confirmed. All outgoing calls for which we receive answer supervision or which have at least 30 seconds of Chargeable Time, including ring time, shall incur a minimum of one-minute airtime charge. Answer supervision is generally received when a call is answered; however, answer supervision may also be generated by voicemail systems, private branch exchanges, and interexchange switching equipment. Chargeable Time may include time for us to recognize that only one party has disconnected from the call, time to clear the channels in use, and ring time. Chargeable Time may also occur from other uses of our facilities, including by way of example, voicemail deposits and retrievals, and call transfers. DISPUTES: WITHIN 100 DAYS OF THE DATE OF ANY EVENT GIVING RISE TO A DISPUTE, YOU MUST NOTIFY US IN WRITING AT AT&T, BILL DISPUTE, 1025 LENOX PARK BLVD., ATLANTA, GA 30342 (“AT&T’S ADDRESS”) OF SUCH DISPUTE, INCLUDING A DISPUTE OVER ANY CHARGES AND ANY SERVICE WE PROVIDED, OR YOU WILL HAVE WAIVED YOUR RIGHT TO DISPUTE THE CHARGE OR SUCH SERVICES AND TO BRING, OR PARTICIPATE IN, ANY LEGAL ACTION RAISING ANY SUCH DISPUTE. DEVICE: The wireless phone or other device assigned to your account (“Device”) must be compatible with, and not interfere with, our service, and must comply with all applicable laws, rules and regulations. A Device capable only of using data service is not allowed with GoPhone service. We may periodically program your Device remotely with system settings for roaming service, to direct your Device to use network services most appropriate for your typical usage, and other features that cannot be changed manually. Devices purchased for use on AT&T’s systems are designed for use only on AT&T’s network (“Equipment”) and may not function on other wireless networks. Equipment is sold exclusively for use with GoPhone service and may not be resold. By purchasing such Equipment, you agree to activate and use it on GoPhone service. You also agree that you will not make, nor will you assist others to make, any modifications to the Equipment or programming to enable the Equipment to operate on any other system. AT&T may, at its sole and absolute discretion, modify the programming to enable the operation of 22 the Equipment on other systems. You understand and acknowledge that the Equipment is sold solely for use with AT&T’s GoPhone service and that AT&T will be significantly damaged if you use or assist others to use the Equipment for any other purpose. You agree not to take any action to circumvent limits on the quantity of Equipment that may be purchased. You will be liable to AT&T for any damages resulting from the conduct prohibited in this section. LOCATION-BASED SERVICES: Your Device may be location-enabled, meaning that the Device is capable of using optional Goods, Content, and Services, at your request or the request of a user on your account, offered by AT&T or third parties that make use of a user’s location (“Location-Based Services”), using location technology such as Global Positioning Satellite (“GPS”), wireless network location, or other location technology. Please review the terms and conditions and the associated privacy policy for each Location-Based Service to learn how the location information will be used and protected. We may also use location Terms of Service PURCHASES AND AUTHORITY TO USE: Your Device can be used to purchase goods and services including ringtones, graphics, games or news alerts (including subscription plans) from AT&T or elsewhere from third parties (“Goods, Content, and Services”). Goods, Content, and Services may be purchased directly with any Device assigned to your account or online. Data transport charges are also incurred in the purchase of Goods, Content, and Services. Unless you have a data feature, in which case you will be billed according to your data feature, you will be charged at the standard perkilobyte charge for the Goods, Content, and Services transport when delivered. You have full-time access to your Goods, Content, and Services transaction history on our website. You are responsible for all Devices containing a SIM assigned to your account. Except as otherwise provided in this Agreement, if such Device is used by others to purchase Goods, Content, and Services, you are responsible for all such purchases and all associated charges. You are giving those other users your authority: 1) to order Goods, Content, and Services from the Device, including subscription services, and to incur charges for those Goods, Content, and Services, and 2) to give any consent required for those Goods, Content, and Services, including the consent to use that user’s location information to deliver customized information to that user’s Device, or to make any representation required for those Goods, Content, and Services, including a representation of the user’s age, if requested. Usage by others can be restricted by use of parental controls or similar features. Such aggregate data may be used for services like traffic monitoring. It is your responsibility to notify users on your account that the Device they are using may be location-enabled. AT&T 411 INFO: In some cases our directory assistance service (411) will use the location of the Device to deliver relevant customized 411 information based upon the user’s request for a listing or other 411 service. By using this directory assistance service, the user is consenting to our use of that user’s location information for such purpose. This location information may be disclosed to a third party to perform the directory assistance service and for no other purpose. Such location information will be retained only as long as is necessary to provide the relevant customized 411 information and will be discarded after such use. LOST OR STOLEN PHONES: If your Device is lost or stolen, you must contact us immediately to report the Device lost or stolen. If your Device is lost or stolen, you will be responsible for all charges incurred on your phone number until you report the theft or loss. You can report your Device as lost or stolen and suspend service without a charge by contacting us. After you report the theft or loss to us, you remain responsible for complying with your other obligations under this Agreement including, but not limited to, payment of any monthly service fees. We and you have a duty to act in good faith and in a reasonable and responsible manner, including in connection with the loss or theft of your Device. DISHONORED CHECKS AND OTHER INSTRUMENTS: We will charge you $30.00 or the highest amount allowed by law, whichever is less, for any check or other instrument (including any credit card chargebacks) tendered by you and returned unpaid by a financial institution for any reason. You agree to reimburse us the fees of any collection agency, which may be based on a percentage at a maximum of 33% of the debt, and all costs and expenses, including reasonable attorneys’ fees, we incur in such collection efforts. CHANGES TO TERMS AND RATES: We may change any terms, conditions, rates, fees, expenses, or charges regarding your service at any time. We will provide you with notice of such changes (other than changes to governmental 24 fees, proportional charges for governmental mandates, roamer rates or administrative charges) by such means as AT&T determines to be most practicable, including playing a recorded message when you attempt to place a call or attempt to add funds to your account, sending written notice to the address provided at the time of activation, sending an SMS message to your phone, or by such other means as AT&T may determine. You understand and agree that State and Federal Universal Service Fees and other governmentally imposed fees, whether or not assessed directly upon you, may be increased based upon the government’s or our calculations. IF WE INCREASE THE PRICE OF ANY OF THE SERVICES TO WHICH YOU SUBSCRIBE, AS SUCH PRICES ARE SET FORTH IN YOUR RATE PLAN BROCHURE, OR IF WE MATERIALLY DECREASE THE GEOGRAPHICAL AREA IN WHICH YOUR AIRTIME RATE APPLIES (OTHER THAN A TEMPORARY DECREASE FOR REPAIRS OR MAINTENANCE), WE WILL DISCLOSE THE CHANGE IN ADVANCE. If you lose your eligibility for a particular rate plan, we may change your rate plan to one for which you qualify. SERVICE LIMITATIONS; LIMITATION OF LIABILITY: Limitations of liability set forth herein govern unless they are prohibited by applicable law. Service may be interrupted, delayed or otherwise limited for a variety of reasons, including environmental conditions, unavailability of radio frequency channels, system capacity, priority access by National Terms of Service TERMINATION: Either party may terminate this Agreement (which will terminate the provision of the Service) at any time on advance notice to the other party. Funds deposited into your account via any method will not be refunded. AT&T may terminate this Agreement at any time without notice if we cease to provide service in your area. We may interrupt or terminate your service without notice for any conduct that we believe violates this Agreement or any terms and conditions of your rate plan, or if you behave in an abusive, derogatory or similarly unreasonable manner with any of our representatives, or if you fail to make all required payments when due or if we have reasonable cause to believe that your Device is being used for an unlawful purpose or in a way that may adversely affect our service. If you have more than one account with us, you must keep all accounts in good standing to maintain service. If one account is past due or over its limit, all accounts in your name are subject to interruption or termination and all other available collection remedies. Any provision of this Agreement which by its context is intended to apply after termination of the Agreement will survive termination, including, but not limited to, any restrictions on the use of Devices or Equipment. 25 Security and Emergency Preparedness personnel in the event of a disaster or emergency, coordination with other systems, equipment modifications and repairs, and problems with the facilities of interconnecting carriers. We may block access to certain categories of numbers (e.g. 976, 900 and international destinations) in our sole discretion. Your plan may include the ability to make and/or receive calls while roaming internationally. Certain eligibility restrictions apply which may be based on factors such as service tenure and/or payment history and AT&T, in its sole discretion, may block your ability to use your phone while roaming internationally until eligibility criteria is met. International roaming rates, which vary by country, will apply for all calls placed or received while outside the U.S., Puerto Rico and USVI. Compatible international-capable device required. If you want to block the ability to make and/or receive calls or use data functions while roaming internationally dial 1-916-843-4685. When outside the U.S., Puerto Rico and USVI, you will be charged normal international roaming airtime when incoming calls are routed to voicemail, even if no message is left. WE DO NOT GUARANTEE YOU UNINTERRUPTED SERVICE OR COVERAGE. WE CANNOT ASSURE YOU THAT IF YOU PLACE A 911 CALL YOU WILL BE FOUND. Airtime and other service charges apply to all calls, including involuntarily terminated calls. AT&T MAKES NO WARRANTY, EXPRESS OR IMPLIED, OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, SUITABILITY, OR PERFORMANCE REGARDING ANY SERVICES OR GOODS, AND IN NO EVENT SHALL AT&T BE LIABLE, WHETHER OR NOT DUE TO ITS OWN NEGLIGENCE, for any: (a) act or omission of a third party; (b) mistakes, omissions, interruptions, errors, failures to transmit, delays or defects in the service provided by or through us; (c) damage or injury caused by the use of service or Device, including use in a vehicle; (d) claim against you by third parties; (e) damage or injury caused by a suspension or termination of service by AT&T; or (f) damage or injury caused by failure or delay in connecting a call to 911 or any other emergency service. Notwithstanding the foregoing, if your service is interrupted for 24 26 or more continuous hours by a cause within our control, we will issue you, upon request, either a credit equal to a pro-rata adjustment of any recurring charge (if applicable) for the time period your service was unavailable, not to exceed the charges collected for the period of interruption, or an extension of the expiration period. Our liability to you for service failures is limited solely to the credit set forth above. Unless applicable law precludes parties from contracting to so limit liability, and provided such law does not discriminate against arbitration clauses, AT&T shall not be liable for any indirect, special, punitive, incidental or consequential losses or damages you or any third party may suffer by use of, or inability to use, service or Device provided by or through AT&T, including loss of business or goodwill, revenue or profits, or claims of personal injuries. To the full extent allowed by law, you hereby release, indemnify, and hold AT&T and its officers, directors, employees and agents harmless from and against any and all claims of any person or entity for damages of any nature arising in any way from or relating to, directly or indirectly, service provided by AT&T or any person’s use thereof (including, but not limited to, vehicular damage and personal injury), INCLUDING CLAIMS ARISING IN WHOLE OR IN PART FROM THE ALLEGED NEGLIGENCE OF AT&T, or any violation by you of this Agreement. This obligation shall survive termination of your service with AT&T. AT&T is not liable to you for changes in operation, equipment or technology that cause your Device or software to be rendered obsolete or require modification. SOME STATES, INCLUDING THE STATE OF KANSAS, DO NOT ALLOW DISCLAIMERS OF IMPLIED WARRANTIES OR LIMITS ON REMEDIES FOR BREACH. THEREFORE, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS AGREEMENT GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. VOICEMAIL SERVICE: We may deactivate your voicemail service if you do not initialize it within a reasonable period after activation. We will reactivate the service upon your request. Terms of Service ACCOUNT ACCESS: You authorize us to provide information about and to make changes to your account, including adding new service, upon the direction of any person able to provide information we deem sufficient to identify you. An account password will be assigned to you. In order to protect the security of your account, you should change this password as soon as possible after your account is activated. If you do not change your password, your account may not be secure. 27 DISPUTE RESOLUTION BY BINDING ARBITRATION: Please read this carefully. It affects your rights. Summary: Most customer concerns can be resolved quickly and to the customer’s satisfaction by calling our customer service department at 1-800-331-0500. In the unlikely event that AT&T’s customer service department is unable to resolve a complaint you may have to your satisfaction (or if AT&T has not been able to resolve a dispute it has with you after attempting to do so informally), we each agree to resolve those disputes through binding arbitration or small claims court instead of in courts of general jurisdiction. Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, allows for more limited discovery than in court, and is subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. Any arbitration under this Agreement will take place on an individual basis; class arbitrations and class actions are not permitted. For any non-frivolous claim that does not exceed $75,000, AT&T will pay all costs of the arbitration. Moreover, in arbitration you are entitled to recover attorneys’ fees from AT&T to at least the same extent as you would be in court. In addition, under certain circumstances (as explained below), AT&T will pay you more than the amount of the arbitrator’s award and will pay your attorney (if any) twice his or her reasonable attorneys’ fees if the arbitrator awards you an amount that is greater than what AT&T has offered you to settle the dispute. ARBITRATION AGREEMENT (1) AT&T and you agree to arbitrate all disputes and claims between us. This agreement to arbitrate is intended to be broadly interpreted. It includes, but is not limited to: • claims arising out of or relating to any aspect of the relationship between us, whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory; • claims that arose before this or any prior Agreement (including, but not limited to, claims relating to advertising); • claims that are currently the subject of purported class action litigation in which you are not a member of a certified class; and • claims that may arise after the termination of this Agreement. 28 References to “AT&T,” “you,” and “us” include our respective subsidiaries, affiliates, agents, employees, predecessors in interest, successors, and assigns, as well as all authorized or unauthorized users or beneficiaries of services or Devices under this or prior Agreements between us. Notwithstanding the foregoing, either party may bring an individual action in small claims court. This arbitration agreement does not preclude you from bringing issues to the attention of federal, state, or local agencies, including, for example, the Federal Communications Commission. Such agencies can, if the law allows, seek relief against us on your behalf. You agree that, by entering into this Agreement, you and AT&T are each waiving the right to a trial by jury or to participate in a class action. This Agreement evidences a transaction in interstate commerce, and thus the Federal Arbitration Act governs the interpretation and enforcement of this provision. This arbitration provision shall survive termination of this Agreement. (2) A party who intends to seek arbitration must first send to the other, by certified mail, a written Notice of Dispute (“Notice”). The Notice to AT&T should be addressed to: General Counsel, AT&T, 1025 Lenox Park Blvd. Atlanta, GA 30319 (“Notice Address”). The Notice must: (a) describe the nature and basis of the claim or dispute; and (b) set forth the specific relief sought (“Demand”). If AT&T and you do not reach an agreement to resolve the claim within 30 days after the Notice is received, you or AT&T may commence an arbitration proceeding. During the arbitration, the amount of any settlement offer made by AT&T or you shall not be disclosed to the arbitrator until after the arbitrator determines the amount, if any, to which you or AT&T is entitled. You may download or copy a form Notice and a form to initiate arbitration at att.com/arbitration-forms. Terms of Service (3) After AT&T receives notice at the Notice Address that you have commenced arbitration, it will promptly reimburse you for your payment of the filing fee, unless your claim is for greater than $75,000. (The filing fee currently is $125 for claims under $10,000 but is subject to change by the arbitration provider. If you are unable to pay this fee, AT&T will pay it directly upon receiving a written request at the Notice Address.) The arbitration will be governed by the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (collectively, “AAA Rules”) of the American Arbitration Association (“AAA”), as modified by this Agreement, and will be administered by the AAA. The AAA Rules are available online at www.adr.org, by calling the AAA at 1-800-7787879, or by writing to the Notice Address. (You may obtain information that is designed for non-lawyers about the arbitration process 29 at http://att.com/arbitration-information.) The arbitrator is bound by the terms of this Agreement. All issues are for the arbitrator to decide, except that issues relating to the scope and enforceability of the arbitration provision are for the court to decide. Unless AT&T and you agree otherwise, any arbitration hearings will take place in the county (or parish) of your billing address. If your claim is for $10,000 or less, we agree that you may choose whether the arbitration will be conducted solely on the basis of documents submitted to the arbitrator, through a telephonic hearing, or by an in-person hearing as established by the AAA Rules. If your claim exceeds $10,000, the right to a hearing will be determined by the AAA Rules. Regardless of the manner in which the arbitration is conducted, the arbitrator shall issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the award is based. Except as otherwise provided for herein, AT&T will pay all AAA filing, administration, and arbitrator fees for any arbitration initiated in accordance with the notice requirements above. If, however, the arbitrator finds that either the substance of your claim or the relief sought in the Demand is frivolous or brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)), then the payment of all such fees will be governed by the AAA Rules. In such case, you agree to reimburse AT&T for all monies previously disbursed by it that are otherwise your obligation to pay under the AAA Rules. In addition, if you initiate an arbitration in which you seek more than $75,000 in damages, the payment of these fees will be governed by the AAA rules. (4) If, after finding in your favor in any respect on the merits of your claim, the arbitrator issues you an award that is greater than the value of AT&T’s last written settlement offer made before an arbitrator was selected, then AT&T will: • pay you the amount of the award or $10,000 (“the alternative payment”), whichever is greater; and • pay your attorney, if any, twice the amount of attorneys’ fees, and reimburse any expenses (including expert witness fees and costs) that your attorney reasonably accrues for investigating, preparing, and pursuing your claim in arbitration (“the attorney premium”). If AT&T did not make a written offer to settle the dispute before an arbitrator was selected, you and your attorney will be entitled to receive the alternative payment and the attorney premium, respectively, if the arbitrator awards you any relief on the merits. The arbitrator may make rulings and resolve disputes 30 as to the payment and reimbursement of fees, expenses, and the alternative payment and the attorney premium at any time during the proceeding and upon request from either party made within 14 days of the arbitrator’s ruling on the merits. (5) The right to attorneys’ fees and expenses discussed in paragraph (4) supplements any right to attorneys’ fees and expenses you may have under applicable law. Thus, if you would be entitled to a larger amount under the applicable law, this provision does not preclude the arbitrator from awarding you that amount. However, you may not recover duplicative awards of attorneys’ fees or costs. Although under some laws AT&T may have a right to an award of attorneys’ fees and expenses if it prevails in an arbitration, AT&T agrees that it will not seek such an award. (6) The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim. YOU AND AT&T AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and AT&T agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of this arbitration provision shall be null and void. MISCELLANEOUS: This Agreement, any applicable rate summary sheet, the terms included in the rate brochure(s) describing your plan and services, terms of service for products and services not otherwise described in this Agreement or the brochure that are posted on an AT&T website and any documents expressly referred to herein or therein, make up the complete agreement between you and AT&T, and supersede any and all prior agreements and understandings relating to the subject Terms of Service (7) Notwithstanding any provision in this Agreement to the contrary, we agree that if AT&T makes any future change to this arbitration provision (other than a change to the Notice Address) during your Service Commitment, you may reject any such change by sending us written notice within 30 days of the change to the Arbitration Notice Address provided above. By rejecting any such change, you are agreeing that you will arbitrate any dispute between us in accordance with the language of this provision. 31 matter of this Agreement. If any provision of this Agreement is found to be unenforceable by a court or agency of competent jurisdiction, the remaining provisions will remain in full force and effect. The foregoing does not apply to the prohibition against class or representative actions that is part of the arbitration clause; if that prohibition is found to be unenforceable, the arbitration clause (but only the arbitration clause) shall be null and void. AT&T may assign this Agreement, but you may not assign this Agreement without our prior written consent. In the event of a dispute between us, the law of the state of your address of record on your account at the time the dispute is commenced, whether in litigation or arbitration, shall govern except to the extent that such law is preempted by or inconsistent with applicable federal law. Your caller identification information (such as your name and phone number) may be displayed on the equipment or bill of the person receiving your call; technical limitations may, in some circumstances, prevent you from blocking the transmission of caller identification information. You consent to the use by us or our authorized agents of regular mail, predictive or autodialing equipment, email, text messaging, facsimile or other reasonable means to contact you to advise you about our services or other matters we believe may be of interest to you. In any event, we reserve the right to contact you by any means regarding customer service related notifications, or other such information. The original version of this Agreement is in the English language. Any discrepancy or conflicts between the English version and any other language version will be resolved with reference to and by interpreting the English version. Es posible que la identificación del cliente (por ejemplo, su nombre y número de teléfono) aparezca en el equipo o en la factura de la persona que recibe la llamada; en algunos casos, ciertas limitaciones técnicas pueden impedir al suscriptor bloquear la transmisión de la identificación. El usuario autoriza el uso, por parte nuestra o de nuestros agentes autorizados, del correo postal, equipos de información ya almacenada o de marcado automático, mensajes de correo electrónico, mensajes de texto, facsímiles u otros medios razonables para contactarlo con el fin de informarle sobre nuestros servicios u otros asuntos que juzguemos de su interés. En todo caso, nos reservamos el derecho de comunicarnos con el suscriptor por cualquier medio con respecto a notificaciones del servicio al cliente u otra información de esa índole. La versión original de este Contrato fue redactada en el idioma inglés. En caso de discrepancia o incongruencia entre la versión en inglés y las versiones en otros idiomas, se remitirá a la interpretación de lo estipulado en la versión en inglés. Preguntas sobre el servicio de los clientes de Connecticut: en caso de tener preguntas o inquietudes sobre nuestro servicio, comunicarse con el Servicio al cliente al 1-800-331-0500, marcar 611 desde el teléfono móvil o 34 El árbitro podrá tomar decisiones y resolver disputas en cuanto al pago y reembolso de honorarios, gastos, el pago alternativo y la prima del abogado en cualquier momento durante el procedimiento y a solicitud de cualquiera de las partes, presentada dentro de los 14 días del fallo del árbitro sobre los méritos legales. (5) El derecho a los honorarios de abogado y gastos determinado en el párrafo (4) complementa cualquier derecho a honorarios de abogado y gastos que le correspondan al usuario en virtud de la legislación aplicable. Por lo tanto, si el usuario tuviera derecho a un monto mayor de conformidad con la legislación aplicable, la presente disposición no impide al árbitro que fije tal indemnización. Sin embargo, el usuario no podrá obtener un resarcimiento doble por los honorarios de abogado o los costos. Si bien es posible que AT&T tenga derecho al resarcimiento de los honorarios de abogado y costos en caso de obtener un fallo favorable en el arbitraje de conformidad con ciertas leyes, la compañía acepta que no intentará cobrar tal resarcimiento. Términos del servicio (6) El árbitro podrá otorgar una medida cautelar o providencia judicial sólo en favor de la parte individual que pretende resarcimiento y sólo en la medida necesaria para proveer el resarcimiento justificado por el reclamo individual de dicha parte. EL USUARIO Y AT&T ACUERDAN QUE CADA UNO PODRÁ ENTABLAR UNA ACCIÓN EN CONTRA DE LA OTRA PARTE SÓLO A TÍTULO PERSONAL, Y NO COMO DEMANDANTE O PARTICIPANTE DE UNA DEMANDA COLECTIVA EN CUALQUIER PROCEDIMIENTO REPRESENTATIVO O COLECTIVO PRETENDIDO. Asimismo, a menos que el cliente y AT&T acuerden lo contrario, el árbitro no podrá acumular los reclamos de más de una persona ni podrá presidir de otra forma sobre ninguna clase de procedimiento colectivo o representativo. En caso de que esta disposición específica se considere sin fuerza ejecutoria, entonces la totalidad de esta cláusula de arbitraje será nula. (7) No obstante cualquier cláusula del presente Contrato que indique lo contrario, se acepta que si AT&T realiza cualquier modificación futura a esta cláusula de arbitraje (excepto una modificación al Domicilio de aviso) durante el plazo de servicio, el cliente podrá rechazar tal modificación al enviar a la compañía una notificación por escrito dentro de los 30 días del cambio al Domicilio de aviso de arbitraje mencionado anteriormente. Al rechazar tal modificación el cliente acepta que cualquier disputa entre el cliente y AT&T se realizará mediante arbitraje conforme a lo establecido en esta cláusula. 33 todas las audiencias del arbitraje tendrán lugar en el condado (o municipio) del domicilio de facturación del usuario. Si el reclamo del usuario es de $10,000 o menos, AT&T acepta que el usuario pueda elegir si el arbitraje se realizará exclusivamente con base en los documentos presentados ante el árbitro, mediante una audiencia telefónica o una audiencia personal según lo establecen las Reglas AAA. Si el reclamo del usuario supera los $10,000, las Reglas AAA determinarán el derecho a celebrar una audiencia. Independientemente de la forma en la que se realice el arbitraje, el árbitro deberá emitir por escrito una decisión justificada que alcance a explicar los hechos y conclusiones en los cuales se basó el fallo. Salvo que se indique de otro modo en el presente Contrato, AT&T pagará todas las tasas judiciales, de administración y de arbitraje de la AAA por cualquier arbitraje que se inicie conforme a los requisitos de aviso mencionados más arriba. Sin embargo, si el árbitro considera que la materia de su reclamo o la reparación judicial pretendida en la Demanda no está fundamentada o se entabla con un propósito indebido (según lo acordado por las normas establecidas en la Regla Federal de Procedimiento Civil 11[b]), entonces el pago de todas las cuotas correspondientes se regirá por las Reglas de la AAA. En tal caso, el usuario acepta reembolsar a AT&T todos los fondos erogados previamente por la compañía que le habrían correspondido al usuario según las Reglas de la AAA. Además, si el usuario inicia un proceso de arbitraje por el cual pretenda obtener más de $75,000 por daños y perjuicios, el pago de dichas tasas estará regido por las Reglas AAA. (4) Si, después de fallar a favor del cliente con respecto a los méritos de su reclamo, el árbitro otorga un fallo que supera el monto de la última oferta escrita de conciliación efectuada por AT&T antes de la selección del árbitro, la compañía: • pagará al cliente el monto del fallo o $10,000 (“el pago alternativo”), lo que sea mayor; y • pagará al abogado del usuario, si hubiera contratado uno, el doble de los honorarios que gana y le reembolsará cualquier gasto (incluso los costos de testigos peritos), dentro de lo prudente, por investigar, preparar y presentar el reclamo del usuario en el arbitraje (“la prima del abogado”). En caso de que AT&T no haya efectuado una oferta escrita para resolver la disputa antes de la selección del árbitro, el usuario y su abogado tendrán derecho a recibir el pago alternativo y la prima, respectivamente, si el árbitro establece una reparación judicial para el usuario sobre los méritos legales. 32 interpretará y hará cumplir conforme a la Ley Federal de Arbitraje (Federal Arbitration Act). Esta cláusula de arbitraje permanecerá en vigencia con posterioridad a la terminación del Contrato. (2) La parte que pretenda recurrir al arbitraje primero deberá enviar a la otra parte, por escrito, mediante correo certificado, un Aviso de disputa (“Aviso”). El Aviso a AT&T deberá estar dirigido a: General Counsel, AT&T, 1025 Lenox Park Blvd. Atlanta, GA 30319 (“Domicilio de aviso”). El Aviso deberá (a) describir la naturaleza y los fundamentos del reclamo o disputa; y (b) establecer la reparación judicial que se pretende (“Demanda”). En el caso de que no se llegue a un acuerdo para resolver el reclamo dentro de los 30 días posteriores a la recepción del Aviso, el usuario o AT&T podrán iniciar un procedimiento de arbitraje. Durante el procedimiento, no se divulgará al árbitro el monto de ninguna oferta de conciliación que AT&T o el usuario efectúe, hasta que el árbitro fije el monto, si lo hubiera, que le corresponde al usuario o a AT&T. Se puede descargar o copiar un formulario del Aviso y un formulario para iniciar el arbitraje en att.com/arbitration-forms (en inglés). Términos del servicio (3) Después de que AT&T reciba el Aviso de que el usuario ha iniciado el arbitraje, en el Domicilio de aviso, inmediatamente se le reembolsará el pago de la tasa judicial, a menos que el reclamo sea superior a $75,000. (La tasa judicial asciende actualmente a $125 para reclamos menores a $10,000, pero está sujeta a modificación por parte del proveedor de servicios del arbitraje. Si el usuario no puede pagar esta tasa, AT&T se hará cargo de la misma luego de que se le envíe una solicitud por escrito al Domicilio de aviso.) El arbitraje se regirá por el reglamento de arbitraje comercial y los procedimientos complementarios para disputas relativas a los consumidores (en conjunto denominados, “Reglas AAA”) de la Asociación Estadounidense de Arbitraje (“AAA”), según modificaciones establecidas en el presente Contrato, y será administrado por la AAA. Las Reglas AAA se pueden consultar en Internet en www.adr.org (en inglés), o se pueden solicitar a la AAA por teléfono al 1-800-778-7879 o por carta al Domicilio de aviso. (El usuario puede obtener información sobre el proceso de arbitraje en http://att.com/arbitration-information. (en inglés). Esta información se ha compilado pensando en aquellas personas que no están familiarizadas con temas jurídicos.) El árbitro se regirá por los términos del presente Contrato. Todos los asuntos se someten a la decisión del árbitro, excepto por aquellos relacionados con el alcance y la exigibilidad de la cláusula de arbitraje que el tribunal deberá decidir. Salvo que AT&T y el usuario acuerden de otro modo, 31 en el arbitraje el usuario tiene derecho a que AT&T pague los honorarios del abogado hasta el monto máximo que le correspondería en un tribunal. En otras circunstancias (que se detallan más adelante), AT&T le pagará al usuario un monto mayor a la indemnización fijada por el árbitro y le pagará a su abogado (si hubiera contratado uno) el doble de sus honorarios razonables, en caso de que el árbitro fije una indemnización mayor al monto que AT&T le haya ofrecido al usuario para resolver la disputa. CLÁUSULA DE ARBITRAJE (1) AT&T y el cliente aceptan someter a arbitraje todas las disputas y reclamos que surjan entre ambos. Este contrato de arbitraje debe ser interpretado en forma amplia. Incluye, entre otros: • los reclamos que se originen o estén relacionados con cualquier aspecto de la relación entre ambos, ya sea que surjan de disposiciones contractuales, actos ilícitos civiles, disposiciones legales, fraude, tergiversación o de cualquier otra figura jurídica; • los reclamos que se presentaron antes de la celebración de este Contrato o cualquier contrato previo (que incluyen, entre otros, reclamos relacionados con la publicidad); • los reclamos que actualmente son el objeto de una demanda colectiva pretendida, en la cual el usuario no es participante de una clase certificada; y • los reclamos que puedan surgir luego de la terminación de este Contrato. Las referencias a “AT&T”, “el usuario” y “nosotros” incluyen nuestras subsidiarias, afiliadas, agentes, empleados, predecesores en interés, sucesores y cesionarios respectivos, así como todos los usuarios o beneficiarios de los servicios o Equipos, autorizados o no, de conformidad con el presente Contrato o contratos previos con la compañía. No obstante lo anterior, cualquiera de las partes podrá iniciar una acción individual ante un tribunal que atiende causas menores. La presente cláusula de arbitraje no le impide al cliente plantear inquietudes a los organismos federales, estatales o locales (como la Comisión Federal de Comunicaciones). Dichos organismos pueden, si así lo permite la ley, recurrir a reparaciones judiciales en nuestra contra en representación del cliente. El usuario acepta que, al suscribir el presente Contrato, tanto él como AT&T renuncian al derecho a un juicio por jurado o a participar en una demanda colectiva. Este Contrato es evidencia de una transacción de comercio interestatal y esta disposición de arbitraje se 30 UN CONTRATO. POR LO TANTO, ES POSIBLE QUE LAS LIMITACIONES O EXCLUSIONES MENCIONADAS ANTERIORMENTE NO SE APLIQUEN AL USUARIO. ESTE CONTRATO LE CONFIERE AL USUARIO DERECHOS LEGALES ESPECÍFICOS; EL USUARIO PUEDE GOZAR, ADEMÁS, DE OTROS DERECHOS, QUE VARÍAN SEGÚN CADA ESTADO. ACCESO A LA CUENTA: el usuario nos autoriza a proveer información acerca de su cuenta y a efectuar cambios en ella, incluso agregar nuevos servicios, bajo la dirección de cualquier persona capaz de proveer la información que se considere suficiente para identificarlo. El usuario recibirá una contraseña de la cuenta. A fin de proteger la seguridad de la cuenta, se recomienda cambiar esta contraseña lo antes posible, una vez que se haya activado la cuenta. En caso de no cambiarla, es posible que la cuenta no esté segura. SERVICIO DE CORREO DE VOZ: si no se configura el servicio de correo de voz dentro de un período razonable después de la activación, es posible que quede desactivado. Se reactivará el servicio al solicitarlo. RESOLUCIÓN DE DISPUTAS MEDIANTE ARBITRAJE OBLIGATORIO: leer con atención esta información. Concierne a los derechos del usuario. Términos del servicio Resumen: la mayoría de las inquietudes de los usuarios se pueden resolver rápidamente a su satisfacción llamando a nuestro servicio al cliente al 1-800-331-0500. En el caso poco probable de que el servicio al cliente de AT&T no pueda resolver una queja a satisfacción del usuario (o si AT&T no puede resolver una disputa con el usuario luego de intentar resolverla de manera informal), AT&T y el usuario aceptan resolver tales disputas mediante arbitraje obligatorio o ante un tribunal que atienda causas de escaso monto, en lugar de recurrir a tribunales de competencia general. El arbitraje es un proceso más informal que un juicio en un tribunal. En el arbitraje participa un árbitro neutral, en lugar de un juez o un jurado, se permite una presentación más limitada de las pruebas que en los tribunales, y el procedimiento está sujeto a una revisión muy limitada por parte de los mismos. Los árbitros pueden fijar indemnizaciones por daños y perjuicios y establecer reparaciones judiciales al igual que los tribunales. Los procedimientos de arbitraje según este Contrato se realizarán individualmente; no se permiten arbitrajes de grupo ni demandas colectivas. AT&T pagará todos los costos del arbitraje cuando se trate de reclamos fundamentados que no superen $75,000. Asimismo, 29 O SERVICIO, Y AT&T NO TENDRÁ RESPONSABILIDAD, EN NINGÚN CASO, YA SEA POR PROPIA NEGLIGENCIA O NO, en caso de: (a) actos u omisiones de terceros (b) equivocaciones, omisiones, interrupciones, errores, fallas de transmisión, demoras o defectos en el servicio provisto por nosotros o por nuestro intermedio (c) daños o lesiones causados por el uso del servicio o del Equipo, incluso el uso en un vehículo (d) reclamos contra el usuario por parte de terceros (e) daños o lesiones causados por una suspensión o terminación del servicio por parte de AT&T o (f) daños o lesiones causados por la imposibilidad o la demora para establecer una llamada al 911 o cualquier otro servicio de emergencia. No obstante lo anterior, si el servicio se interrumpe durante 24 horas seguidas o más por causas bajo nuestro control, le otorgaremos, a solicitud, un crédito equivalente a un ajuste prorrateado del cargo recurrente de servicio (si procede) por el período de tiempo que no se prestó el servicio, por un monto que no exceda el cargo de servicio cobrado por el período de la interrupción. Nuestra responsabilidad por fallas del servicio se limita exclusivamente al crédito mencionado anteriormente. A menos que la ley aplicable impida que las partes limiten de este modo la responsabilidad, y siempre que esa ley no discrimine en contra de las cláusulas de arbitraje, AT&T no será responsable por pérdidas o daños indirectos, especiales, punitivos, incidentales o demás pérdidas indirectas que el usuario o un tercero pueda sufrir por el uso, imposibilidad de uso, el servicio o Equipo proporcionado por AT&T o a través de AT&T, incluso pérdidas comerciales, de reputación, ingresos o beneficios, o reclamaciones de daños personales. Con el máximo alcance permitido por la ley, por el presente el usuario desvincula, indemniza y exime de responsabilidad a AT&T, sus funcionarios, directores, empleados y agentes ante cualquier reclamo de cualquier persona o entidad por daños y perjuicios de cualquier naturaleza que surjan, en forma directa o indirecta, del servicio, o en relación con el mismo, provisto por AT&T o del uso de dicho servicio por cualquier persona (incluso, entre otros, daños a vehículos y lesiones personales), INCLUSO RECLAMOS QUE SURJAN, EN SU TOTALIDAD O EN PARTE, DE LA PRESUNTA NEGLIGENCIA DE AT&T, o por incumplimiento de este Contrato por parte del usuario. Esta obligación permanecerá en vigencia después de la cancelación de su servicio con AT&T. AT&T no se responsabilizará ante el usuario por cambios en la operación, el equipo o la tecnología, por cuyo motivo su Equipo o software se vuelvan obsoletos o requieran modificaciones. ALGUNOS ESTADOS, INCLUSO EL ESTADO DE KANSAS, NO PERMITEN DESCARGOS DE RESPONSABILIDAD DE GARANTÍAS IMPLÍCITAS O LÍMITES EN LOS RECURSOS, ANTE EL INCUMPLIMIENTO DE 28 Términos del servicio radial, capacidad del sistema, acceso prioritario de Seguridad Nacional y del personal de Preparación para Emergencias en el caso de un desastre o emergencia, coordinación con otros sistemas, modificaciones y reparaciones del equipo, y problemas con las instalaciones de compañías interconectadas. Es posible que se bloquee el acceso a ciertas categorías de números (por ejemplo, 976, 900 y destinos internacionales), a nuestra entera discreción. Es posible que el plan del suscriptor incluya la posibilidad de realizar o recibir llamadas al usar el servicio de roaming en el extranjero. Existen ciertas restricciones que se fundamentan en el tiempo que se haya sido cliente del servicio o el historial de pagos. AT&T, a su entera discreción, podrá bloquear la función de roaming internacional en el teléfono del suscriptor hasta que se reúnan los requisitos. Las tarifas de roaming internacional, que varían según el país, aplicarán a todas las llamadas realizadas o recibidas fuera de los EE. UU., Puerto Rico o de las Islas Vírgenes Estadounidenses. Se requiere un equipo con compatibilidad internacional. Si el cliente desea bloquear la posibilidad de realizar o recibir llamadas o de usar funciones de datos al usar el servicio de roaming en el extranjero, debe llamar al 1-916-843-4685. Fuera de los EE. UU., Puerto Rico o de las Islas Vírgenes Estadounidenses, se cobrarán las tarifas normales de roaming internacional cuando las llamadas entrantes se desvían al correo de voz, incluso si no se deja ningún mensaje. Muchos equipos transmiten y reciben mensajes de datos sin la intervención del usuario y pueden generar cargos inesperados al encenderlos fuera de los Estados Unidos, Puerto Rico o las Islas Vírgenes Estadounidenses. Es posible que AT&T envíe “alertas” por mensaje de texto o de correo electrónico para notificarle a sus clientes acerca del uso. Las alertas son cortesía de AT&T. No hay garantía de que el cliente las reciba. Podremos, sin tener obligación alguna de hacerlo, rehusarnos a transmitir información a través del servicio y examinar y borrar información antes de que le sea entregada al usuario. Existen brechas en el servicio dentro de las áreas de servicio ilustradas en los mapas de cobertura que, por naturaleza, son sólo aproximaciones de la cobertura real. NO GARANTIZAMOS SERVICIO O COBERTURA ININTERRUMPIDOS. NO PODEMOS GARANTIZAR QUE, SI REALIZA UNA LLAMADA AL 911, EL USUARIO SERÁ LOCALIZADO. Se cobran cargos por tiempo de uso y otros cargos de servicio a todas las llamadas, incluso a las llamadas terminadas en forma involuntaria. AT&T NO EXTIENDE GARANTÍA, EXPRESA O IMPLÍCITA, DE COMERCIABILIDAD O IDONEIDAD PARA UN FIN ESPECÍFICO, CONVENIENCIA O RENDIMIENTO DE NINGÚN PRODUCTO 27 de naturaleza similar que AT&T determine. El usuario comprende y acepta que los cargos del servicio universal federal y estatal, y otros cargos gubernamentales, cobrados directamente al usuario o no, podrán aumentar en base a cálculos del gobierno o de nuestra empresa. SI AUMENTAMOS EL PRECIO DE CUALQUIERA DE LOS SERVICIOS A LOS CUALES EL USUARIO ESTÁ SUSCRITO, SEGÚN LO ESTABLECIDO EN EL FOLLETO DE SU PLAN DE TARIFAS CORRESPONDIENTE, O SI REDUCIMOS SUSTANCIALMENTE EL ÁREA GEOGRÁFICA A LA QUE SE APLICA SU TARIFA DE TIEMPO DE USO (EXCEPTO DISMINUCIONES TEMPORALES POR REPARACIONES O MANTENIMIENTO), INFORMAREMOS EL CAMBIO CON ANTICIPACIÓN. Si el suscriptor ya no reúne los requisitos para un plan de tarifas en particular, es posible que cambiemos el plan de tarifas por otro para el cual reúna los requisitos. CANCELACIÓN: ambas partes pueden cancelar este Contrato (lo que también cancelará la prestación del Servicio) en cualquier momento, previa notificación a la otra parte. Los fondos depositados en la cuenta del suscriptor mediante cualquier método no se reembolsarán. AT&T podrá terminar este Contrato en cualquier momento sin aviso previo si se deja de proveer el servicio en el área. Podremos interrumpir o cancelar el servicio sin aviso previo por cualquier conducta que, según nuestro criterio, infrinja este Contrato o cualquiera de los términos y condiciones del plan de tarifas, si el usuario se comporta de manera abusiva, peyorativa o de cualquier otro modo igualmente ilógico con cualquiera de nuestros representantes, si incurre en incumplimiento de los pagos requeridos al vencimiento, si tenemos motivos suficientes para creer que el Equipo se está utilizando con fines ilícitos o de cualquier manera que pudiera afectar nuestro servicio desfavorablemente. Si se tiene más de una cuenta con la empresa, se deberá mantener todas las cuentas al día para conservar el servicio. Si se ha retrasado en el pago de una cuenta o ha superado su límite, todas las cuentas a nombre del mismo titular están sujetas a interrupción o terminación y a todos los demás recursos de cobro a nuestra disposición. Cualquier disposición del presente Contrato que por contexto haya de aplicarse después de la cancelación del Contrato permanecerá vigente tras la cancelación incluso, entre otros, toda restricción con respecto al uso de los Equipos. LIMITACIÓN DEL SERVICIO; LIMITACIÓN DE RESPONSABILIDAD: las limitaciones de responsabilidad que se establecen en el presente tienen validez a menos que estén prohibidas por la ley aplicable. El servicio puede interrumpirse, demorarse o bien limitarse por una variedad de motivos, incluso condiciones climáticas, inaccesibilidad de los canales de frecuencia 26 el usuario acepta que usemos la información de su ubicación para dicho fin, la cual puede divulgarse a terceros para prestar el servicio de información y no para otro fin. Dicha información de la ubicación se conservará sólo durante el tiempo que sea necesario para brindar la información personalizada pertinente, después de lo cual se eliminará. PÉRDIDA O ROBO DE TELÉFONOS: en caso de extravío o robo del Equipo, el usuario debe comunicarse con la empresa de inmediato y notificarnos del robo o extravío; asimismo, el usuario será responsable por todos los cargos en los que incurra su número de teléfono hasta que nos notifique el robo o la pérdida. Se puede realizar dicha notificación y suspender el servicio sin cargo con sólo comunicarse con nosotros. Luego de que se nos informe el robo o extravío, el usuario conservará la responsabilidad de cumplir con sus demás obligaciones según este Contrato, entre ellas el pago del cargo mensual del servicio. La empresa y el suscriptor tienen la obligación de actuar de buena fe y de forma razonable y responsable en lo que respecta al extravío o robo del Equipo del suscriptor. Términos del servicio CHEQUES Y OTROS MEDIOS DE PAGO RECHAZADOS: se cobrarán $30.00, o el importe máximo permitido por la ley, el que sea menor, por cualquier cheque u otro medio de pago (incluso recargos de la tarjeta de crédito) presentado por el usuario y devuelto sin pagar por una institución financiera, cualquiera que sea el motivo. El usuario acepta reembolsarnos los cargos de cualquier agencia de cobro, que pueden basarse en un porcentaje a un máximo del 33% de la deuda, más todos los costos y gastos, incluso los honorarios razonables de abogados, en los que incurramos con el propósito de realizar tales cobros. CAMBIOS EN LOS TÉRMINOS Y EN LAS TARIFAS: podremos cambiar cualquier término, condición, tarifa, cuota, gasto o cobro en referencia al servicio en cualquier momento. El cliente entiende y reconoce que el Equipo se vende exclusivamente para usarse con el servicio GoPhone de AT&T y que la Compañía se verá en gran medida perjudicada si el cliente usa o ayuda a otras personas a usar el Equipo con otros fines. El cliente acepta no realizar ningún acto a fin de evadir los límites en la cantidad de Equipos que puedan adquirirse y es responsable ante AT&T por cualquier daño que resulte de la conducta que se prohíbe en esta sección. COMPRAS Y AUTORIZACIÓN DE USO: el Equipo del cliente puede usarse para adquirir bienes y servicios, entre ellos, tonos de timbre, gráficos, juegos o alertas de noticias (incluso planes de suscripción) de AT&T o terceros (“Contenido, bienes y servicios”). El contenido, los bienes y servicios se pueden adquirir directamente con cualquier Equipo asignado a la cuenta del suscriptor o por Internet. LA TRANSFERENCIA DE DATOS SE FACTURA EN INCREMENTOS DE KILOBYTES COMPLETOS Y LA TRANSFERENCIA REAL SE REDONDEA AL SIGUIENTE KILOBYTE COMPLETO AL FINAL DE CADA SESIÓN DE DATOS A LOS FINES DE FACTURACIÓN. AT&T COBRA UN KILOBYTE COMPLETO DE TRANSFERENCIA DE DATOS POR CADA FRACCIÓN DEL ÚLTIMO KILOBYTE DE TRANSFERENCIA DE DATOS USADO EN CADA SESIÓN. EL TIEMPO DE PROCESAMIENTO DE LA RED, SOLICITUDES DE 21 MI CUENTA: con Mi Cuenta, como cliente de GoPhone, puedes tener acceso a los servicios de administración de la cuenta desde tu teléfono. Cómo activar el control para menores: ve a la página principal de MEdia Net (Internet móvil) en tu teléfono móvil, selecciona “Customize MEdia Net (Mobile Web)” (Personalizar MEdia Net [Internet móvil]) y luego selecciona “Parental Controls” (Control para menores). Cambia a “On” los filtros de contenido (“Content Filters”) o el bloqueador de compras (“Purchase Blocker”). Se te pedirá que ingreses un código PIN y que brindes tu dirección de correo electrónico. (La dirección de correo electrónico se utilizará a efectos de verificación únicamente y si necesitas restablecer tu PIN.) Las opciones de configuración se pueden cambiar con facilidad y en cualquier momento con el código PIN o comunicándose con el servicio al cliente. Ningún filtro es 100% preciso y AT&T no garantiza que el filtro sea exacto. 13 MENSAJES DE TEXTO1: el servicio de mensajes de texto te permite enviar y recibir mensajes cortos directamente desde tu teléfono móvil a cualquier otro teléfono móvil, independientemente del proveedor de servicios. Es una manera rápida, sencilla y discreta de comunicarse. Se ofrecen paquetes de mensajes. Consulta la sección “PAQUETES DE FUNCIONES PAY AS YOU GO” y el folleto para obtener más información. SERVICIO INTERNACIONAL DE MENSAJES DE TEXTO2: envía y recibe mensajes de texto desde y hacia teléfonos móviles en más de 100 países de todo el mundo. • Los mensajes internacionales deben marcarse utilizando el siguiente formato: 011 + código del país + número de teléfono móvil (ejemplo: 0114412345678) • También puedes enviar un mensaje internacional reemplazando 011 con un signo “+” (ejemplo: +4412345678) TONOS DE TIMBRE, RINGBACK TONES, JUEGOS Y FONDOS DE PANTALLA1,2: personaliza tu teléfono con su propio tono de timbre, protector o fondo de pantalla. DATOS1,2: conéctate a Internet móvil, realiza búsquedas, consulta el correo electrónico, usa aplicaciones y más. Obtén instrucciones para llegar a tu destino, descarga tonos de timbre y juegos. Ten acceso a tus sitios web favoritos como CNN, ESPN, Facebook, Google y más. Se ofrecen paquetes de datos. Consulta la sección “PAQUETES DE FUNCIONES PAY AS YOU GO” y el folleto para obtener más información. CONTROL PARA MENORES DE INTERNET MÓVIL: permite a los padres restringir el acceso a contenido de Internet móvil que pueda no ser apropiado para menores así como bloquear el acceso a la función de búsqueda por Internet en el teléfono móvil. Control del contenido: activa (“On”) o desactiva (“Off”) los filtros de 12 Funciones optimizadas ROAMING INTERNACIONAL EN MÉXICO: ahora puedes usar tu servicio de Pay As You Go cuando viajes a México. No se requiere ninguna función adicional para usar el servicio de roaming en México, todos los clientes de Pay As You Go cumplen automáticamente con los requisitos. Se cobran cargos de roaming. Funciones optimizadas * Funciones básicas Para comunicarte con el servicio al cliente o la asistencia automatizada mientras utilizas el servicio de roaming en México, llama al 611 (desde tu teléfono móvil) o al +1 (408) 962-1025 (desde cualquier teléfono fijo). Cuando utilices el servicio de roaming en el extranjero, asegúrate de hacer todas las llamadas internacionales con el formato internacional (+, código de país y número de teléfono). Por ejemplo, para hacer una llamada internacional a los Estados Unidos, marca +1, luego el código de área y el número de teléfono (el código de país de los EE. UU. es “1”). En la mayoría de los equipos GSM, mantener oprimida la tecla “0” hará que aparezca el signo “+”. Para realizar una llamada en México, marca el número de 10 dígitos con el código de área y el número local incluidos. Al utilizar el servicio de roaming en el extranjero, la mayoría de los teléfonos te permitirán tener acceso al correo de voz si mantienes oprimida la tecla “1”. Si no puedes tener acceso al correo de voz de este modo, marca tu propio número de teléfono móvil (inserta +1 antes del número) y oprime la tecla ” “ durante el saludo del correo de voz. Deberás recordar el código personal de tu correo de voz. Cuando se utiliza el servicio de roaming en el extranjero, las llamadas al correo de voz se facturan a tarifas de roaming. 11 LLAMADA ENTRE TRES1: añade un tercero a la llamada. (En algunas áreas se ofrece el servicio de llamada en conferencia, que te permite hablar con un máximo de cinco personas simultáneamente. Esta función sólo se ofrece con ciertos teléfonos.) IDENTIFICADOR DE LLAMADAS: te permite saber quién te llama. LLAMADA EN ESPERA1: te hace saber cuando tienes otra llamada y te permite poner la primera llamada en espera. RETENCIÓN DE LLAMADA1: mantiene en línea a una persona mientras realizas o recibes otra llamada. También sirve como silenciador del micrófono. DESVÍO DE LLAMADA1: desvía llamadas a otro número. LARGA DISTANCIA INTERNACIONAL1: llama directamente desde tu teléfono móvil a amigos, familiares y colegas de todo el mundo. SERVICIO DE INFORMACIÓN1: marca 411 en tu teléfono móvil y obtén los números de teléfono que necesitas; luego, conéctate automáticamente con ellos. Puedes conectarte al servicio de información, recibir instrucciones para llegar a algún lugar y mucho más. 1 Se podrán cobrar cargos por tiempo de uso y otros cargos adicionales por el uso de funciones. Configurar el correo de voz puede activar cargos diarios por acceso en planes calificados. Consultar el folleto de GoPhone Pay As You Go para obtener más detalles. 10 Funciones básicas Empieza a hablar Puedes utilizar el servicio de GoPhone de la misma manera en que utilizarías cualquier otro teléfono móvil; sin embargo, con este servicio no se podrán realizar llamadas a números con tarifas especiales (por ejemplo, 900, 976) ni llamadas por cobrar. El mapa muestra una aproximación de la cobertura al aire libre. Puede incluir áreas cubiertas por otras compañías no afiliadas y es posible que represente el área para la cual dichas compañías cuentan con licencia en lugar de una aproximación de la cobertura. El área de cobertura real puede variar considerablemente del área que aparece en el mapa a causa del terreno, condiciones meteorológicas, follaje, edificios y demás construcciones, intensidad de la señal, equipo del cliente y otros factores. AT&T no garantiza la cobertura ni disponibilidad de la red. Los cargos dependerán del lugar en donde se recibe y transmite la llamada, mas no del lugar en donde se encuentre el suscriptor. Las tarifas se cobrarán por las llamadas que se hagan y se reciban desde el área de cobertura de GoPhone. La información que aparece en la pantalla del teléfono no indica la tarifa que se cobrará. Cómo hacer una llamada Realiza llamadas con el servicio de GoPhone Pay As You Go mientras estés en tu área de cobertura a: • Otros teléfonos móviles • Teléfonos fijos • Números de teléfono nacionales de larga distancia y fuera del estado • Números internacionales (visita la página att.com/gophone para obtener más información) • Llamadas a números sin cargo (se cobran cargos por tiempo de uso) • Servicio de información (se cobran cargos por llamada además de cargos por tiempo de uso) 8 Cómo consultar el saldo y la fecha de vencimiento * Cómo recargar tu cuenta CÓMO CONSULTAR EL SALDO Y LA FECHA DE VENCIMIENTO: al final de cada llamada que realizas o recibes, el costo de la llamada se descontará de tu cuenta en incrementos de minutos completos. • Recibirás un mensaje de texto con tu saldo actual en la pantalla del teléfono después de cada llamada con cargo que realices o recibas. • Puedes marcar 777# y oprimir SEND (enviar) para recibir un mensaje de texto con el saldo de tu cuenta y la fecha de vencimiento • O bien, puedes llamar al 611 en cualquier momento y seguir las instrucciones para escuchar tu saldo actual y la fecha de vencimiento. No se cobran cargos por las llamadas al servicio automatizado de atención al cliente (611). Cómo consultar el saldo y la fecha de vencimiento El sistema de Pay As You Go te advertirá que debes agregar tiempo de uso a tu cuenta en los siguientes casos: • El saldo de tu cuenta es bajo • Restan 10 para el vencimiento de la cuenta • El saldo de tu cuenta es demasiado bajo para cubrir el costo de una llamada Con estos avisos recibirás opciones para agregar tiempo de uso a tu cuenta. Si tienes fondos suficientes, puedes pasar por alto estas opciones presionando la tecla “#” para continuar la llamada. Aunque AT&T te enviará mensajes de recarga oportunos, el envío no puede garantizarse. 7 Cómo recargar tu cuenta Cómo recargar la cuenta con una tarjeta Pay As You Go PASO 1 REFILL YO U R A CCO U N T 25 $ Then save by adding Feature Packages: TEXT MESSAGING — UNLIMITED, 1000 OR 200 NIGHT & WEEKEND MINUTES DATA — UNLIMITED — 1 MB OR 100 MB Compra una tarjeta Pay As You Go en las tiendas de AT&T. PASO 2 PIN del servicio prepagado # RASPA EL CUADRO GRIS Encuentra el PIN asociado con la tarjeta prepagada. Generalmente, el PIN aparece en el reverso de la tarjeta o impreso en el recibo. PASO 3 Para agregar el valor del PIN a tu cuenta, sigue las instrucciones que aparecen en el reverso de la tarjeta o impresas en el recibo del PIN. Con la mayoría de las tarjetas de recarga puedes agregar el valor del PIN usando el teclado del teléfono con servicio prepagado: ingresa 888 seguido del número PIN y luego oprime la tecla # (ej.: 888 NÚMERO PIN#) y SEND (enviar). O bien visita att.com/mygophone (en inglés) o llama al 611 y elige la opción para agregar dinero. * * * * Una vez que hayas ingresado el número de tu tarjeta prepagada, te informaremos el nuevo saldo de tu cuenta y la fecha de vencimiento. En muchos lugares, las tarjetas de GoPhone Pay As You Go pueden devolverse al local de compra dentro de un plazo de 30 días siempre que no se haya retirado la banda para raspar. El PIN electrónico impreso en la factura de compra no tiene devolución. La norma de reembolso puede variar según el lugar de compra. 6 Cómo recargar tu cuenta código personal de la cuenta El servicio GoPhone Pay As You Go te permite pagar tu tiempo de uso por adelantado. El costo de cada llamada que realizas o recibes se descontará de tu cuenta en incrementos de minutos completos. El descuento podrá retrasarse si se producen interrupciones en el sistema u otro tipo de interrupción en AT&T. Recarga la tarjeta antes de que caduque el saldo actual y dicho saldo se transferirá a la nueva fecha de vencimiento. Puedes realizar una recarga cuando se agote el saldo o esté a punto de acabarse, de una de las siguientes maneras: • Pago con tarjeta de crédito, de débito o cuenta de cheques: – Visita att.com/mygophone (en inglés) – Marca 611 desde tu teléfono móvil. Es posible que se cobre un cargo por las llamadas realizadas para agregar fondos mediante un representante de servicio. • Paga en efectivo al visitar una tienda de AT&T o ve a cualquiera de las más de 200,000 tiendas autorizadas en los EE. UU. y compra una tarjeta de recarga o un PIN Recarga sin complicaciones, al suscribirte al servicio de recarga automática Suscribe tu cuenta a la recarga automática y el valor del tiempo de uso que elijas se deducirá automáticamente de tu tarjeta de crédito o de débito en la fecha que lo indiques. Suscríbete de una de las siguientes maneras: • Visita att.com/mygophone y selecciona el enlace “Refill Your Minutes” (recargar tus minutos) para recargar con tarjeta de crédito o débito, luego haz clic en “Manage My Account” (administrar mi cuenta). Se pueden elegir los siguientes planes para recarga automática: Weekly Plan (plan semanal), Pay Day Plan (plan quincenal), Monthly Plan (plan mensual) o Expiration Protection Plan (plan de protección del vencimiento). 5 Cómo recargar tu cuenta Código personal de la cuenta El código personal inicial de la cuenta son los últimos cuatro dígitos de tu número de teléfono móvil. Se te pedirá que lo cambies para ingresar al servicio al cliente por Internet. Por tu seguridad, te recomendamos cambiar el código personal por un código secreto que no sean los últimos cuatro dígitos de tu teléfono móvil. Puedes modificar el código personal de la cuenta en cualquier momento a través del servicio al cliente por Internet (att.com/mygophone, en inglés) o comunicándote con un representante del servicio al cliente. Si te olvidas del código, puedes solicitar que te lo envíen en un mensaje de texto a tu teléfono sin cargos, por medio del servicio al cliente por Internet.
