confidentialinformationofLicensoranditslicensors.You
agreenottoprovideordiscloseanysuchconfidential
informationintheSoftwareorderivedfromittoanythird
party.
4.2Theprovisionsofclause4.1willnotapplytoany
informationwhichis:
4.2.1lawfullyobtainedfreeofanydutyofconfidentiality
(otherwisethandirectlyorindirectlyfromLicensor);or
4.2.2alreadyinyourpossession,providedthatLicenseecan
showsuchpossessionfromwrittenrecords(otherthanasa
resultofabreachofthisclause4);or
4.2.3whichyoucandemonstrateisinthepublicdomain
(otherthanasaresultofabreachofthisclause4).
4.3Totheextentthatanyinformationisnecessarily
