enregistrée sous le numéro 14107. En conséquence et en application des dispositions de l’article 6.4 de la
directive 99/05/CE du 9 mars 1999, la commercialisation de ce type d’équipements en France ne peut débuter
avant le 18/6/2007.
La mise sur le marché et/ou la mise en service du matériel que vous avez notifié sont soumises à des
restrictions puisque cet équipement ne relève pas de la classe 1 définie par la décision de la Commission
européenne du 6 avril 2000 établissant la classification initiale des équipements hertziens et des équipements
terminaux de télécommunications ainsi que des identificateurs associés (JOCE du 19 avril 2000,
http://www.europa.eu.int/comm/enterprise/rtte/decision/classif.htm et http://www.ero.dk/rtte).
La réglementation française fixant les conditions d'utilisation des réseaux locaux radioélectriques à haute
performance (Hiperlan) dans la bande des 5 GHz et des réseaux locaux radioélectriques (RLAN) dans la bande
des 2,4 GHz a évolué au cours de l'année 2003. Ainsi, la réglementation relative aux Hiperlan prévoit une
restriction des niveaux de puissance pour une utilisation limitée à l'intérieur des bâtiments, ainsi qu'une limitation
de la bande de fréquences utilisées quand les équipements ne comportent pas la fonction de sélection des
fréquences (DFS) permettant d’éviter l’émission sur des canaux occupés et la fonction de contrôle de puissance
(TPC) permettant une atténuation de la puissance moyenne émise de 3 dB minimum. En outre, pour être
utilisables en France, les équipements dotés de la fonction de sélection des fréquences (DFS) doivent se référer à
la version 1.3.1 (2005-08), ou une version ultérieure, de la norme EN 301 893.
Par ailleurs, la réglementation relative aux RLAN prévoit, selon la bande de fréquences utilisées, des
restrictions des niveaux de puissance pour l'établissement et l'exploitation de ces réseaux voire un régime
d'autorisation différent suivant que l'équipement est utilisé à l'intérieur ou à l'extérieur des bâtiments.
En conséquence, je vous recommande vivement de prendre contact avec l'Autorité de régulation des
communications électroniques et des postes (ARCEP) (http://www.arcep.fr) afin de fournir aux consommateurs
des informations précises concernant les conditions d’utilisation du matériel commercialisé, sur l’emballage et
dans le manuel d'utilisation conformément aux dispositions de l’article 6.3 de la directive 99/05/CE du 9 mars
1999. Par ailleurs, comme vous le savez, pour être mis sur le marché, cet équipement doit porter les marquages
adéquats, notamment le marquage CE attestant qu'il est conforme aux exigences essentielles qui lui sont
applicables, l'identificateur de la catégorie d'équipement (signe d'alerte), puisqu'il ne relève pas de la classe 1
susmentionnée, et le cas échéant le numéro de l'organisme notifié qui a été consulté.
Enfin, si votre équipement est doté d'un système de cryptologie, une déclaration ou une demande
d'autorisation auprès des services du SGDN (Secrétariat Général de la Défense Nationale), Direction centrale de
la sécurité des systèmes d'information peut être requise. A cette fin, vous pouvez consulter le site:

The French frequency agency (ANFR) received your notification the 21/05/2007 and recorded
it under the number 14107. In accordance with the provisions of article 6.4 of directive 99/05/EC of 9
March 1999, the marketing in France of this type of equipment cannot begin before the 18/6/2007 ;
The placing on market and/or the putting into service of the notified equipment are submitted
to restrictions since it doesn’t belong to class 1 as defined by the European Commission Decision of 6
April 2000 establishing the initial classification of radio equipment and telecommunications terminal
equipment and associated identifiers (OJEC of April 19 2000,
http://www.europa.eu.int/comm/enterprise/rtte/decision/classif.htm and http://www.ero.dk/rtte).
The French regulation dealing with conditions of use of the high performance radio local area
network (HiperLAN) in the 5 GHz band and the radio local area network (RLAN) in the 2.4 GHz has
been modified during year 2003.
Currently, the regulation concerning HiperLAN sets power restrictions indoor. Moreover, it
states limitations of the frequency bands used when the equipment doesn’t have certain functions such
as a Dynamic Frequency Selection (DFS) capable of avoiding occupied channels and a Transmitted
Power Control (TPC) to ensure a mitigation factor of at least 3db. When the DFS function is required
it must be in compliance with the version 1.3.1 (2005-08), or later version, of the standard EN
301 893.
The regulation relating to RLAN states power restrictions according to the frequency band
used and even different authorisation regimes whether the equipment is used indoor or outdoor.
Consequently, I recommend you to contact the French telecommunications regulatory
authority (ARCEP) (http://www.arcep.fr) in order to provide to consumers precise information about
the conditions of use of this equipment, on its packaging and in the instructions, according to article
6.3 of directive 99/05/EC of 9 March 1999.
In addition, as you know, to be placed on the market, this equipment must bear appropriate
markings, such as CE marking, testifying it complies with the relevant essential requirements, the
equipment class identifier (alert sign) since it doesn’t belong to the class 1, and the identification
number of the notified body consulted, when the case arises.
Finally, if your equipment is equipped with encryption, a declaration or an authorisation by the
services of the Secrétariat Général de la Défense Nationale (SGDN), Direction centrale de la sécurité

enregistrée sous le numéro 14108. En conséquence et en application des dispositions de l’article 6.4 de la
directive 99/05/CE du 9 mars 1999, la commercialisation de ce type d’équipements en France ne peut débuter
avant le 18/6/2007.
La mise sur le marché et/ou la mise en service du matériel que vous avez notifié sont soumises à des
restrictions puisque cet équipement ne relève pas de la classe 1 définie par la décision de la Commission
européenne du 6 avril 2000 établissant la classification initiale des équipements hertziens et des équipements
terminaux de télécommunications ainsi que des identificateurs associés (JOCE du 19 avril 2000,
http://www.europa.eu.int/comm/enterprise/rtte/decision/classif.htm et http://www.ero.dk/rtte).
La réglementation française fixant les conditions d'utilisation des réseaux locaux radioélectriques à haute
performance (Hiperlan) dans la bande des 5 GHz et des réseaux locaux radioélectriques (RLAN) dans la bande
des 2,4 GHz a évolué au cours de l'année 2003. Ainsi, la réglementation relative aux Hiperlan prévoit une
restriction des niveaux de puissance pour une utilisation limitée à l'intérieur des bâtiments, ainsi qu'une limitation
de la bande de fréquences utilisées quand les équipements ne comportent pas la fonction de sélection des
fréquences (DFS) permettant d’éviter l’émission sur des canaux occupés et la fonction de contrôle de puissance
(TPC) permettant une atténuation de la puissance moyenne émise de 3 dB minimum. En outre, pour être
utilisables en France, les équipements dotés de la fonction de sélection des fréquences (DFS) doivent se référer à
la version 1.3.1 (2005-08), ou une version ultérieure, de la norme EN 301 893.
Par ailleurs, la réglementation relative aux RLAN prévoit, selon la bande de fréquences utilisées, des
restrictions des niveaux de puissance pour l'établissement et l'exploitation de ces réseaux voire un régime
d'autorisation différent suivant que l'équipement est utilisé à l'intérieur ou à l'extérieur des bâtiments.
En conséquence, je vous recommande vivement de prendre contact avec l'Autorité de régulation des
communications électroniques et des postes (ARCEP) (http://www.arcep.fr) afin de fournir aux consommateurs
des informations précises concernant les conditions d’utilisation du matériel commercialisé, sur l’emballage et
dans le manuel d'utilisation conformément aux dispositions de l’article 6.3 de la directive 99/05/CE du 9 mars
1999. Par ailleurs, comme vous le savez, pour être mis sur le marché, cet équipement doit porter les marquages
adéquats, notamment le marquage CE attestant qu'il est conforme aux exigences essentielles qui lui sont
applicables, l'identificateur de la catégorie d'équipement (signe d'alerte), puisqu'il ne relève pas de la classe 1
susmentionnée, et le cas échéant le numéro de l'organisme notifié qui a été consulté.
Enfin, si votre équipement est doté d'un système de cryptologie, une déclaration ou une demande
d'autorisation auprès des services du SGDN (Secrétariat Général de la Défense Nationale), Direction centrale de
la sécurité des systèmes d'information peut être requise. A cette fin, vous pouvez consulter le site:

The French frequency agency (ANFR) received your notification the 21/05/2007 and recorded
it under the number 14108. In accordance with the provisions of article 6.4 of directive 99/05/EC of 9
March 1999, the marketing in France of this type of equipment cannot begin before the 18/6/2007 ;
The placing on market and/or the putting into service of the notified equipment are submitted
to restrictions since it doesn’t belong to class 1 as defined by the European Commission Decision of 6
April 2000 establishing the initial classification of radio equipment and telecommunications terminal
equipment and associated identifiers (OJEC of April 19 2000,
http://www.europa.eu.int/comm/enterprise/rtte/decision/classif.htm and http://www.ero.dk/rtte).
The French regulation dealing with conditions of use of the high performance radio local area
network (HiperLAN) in the 5 GHz band and the radio local area network (RLAN) in the 2.4 GHz has
been modified during year 2003.
Currently, the regulation concerning HiperLAN sets power restrictions indoor. Moreover, it
states limitations of the frequency bands used when the equipment doesn’t have certain functions such
as a Dynamic Frequency Selection (DFS) capable of avoiding occupied channels and a Transmitted
Power Control (TPC) to ensure a mitigation factor of at least 3db. When the DFS function is required
it must be in compliance with the version 1.3.1 (2005-08), or later version, of the standard EN
301 893.
The regulation relating to RLAN states power restrictions according to the frequency band
used and even different authorisation regimes whether the equipment is used indoor or outdoor.
Consequently, I recommend you to contact the French telecommunications regulatory
authority (ARCEP) (http://www.arcep.fr) in order to provide to consumers precise information about
the conditions of use of this equipment, on its packaging and in the instructions, according to article
6.3 of directive 99/05/EC of 9 March 1999.
In addition, as you know, to be placed on the market, this equipment must bear appropriate
markings, such as CE marking, testifying it complies with the relevant essential requirements, the
equipment class identifier (alert sign) since it doesn’t belong to the class 1, and the identification
number of the notified body consulted, when the case arises.
Finally, if your equipment is equipped with encryption, a declaration or an authorisation by the
services of the Secrétariat Général de la Défense Nationale (SGDN), Direction centrale de la sécurité
