When yourphone finds a signal, it automatically enters Standby mode thephone's idle state. At this point, you are ready to begin makingand receiving calls.If your phone is unable to find a signal after 15 minutes ofsearching, the Power Save mode is automatically activated.When a signal is found, your phone automatically returns toStandby mode.In the Power Save mode, your phone searches for a signalperiodically without your intervention. While in a menu, pressthe navigation key up, down, left or right to scrollthrough the list and menus. Pressing this key in whennavigating through menus accepts the highlightedchoice in the menus.Pressing the key <1> for two seconds automatically dialsyour voicemail.The navigation keys also provide a shortcut topredefined functions from Standby mode. You canchange the functions pre assigned to the navigationkeys.<Talk> Place or receive a call. In Standby mode, press the keyonce to enter the Outgoing call log. If you press andhold the key down you will initiate Voice Dial.<Back> Deletes characters from the display. When in a menu,

The moreblack bars you see, the greater the charge.Your Phone 2Using and Charging the BatteryBattery CapacityYour Sprint PCS phone is equipped with a Lithium Ion (LiIon)battery. It allows you to recharge your battery before it is fullydrained. The battery provides approximately 2.9 hours ofcontinuous digital talk time (1 hour in analog) or approximately168 hours of continuous digital standby time (15 hours inanalog).Approximately five minutes before the battery charge level getstoo low to operate the phone, the battery sensor will let youknow by blinking an empty battery icon ( ), sounding anaudible alert and displaying a warning message. If you continueto operate the phone without charging, the phone will turn off
automatically (after a three to five minute delay). If thishappens, your call will end.Note: Long backlight settings, searching for service, vibrate mode andBrowser use affect the battery's talk and standby times.Tip: Be sure to charge your phone's battery and watch your indicator toensure your levels are okay.Installing the BatteryYour Sprint PCS phone comes with a LiIon battery. Follow thesesteps to install it:1. Place the battery on the back of the phone with the top of thebattery about 1/4 inch to 1/2 inch from the battery latch.2. Gently push the battery toward the top of the phone until itsnaps into place.Removing the BatteryTo remove your battery for charging or for another reason, follow these easy steps:1. Make sure the power is off by pressing and holding <End> soyou don't lose any stored numbers or messages.2. Press the battery release latch and slide the battery away from the latch.3. Lift the battery away from the phone.Charging the BatteryYour Sprint PCS phone comes with a rechargeable battery. Youshould charge the battery as soon as possible so you can beginusing your phone.Keeping track of your battery's charge is important. For a quickcheck of your phone's battery level, glance at the battery chargeindicator located in the upper-right corner of your phone'sdisplay screen. If the battery charge gets too low, the battery icon( ) blinks and the phone sounds a warning tone.Always use a Sprint PCS-approved desktop charger, travelcharger or cigarette lighter adapter to charge your battery.Warning! Using the wrong battery charger could cause damage to yourphone and void the warranty.Using the Travel AdapterPlug the connector of the supplied travel adapter into the serialconnector at the bottom of your phone, and then into the ACwall outlet.When the travel adapter is plugged in and charging the phone,the phone displays a charging light and the battery icon starts toblink. The phone can still be used while it is plugged into thetravel adapter, but this will cause the phone to charge moreslowly. To quickly charge the phone, turn the power off.Using the Dual-Slot Desktop ChargerYou can purchase an optional dual-slot desktop charger from thelocal Sprint PCS Centers.To use the desktop charger:
1. Plug the desktop charger's power cord into a wall outlet.2. Insert the phone (with the battery installed) into the frontslot of the charger.Or, insert the battery alone into the rear slot.The LED on the front of the dual-slot desktop charger indicatesthe following:.Ared light indicates the battery is charging..Agreen light indicates the battery is at least 90 percentcharged..Ayellow light indicates that the battery is operating at atemperature that is too high or too low, or that there is a poorconnection. Make sure the phone is resting in the chargerslot.It generally takes about four hours to fully recharge a completelydischarged battery. indicates what you'll see depending on where you're using yourphone.Tip: Remember, when you're using your phone off the Sprint PCS Network,always dial numbers using 11 digits (1 + area code + number.)Note: You will pay a higher per-minute rate for roaming calls.RoamingonOtherDigitalNetworksWhen you're roaming on other digital networks, your callquality and security will be similar to the quality you receivewhen making calls while on the Sprint PCS Network. You maynot be able to access certain calling features, such as Sprint PCSWireless Web.RoamingonAnalogNetworksWhenyouroamonanalognetworks,youwillexperienceasimilar quality provided by other analog carriers today.Although some calling features, such as Sprint PCS WirelessWeb, may be unavailable, you can still make and receive calls.You will experience a few differences including:.You are more likely to experience static, cross-talk, fade-outand dropped calls..Some calling features which are standard on the Sprint PCSNetwork, such as Call Waiting, Sprint PCS Wireless Web anddirect international dialing, are unavailable..There are security and privacy risks (eavesdropping andcloning) that exist with conventional analog services today..Your battery needs recharging sooner when you use yourphone for analog roaming.Tip: If you're on a call when you leave the Sprint PCS Network and enteran area where roaming is available (whether digital or analog), your call isdropped. If your call is dropped in an area where you think Sprint PCSService is available, turn your phone off and on again to reconnect to theSprint PCS Nationwide Network.Setting Your Phone's Roam ModeYour Sprint PCS phone allows you to control your ability toroam. By using the Roaming menu option, you determine whichsignals your phone accepts.Set ModeChoose from three different settings on your dual-band modephone to control your roaming experience:1. Press <Menu> for the Main menu.2. Select Settings on Main menu.3. Press <8> for Others and then <7> for Roaming.4. Press <1> for Set Mode. Using the navigation key, scroll toselect:.Automatic: This setting seeks Sprint PCS Service. When
Sprint PCS Service is unavailable, it searches for analternative system..Analog: This setting forces the phone to seek an analogroaming system. The previous setting is restored the nexttime the phone is turned on..Sprint : This setting allows you to select the Sprint PCSNationwide Network only and prevents roaming on othernetworks.5. Press <OK> to Save.Setting an Alert When Roam Charges Apply (Call Guard)Inadditiontotheroamingicon, Call Guard alerts you whenroaming charges apply. This feature makes it easy to manageyour roaming charges by reminding you when you make orreceive roaming calls. It also requires you to take additionalsteps before placing or answering a roaming call. Theseadditional steps are not required when you make or receive callswhile on the Sprint PCS Nationwide Network.To turn the Call Guard feature on or off:1. Press <Menu> for the Main menu.2. Select Settings on Main menu.3. Press <8> for Others and then <7> for Roaming.4. Press <2> for Call Guard. Wait briefly until a messageprompt displays and then disappears from the displayscreen.5. Select Yes or No, and press <OK>..If the Yes option is chosen, an extra step is required to makeor take roaming calls..If the No option is chosen, no extra step is required to makeor take roaming calls.To place the roaming calls with the Call Guard on:1. From Standby mode, dial 1+ area code + the seven-digit number.(You can also initiate a call from the Internal Phone Book,Call History or Sprint PCS Web Messages) and press <Talk>.2. A message is displayed indicating that roaming rate applies.Press <1> to place the call.To answer incoming roaming calls with the Call Guard on:Remember if the Call Guard feature is set to On, you need to takeextra steps to make and receive roaming calls even if you haveselected the Analog setting.To set the time and date in Analog mode:The time and date are set automatically by the Sprint PCSnetwork. If you are outside your coverage area and are in analogmode, the time and date are not automatically updated. To setthe time and date in analog mode, see "Set Time".

From Standby mode, enter four digits of any phone numberstored in the Phonebook.2. Press <Talk>.Note: If more than one number is found with the same last four digits, usethe navigation key to scroll up or down to the desired entry. When thedesired number is highlighted, press .Using One/Two/Three Speed DialingWith this feature, you can automatically call the numbers storedin your internal Phonebook using one key press for locations 1-9, two key presses for locations 10-99, or three key presses forlocations 100-250.To use One-Touch Dialing for the Phonebook entries 1-9:1. Press and hold the appropriate key for two seconds. Thedisplay confirms that the number has been dialed when itshows “Connecting.”To use Two-Touch Dialing for the Phonebook entries 10-99:1. A 2-second pause causes the phone to stop dialingfor two seconds. When an incoming call is not answered, the number of missedcalls together with the last call's phone number is displayed onyour screen.To display the Missed Call log and view the last 10 missed calls:1. This section guides you throughaccessing and making the most of your Call History.Viewing Call History (Incoming, Outgoing and Missed)You'll find your Call History invaluable. It is a list of the last 10phone numbers or the internal Phone Book entries for calls youplaced, received or missed. Call History makes redialing anumber fast and easy. It is continually updated as new numbersare added to the beginning of the list and the oldest entries areremoved from the bottom of the list.Each entry contains the phone number (if it is available) and theinternal Phone Book entry name (if the phone number is in yourinternal Phone Book). Duplicate calls (same number and type ofcall) may only appear once on the list.To view a Call History entry:1. Press <Menu> for the Main menu.2. Select 1:Calls(List Style), or Select 5:Calls(3x3 Style)3. Select 1:Missed Calls, 2:Outgoing Calls,or3:Incoming Calls. Only onenumber per entry can be set to Speed Dial..E-mail is used as a label when saving an E-mail address..Group is used to save the phone book entry into a group. Thedefault groups are: No Group, Friend, Family, Colleague, orVIP..Name ring is used to designate a specific ringer sound whenyou receive a call from the number saved in the phone book.Note: “ Default” means the global ringer selected for all incomingcalls will be played..Birthday allows you to enter the Date input screen..Secret hides the phone number and user information fromdisplaying on the screen. Instead, Secret is displayed.Note: These numbers can still be dialed, but the name & number willbe hidden..Image is used to designate a specific image when you receivea call from the one of the numbers in the entry. You can alsouse downloaded images or erase a selected image.Saving Phone Numbers With PausesYou can dial or save phone numbers with pauses for use withautomated systems, such as voicemail or credit card billingnumbers. If you select a hard pause, the next set of numbers aresent when you press <Talk>. If you select a 2-second pause,your phone automatically sends the next set of numbers aftertwo seconds.Note: You can have multiple pauses in a phone number and combine2-second and hard pauses.To save a phone number with pauses:
1. At the step you enter a phone number to store in yourinternal Phonebook (refer to step 1 to step 3 on page xx),press <Menu> to open the Menu options.2. This reduces the wireless web usage times.If the phone has been inactive for a while and a new wirelessInternet site has not been requested, the Browser willautomatically disconnect. The Browser will remain active onlythe connection will end. The Browser will automaticallyreconnect when you go to a wireless Internet site that's notstored in the phone's memory cache. For this reason, you mayfind that you are billed for several network connections within a
single session. This is normal and is designed to minimizeairtime charges.When launching the Browser, you may need to take an extrastep or see a reminder that Browser calls will be charged. connect to a laptop PC, hand-held or palm-sized computingdevice to send and receive e-mail, access the Internet or yourcompany's network and more, without searching for a wall-mountedtelephone jack. In just three steps, you can use yourconnectivity:1. First, you'll need a Sprint PCS Wireless Web Connection Kit(sold separately).2. Connect your laptop PC to your Sprint PCS Phone by usingthe serial data cable. The cable adapter will connect to ahandheld or palm-sized computing device.3. Finally, take a few minutes to install the Sprint PCS DialerSMsoftware onto your computer using your CD..For complete details on how to install and use the software,refer to the user guide in the Sprint PCS Wireless WebConnection Kit you purchased.Note: You will not have to install the Sprint PCS Dialer for Palm®orHPC/Windows CE.Placing a Data CallTo place a data call while you're connected to the Sprint PCSWireless Web:1. First, make sure the cable is connected properly.2. Open the Sprint PCS Dialer application on your computerand place the call..The phone displays the number your computer is callingand a “connecting” message is displayed..Once the call successfully connects, your phone's displayshows you information on the status of the data call.Receiving Sprint PCS Wireless Web CallsMost users use the Sprint PCS Wireless Web Connection to placeoutgoing data/fax calls. But you can also set up your Sprint PCSPhone to receive (host) data and fax calls. Because each phonemodel is different, the Sprint PCS Wireless Web Connection Kitdoesn't include instructions for how to set up your phone toreceive data and fax calls. Here's the procedure to set up yourSprint PCS Phone to receive a (mobile-terminated) data or faxcall:1. Select the menu option to enable incoming data/fax calls.Note that incoming voice calls are not possible when yourSprint PCS Phone is set to receive data/fax calls.2. What kinds of phones are the subject of this update?The term wireless phone refers here to hand-held wireless phones with built-in antennas, often called cell, mobile, or PCS phones.These types of wireless phones can expose the user to measurable radio frequency energy (RF) because of the short distancebetween the phone and the user s head. These RF exposures are limited by Federal Communications Commission safetyguidelines that were developed with the advice of FDA and other federal health and safety agencies. When the phone is locatedat greater distances from the user, the exposure to RF is drastically lower because a person's RF exposure decreases rapidly withincreasing distance from the source. The so-called cordless phones, which have a base unit connected to the telephone wiring ina house, typically operate at far lower power levels, and thus produce RF exposures well within the FCC's compliance limits.2. Do wireless phones pose a health hazard?The available scientific evidence does not show that any health problems are associated with using wireless phones. There is noproof, however, that wireless phones are absolutely safe. Wireless phones emit low levels of radio frequency energy (RF) in themicrowave range while being used. They also emit very low levels of RF when in the stand-by mode. Whereas high levels ofRF can produce health effects (by heating tissue), exposure to low level RF that does not produce heating effects causes noknown adverse health effects. Many studies of low level RF exposures have not found any biological effects. Some studies havesuggested that some biological effects may occur, but such findings have not been confirmed by additional research. In somecases, other researchers have had difficulty in reproducing those studies, or in determining the reasons for inconsistent results.3. What is FDA's role concerning the safety of wireless phones?Under the law, FDA does not review the safety of radiation-emitting consumer products such as wireless phones before they can be sold, as it
does with new drugs or medical devices. However, the agency has authority to take action if wireless phones are shown to emit radio frequencyenergy (RF) at a level that is hazardous to the user. In such a case, FDA could require the manufacturers of wireless phones to notify users ofthe health hazard and to repair, replace or recall the phones so that the hazard no longer exists.Although the existing scientific data do not justify FDA regulatory actions, FDA has urged the wireless phone industry to take a number of steps,including the following:Support needed research into possible biological effects of RF of the type emitted by wireless phones; Design wireless phones in a way thatminimizes any RF exposure to the user that is not necessary for device function; and Cooperate in providing users of wireless phones with thebest possible information on possible effects of wireless phone use on human healthFDA belongs to an interagency working group of the federal agencies that have responsibility for different aspects of RF safety to ensurecoordinated efforts at the federal level. The following agencies belong to this working group:National Institute for Occupational Safety and Health Environmental Protection Agency Federal Communications Commission Occupational Safetyand Health Administration National Telecommunications and Information AdministrationThe National Institutes of Health participates in some interagency working group activities, as well.FDA shares regulatory responsibilities for wireless phones with the Federal Communications Commission (FCC). All phones that are sold in theUnited States must comply with FCC safety guidelines that limit RF exposure. FCC relies on FDA and other health agencies for safety questionsabout wireless phones.FCC also regulates the base stations that the wireless phone networks rely upon. While these base stations operate at higher power than do thewireless phones themselves, the RF exposures that people get from these base stations are typically thousands of times lower than those they canget from wireless phones. Base stations are thus not the primary subject of the safety questions discussed in this document.4. What is FDA doing to find out more about the possible health effects of wireless phone RF?FDA is working with the U.S. National Toxicology Program and with groups of investigators around the world to ensure that high priorityanimal studies are conducted to address important questions about the effects of exposure to radio frequency energy (RF).FDA has been a leading participant in the World Health Organization International Electromagnetic Fields (EMF) Project since its inception in1996. An influential result of this work has been the development of a detailed agenda of research needs that has driven the establishment ofnew research programs around the world. The Project has also helped develop a series of public information documents on EMF issues.FDA and the Cellular Telecommunications & Internet Association (CTIA) have a formal Cooperative Research and Development Agreement(CRADA) to do research on wireless phone safety. FDA provides the scientific oversight, obtaining input from experts in government, industry,and academic organizations. CTIA-funded research is conducted through contracts to independent investigators. The initial research will includeboth laboratory studies and studies of wireless phone users. The CRADA will also include a broad assessment of additional research needs in thecontext of the latest research developments around the world.5. What steps can I take to reduce my exposure to radio frequency energy from my wireless phone?If there is a risk from these product sand at this point we do not know that there isit is probably very small. But if you are concerned aboutavoiding even potential risks, you can take a few simple steps to minimize your exposure to radio frequency energy (RF). Since time is a keyfactor in how much exposure a person receives, reducing the amount of time spent using a wireless phone will reduce RF exposure.If you must conduct extended conversations by wireless phone every day, you could place more distance between your body and the source ofthe RF, since the exposure level drops off dramatically with distance. For example, you could use a headset and carry the wireless phone awayfrom your body or use a wireless phone connected to a remote antennaAgain, the scientific data do not demonstrate that wireless phones are harmful. But if you are concerned about the RF exposure from theseproducts, you can use measures like those described above to reduce your RF exposure from wireless phone use.
6. What about children using wireless phones?The scientific evidence does not show a danger to users of wireless phones, including children and teenagers. If you want to take steps to lowerexposure to radio frequency energy (RF), the measures described above would apply to children and teenagers using wireless phones. Reducingthe time of wireless phone use and increasing the distance between the user and the RF source will reduce RF exposure.Some groups sponsored by other national governments have advised that children be discouraged from using wireless phones at all. For example,the government in the United Kingdom distributed leaflets containing such a recommendation in December 2000. They noted that no evidenceexists that using a wireless phone causes brain tumors or other ill effects. Their recommendation to limit wireless phone use by children wasstrictly precautionary; it was not based on scientific evidence that any health hazard exists.7. Do hands-free kits for wireless phones reduce risks from exposure to RF emissions?Since there are no known risks from exposure to RF emissions from wireless phones, there is no reason to believe that hands-free kits reducerisks. Hands-free kits can be used with wireless phones for convenience and comfort. These systems reduce the absorption of RF energy in thehead because the phone, which is the source of the RF emissions, will not be placed against the head. On the other hand, if the phone ismounted against the waist or other part of the body during use, then that part of the body will absorb more RF energy. Wireless phonesmarketed in the U.S. are required to meet safety requirements regardless of whether they are used against the head or against the body. Eitherconfiguration should result in compliance with the safety limit.8. Do wireless phone accessories that claim to shield the head from RF radiation work?Since there are no known risks from exposure to RF emissions from wireless phones, there is no reason to believe that accessories that claim toshield the head from those emissions reduce risks. Some products that claim to shield the user from RF absorption use special phone cases, whileothers involve nothing more than a metallic accessory attached to the phone. Studies have shown that these products generally do not work asadvertised. Unlike hand-free kits, these so-called "shields" may interfere with proper operation of the phone. The phone may be forced to boostits power to compensate, leading to an increase in RF absorption. In February 2002, the Federal trade Commission (FTC) charged two companiesthat sold devices that claimed to protect wireless phone users from radiation with making false and unsubstantiated claims. According to FTC,these defendants lacked a reasonable basis to substantiate their claim.9. What about wireless phone interference with medical equipment?Radio frequency energy (RF) from wireless phones can interact with some electronic devices. For this reason, FDA helped develop a detailed testmethod to measure electromagnetic interference (EMI) of implanted cardiac pacemakers and defibrillators from wireless telephones. This testmethod is now part of a standard sponsored by the Association for the Advancement of Medical instrumentation (AAMI). The final draft, a jointeffort by FDA, medical device manufacturers, and many other groups, was completed in late 2000. This standard will allow manufacturers toensure that cardiac pacemakers and defibrillators are safe from wireless phone EMI.FDA has tested hearing aids for interference from hand held wireless phones and helped develop a voluntary standard sponsored by the Instituteof Electrical and Electronic Engineers (IEEE). This standard specifies test methods and performance requirements for hearing aids and wirelessphones so that that no interference occurs when a person uses a compatible phone and a compatible hearing aid at the same time. This standardwas approved by the IEEE in 2000.FDA continues to monitor the use of wireless phones for possible interactions with other medical devices. Should harmful interference be foundto occur, FDA will conduct testing to assess the interference and work to resolve the problem.10. What are the results of the research done already?The research done thus far has produced conflicting results, and many studies have suffered from flaws in their research methods. Animalexperiments investigating the effects of radio frequency energy (RF) exposures characteristic of wireless phones have yielded conflicting resultsthat often cannot be repeated in other laboratories. A few animal studies, however, have suggested that low levels of RF could accelerate thedevelopment of cancer in laboratory animals. However, many of the studies that showed increased tumor development used animals that had beengenetically engineered or treated with cancer-causing chemicals so as to be pre-disposed to develop cancer in the absence of RF exposure. Other
studies exposed the animals to RF for up to 22 hours per day. These conditions are not similar to the conditions under which people usewireless phones, so we don t know with certainty what the results of such studies mean for human health.Three large epidemiology studies have been published since December 2000. Between them, the studies investigated any possible associationbetween the use of wireless phones and primary brain cancer, glioma, meningioma, or acoustic neuroma, tumors of the brain or salivary gland,leukemia, or other cancers. None of the studies demonstrated the existence of any harmful health effects from wireless phone RF exposures.However, none of the studies can answer questions about long-term exposures, since the average period of phone use in these studies was aroundthree years.11. What research is needed to decide whether RF exposure from wireless phones poses a health risk?A combination of laboratory studies and epidemiological studies of people actually using wireless phones would provide some of the data that areneeded. Lifetime animal exposure studies could be completed in a few years. However, very large numbers of animals would be needed toprovide reliable proof of a cancer promoting effect if one exists. Epidemiological studies can provide data that is directly applicable to humanpopulations, but 10 or more years follow-up may be needed to provide answers about some health effects, such as cancer. This is because theinterval between the time of exposure to a cancer-causing agent and the time tumors develop - if they do - may be many, many years. Theinterpretation of epidemiological studies is hampered by difficulties in measuring actual RF exposure during day-to-day use of wireless phones.Many factors affect this measurement, such as the angle at which the phone is held, or which model of phone is used.12. We donot guarantee that there will be no interruptions or delays in Services.Your Sprint PCS Phone™will not accept the services of any wirelessprovider other than Sprint PCS (but see Roaming).NumberWe assign a phone number (“Number”) to the phone or otherequipment used by you on the Sprint PCS Network. We may change theNumber without compensation by giving you prior notice. You do notown the Number. You may not modify the Number we program intoany phone or other equipment.Phone Activation FeeYou may be required to pay a non-refundable phone activation fee whenyou activate a new Number, have us switch a Number to a differentphone, we activate a different phone on your existing account or yourService Plan says so. Details on any applicable phone activation fee areset out in your Service Plan or can be obtained by calling Sprint PCSCustomer Care.ChargesFor most forms of wireless Service, your usage will be charged from thetime you first initiate contact between your phone or other wirelessdevice and the network until the network connection is broken, whetheror not you are successful in connecting with the service with which youseek to connect, even if the connection is later broken or dropped. Anexception is that you are not charged for voice calls that are notcompleted. You are charged for completed calls to your Number fromthe time shortly before the phone starts ringing until the call isterminated by either party. You will be charged peak rates for the entireduration of calls initiated during the peak time periods applicable toyour Service. You will be charged off-peak rates for the entire durationof calls initiated during the off-peak time periods applicable to yourService. In addition to these usage charges, you may be charged forrecurring monthly service charges, applicable local and long-distancetoll charges, other usage charges, connection fees, roaming charges,directory assistance, call completion charges, optional features youselect at an extra cost, and taxes and other regulatory related charges.Charges for most Services are incurred in one-minute increments, with
partial minutes of use rounded up to the next highest minute. You mustpay, by each invoice due date, all charges for Services provided to theNumber for each phone or other equipment that our records show youactivated, no matter who actually uses or has possession of the phone orother equipment at the time Services are provided.Voice CommandSprint PCS Voice CommandSM is an optional service that allows you toplace calls by using speech recognition technology. Calls to 911 orsimilar emergency numbers cannot be placed through the VoiceCommand feature. Airtime and applicable long distance charges for acall completed from your Number using the Voice Command featurebegin when you press or activate the TALK or similar keys and endwhen your call is terminated by hitting the END key or by returning tothe Voice Command platform. If you initiate and complete another callwithout leaving the Voice Command platform, a separate charge forthat call will begin from the time the previous call was terminated.Airtime and applicable long distance charges will be applied to theentire length of a completed call initiated from Voice Command. UsingDirectory Assistance to input names into your Voice Command addressbook will incur additional charges. Details on charges for the VoiceCommand feature can be found in the marketing materials for thisfeature, by visiting www.sprintpcs.com or by calling Sprint PCSCustomer Care.InvoicingInvoicing cycles are approximately 30 days in length. Invoicing cyclesand dates may change from time to time. Except as otherwise providedin your Service Plan, monthly recurring charges (MRCs) are invoicedone invoicing cycle in advance. Charges for Services are usuallyinvoiced as soon as possible after the charges accrue. We may, however,invoice you for usage and charges occurring before the invoicing cyclebeing invoiced, if they were not previously invoiced. If you are invoicedfor usage incurred during a prior invoicing cycle, those minutes will beapplied to your Service Plan minutes for the current invoicing cycle.However, if you change your Service Plan between the time the usagewas incurred and the beginning of the current invoicing cycle, thoseminutes from the prior invoicing cycle will be charged at the rate perminute for usage over included minutes provided in the Service Plan ineffect at the time the usage was incurred.PaymentIf you have authorized payment for Services or equipment by creditcard or by debiting a bank account, no additional notice or consent isrequired before we invoice the credit card or debit the bank account forall amounts due to us or billed by us on behalf of a third party. You mustpromptly notify us of any change in your invoicing address or of thecredit card or bank account used for payment. We reserve the right torequire payment by money order, cashier's check or other secured formof payment. If we take action to receive payment beyond invoicing youfor charges for Services or equipment, you must pay our costs andexpenses of collection, including attorneys' fees and expenses, the fees
of any collection agency and court costs. If we act as an invoicing agentfor a third-party service provider, payments received are first applied toamounts due and owing to us and any remaining amounts are appliedto sums due and owing to the third-party service provider. We maycharge an additional fee for any check or other negotiable instrumentendorsed by you and returned unpaid by a financial institution for anyreason. You may be charged fees for certain methods of payment.Late Payment ChargesPayment is past due if we do not receive it by the due date shown onyour invoice. Any payment for Services and equipment not made whendue accrues late charges until paid at the rate of 1.5% per month or atthe highest rate allowed by law. Late charges are prorated daily for eachday that payment is past due, but are not compounded monthly.Acceptance of late or partial payments (even if marked “paid in full”)does not waive our right to collect all amounts that you owe us.Disputed ChargesYou must raise any dispute that you have about any charges invoiced toyou within 15 days of the date of the invoice or you have accepted theinvoice. You may notify us of any dispute by notifying Sprint PCSCustomer Care. Calls to our sales or general business offices are notnotice of a dispute. If disputed invoice procedures are described on theinvoice, you must follow them.Termination. Non-Term Service Plan.If you are on a Non-Term Service Plan you may terminate Services atany time by giving us notice. Subject to the terms of this Agreement, wemay terminate Services at any time, with or without notice. We maydeactivate any Number before you receive notice of terminationwithout liability to you. Termination by either of us may be with orwithout cause.Termination. Term Service Plan.If you are on a Term Service Plan (1) your ability to terminate Servicesbefore the end of the term is limited, (2) your ability to change toanother Service Plan before the end of the term may be limited, and mayresult in a termination or activation fee, (3) you may be required to pay atermination fee, (4) we may not terminate Services without cause beforethe end of the term and (5) if we terminate Services for cause before theend of the term, you may be required to pay a termination fee. Notermination fee is charged if you terminate a Term Service Plan within14 days of activation of your Sprint PCS Phone. During the term wemust give each other notice to terminate Services. At and after theexpiration of the term, you may terminate Services at any time by givingus notice and we may, subject to this Agreement, terminate Services atany time, with or without notice.Termination. General.Regardless of whether you have a Non-Term or a Term Service Plan, wemay terminate or suspend Services to you without liability (1) if youbreach any provision of this Agreement (including if you fail to pay any
charges for Services), or (2) if you fail to pay any charges due us forequipment or otherwise. If you promptly cure the breach, we may, butare not obligated to, reactivate Services to you. You must pay all chargesfor (a) Services provided before termination of a Number and (b)equipment, regardless of who terminates Services. If Services areterminated before the end of your current invoicing cycle, (i) themonthly recurring charge is not prorated to the date of termination, and(ii) you will not receive a credit or refund for any unused minutes inyour Service Plan.Account Spending LimitIf we agree to provide Services to you on an Account Spending Limitbasis, we will tell you your Account Spending Limit before we startServices to your Number, or as reasonably practicable after the limit isimposed. If we require a deposit for you to establish or keep Services onan Account Spending Limit basis, we will hold the deposit as partialguarantee of payment for Services (see Deposits). Charges for Servicesaccrue against your Account Spending Limit as they are incurred. Wemay charge an initial ASL start up fee. We may charge a monthly ASLservice fee, in addition to your recurring monthly service charge. Wemay suspend Services to your Number without prior notice to youwhen your account balance reaches your Account Spending Limit.Services are restored when you have paid any past due balance and paya specified minimum amount to reduce your account balance belowyour Account Spending Limit. We may change this minimum amount atany time upon notice to you. You may pay any past due balance and theminimum amount by any method authorized by Sprint PCS. Call SprintPCS Customer Care for information about authorized methods ofmaking these payments. We may charge you a fee for calls that involveour live customer care services. If we provide Services to you on anAccount Spending Limit basis, Services and coverage may be limited incertain ways. You must pay all charges for Services even if they exceedthe amount of your Account Spending Limit.DepositsIf we require a deposit for you to establish or keep Services, we will holdthe deposit as partial guarantee of payment for Services. We maychange the deposit amount at any time to reflect revised estimatedmonthly charges based upon your usage. A deposit may not be used topay any invoice (unless it is used to pay a final invoice) or delaypayment. The deposit amount, the length of time we hold the depositand changes to the deposit amount are determined based on your creditand payment history. The rate of interest on the deposit is subject tochange. We may mix deposits with our other funds. If Services areterminated for any reason, we may, without notice to you, apply yourdeposit toward payment of outstanding charges and return any excessto you at your last known address within 75 days after termination ofServices. If the U.S. Postal Service cannot deliver the money to you andreturns it to us, we will hold it for you for one year from the date ofreturn and, during that period, we may charge a monthly servicing feeagainst the deposit balance. Any money held during this one-yearperiod will not accrue interest for your benefit. You forfeit any portion
of the money left after the one-year period.Wireless Web and Voice Portal ServicesWireless Web Services are part of the Services that can be obtainedthrough Sprint PCS. Wireless Web Services may not be immediatelyavailable in some Sprint PCS affiliate markets. Use of Wireless WebServices requires a wireless data compatible phone or certain otherequipment (or both) and is subject to any memory, storage or otherlimitation in the phone or other equipment. The Caller ID blockingfeature is not available when using Wireless Web Services. For data calls(including Wireless Web and Voice Portal calls) that are attempted, butnot completed, you are charged for the time during which the networkattempts to connect the call. You are charged for time spent connected tothe Wireless Web or Voice Portal, including time spent browsing on theInternet or Voice Portal and reviewing or scrolling through Internetinformation on-line while still connected to the Sprint PCS Network.Not all Internet sites can be accessed and you may receive an errormessage if you attempt to access a site that cannot be accessed throughWireless Web Services. You are also charged for Wireless Webconnections to review your Sprint PCS account information. WirelessWeb Services and Voice Portal data calls may not be available when youare roaming off the Sprint PCS Network. Wireless Web Services are notavailable to you if you are on a Sprint PCS Prepaid Service Plan. If youreceive Services on an Account Spending Limit basis, you may belimited in the Wireless Web and Voice Portal Services available to you.Call Sprint PCS Customer Care or visit our website atwww.sprintpcs.com for availability and equipment compatibilityinformation. Specific additional information about Wireless WebServices and Voice Portal Services, including pricing, included minutesand combining with other Service Plans, is available in our standardsales collateral for Sprint PCS Wireless Web Services and Voice PortalServices or at www.sprintpcs.com. Sprint PCS is not a publisher of thirdparty content that can be accessed through Wireless Web Services orVoice Portal Services. Sprint PCS is not responsible for any opinions,advice, statements, services or other information is provided by thirdparties and accessible through Wireless Web Services or Voice PortalServices. Neither Sprint PCS nor its vendors or licensors guarantees theaccuracy, completeness or usefulness of information that is obtainedthrough the Wireless Web Services or Voice Portal Services. You areresponsible for evaluating such content.Taxes and Other Regulatory Related ChargesWe invoice you for taxes, fees and other charges levied by federal, stateor local authorities, or foreign government on Services. We also assesscharges associated with regulatory mandates and obligations, such asUniversal Service and Enhanced 911 service. If you claim any taxexemption, you must provide us with a valid tax-exempt document.Any tax exemption applies only from the date we receive a valid taxexemptdocument.RoamingCalls made outside of your Home Service Area and outside of the Sprint
PCS Network are “roaming” calls. Your Sprint PCS phone is specificallydesigned and engineered to work only on the Sprint PCS Network. Itworks on another CDMA PCS provider's system only when a roamingagreement is in place between Sprint PCS and the other provider. Ifyour Sprint PCS Phone is a dual-mode phone, it works on both a CDMAPCS provider's system (in addition to the Sprint PCS Network) and awireless analog telecommunications provider's system only whenroaming agreements are in place between Sprint PCS and the otherproviders. If we do not have a roaming agreement in place, you may beable to place roaming calls “manually” by using a valid credit card. Ifthere is a gap or other interruption of coverage within a Sprint PCScoverage area that prevents connection with the Sprint PCS networkand your dual-mode phone is set to roam automatically when outsideSprint PCS coverage, you may incur roaming fees within a Sprint PCScoverage area. Certain features are not available when roaming.Roaming rates may be different from and higher than the rates you payfor calls within your Sprint PCS Home Service Area and on the SprintPCS Network. Roaming charges are invoiced according to the practicesof the roaming service provider. When roaming, you are subject to thelimitation of liability provisions and other applicable rules imposed bythe roaming service provider.Interruption of ServiceWe may give credit for a continuous interruption of Services for morethan 24 hours on a case-by-case basis. Interruptions caused by yournegligent or willful actions, or by failure of equipment or service notprovided by us, or by causes beyond our reasonable control, do notqualify for credit. We may provide you with an airtime credit of oneminute for a call that is disconnected because of transmission limitationscaused by atmospheric, geographic or topographic conditions and thatyou redial within one minute of disconnection. You must notify uswithin 24 hours of the disconnection to request credit.Phones and Other EquipmentPhones and other equipment may be purchased and returned asprovided in the purchase documents. We are not the manufacturer ofthe phones or other equipment. The only warranties on the phones orother equipment are any limited warranties extended by themanufacturers. We have no liability in connection with the phones andother equipment or for the manufacturers' acts or omissions.Lost or Stolen EquipmentIf your phone or other equipment is lost or stolen, you must notify us bycalling Sprint PCS Customer Care. You are responsible for all chargesfor Services provided to the Number for the lost or stolen equipmentbefore you notify us of the loss or theft. We will deactivate Services tothe Number upon notification to us of any loss or theft. You may berequired to provide evidence of the loss or theft (for example, a policereport or sworn statement). If the equipment is later found, we mayrequire that you exchange it for another phone or other equipmentbefore we reactivate Services (if we do reactivate Services), as well asrequire you to pay a reactivation fee. We will deactivate Services to any
Number without prior notice to you if we suspect any unlawful orfraudulent use of the Number. You agree to cooperate reasonably withus in investigating suspected unlawful or fraudulent use.Caller IDIf you do not want people you call to get the Number assigned to yourphone, you must call Sprint PCS Customer Care for information aboutautomatic Caller ID blocking. The Number assigned to your phone canbe blocked on a per-call basis by dialing *67 + Destination Number +OK, but Caller ID delivery resumes on the next call you make. Caller IDdisplay on incoming calls to your Number depends on receiving theinformation from the calling party.TTY AccessA TTY (also known as TDD or Text Telephone) is a telecommunicationsdevice that allows people who are deaf or hard of hearing, or who havespeech or language disabilities, to communicate by telephone. It is notpossible to use your phone with a TTY.Pay-Per-Call ServiceWe will not complete calls from your Number to 900, 976 and similarnumbers for pay-per-call services.International CallingYou may be limited in the international destinations that you can callwith Services. You should contact Sprint PCS Customer Care forinformation about international destinations that you cannot call.Limitation of LiabilityExcept as otherwise provided in this section, our sole liability to you forany loss or damage arising out of providing or failing to provideServices (including mistakes, omissions, interruptions, delays, errors, ordefects) does not exceed (1) in cases related to a specific piece ofequipment, the prorated MRC for Services to the piece of equipmentduring the affected period, or (2) in cases not related to a specific pieceof equipment, the prorated MRCs for Services to you during the affectedperiod. Neither we nor our vendors, suppliers or licensors are liable forany damage arising out of or in connection with:a) any act or omission of any telecommunications service or otherservice provider other than us;b) any directory listing;c) any dropped calls or inability to place or receive calls;d) any interruption of Services, including interruptions caused byequipment or facilities failure or shortages, transmission limitations orsystem capacity limitations;e) traffic or other accidents, or any health-related claims allegedlyarising from the use of Services, phones, equipment or accessories usedin connection with the Services;f) the use of Sprint PCS Wireless Web Services, including the accuracy orreliability of any information obtained from the Internet using SprintPCS Wireless Web Services or from Voice Portal Services, or Internetservices, content or applications not supported by Sprint PCS;
g) any late or failed message delivery;h) any interruption or failure of 911 or E911 emergency services oridentification of the Number, address or name associated with anyperson accessing or attempting to access emergency services from yourphone;i) the installation or repair of any products or equipment by parties whoare not our authorized employees or agents;j) events due to factors beyond our control, including acts of God(including, without limitation, weather-related phenomena, fire orearthquake), war, riot, strike, or orders of governmental authority;k) any act or omission of any third party or independent contractor thatoffers products or services in conjunction with or through the Services,orl) your negligent or intentional act or omission.NO CONSEQUENTIAL OR OTHER DAMAGESUNDER NO CIRCUMSTANCES ARE WE LIABLE FOR ANYINCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SPECIALDAMAGES OF ANY NATURE WHATSOEVER ARISING OUT OF ORIN CONNECTION WITH PROVIDING OR FAILING TO PROVIDESERVICES, PHONES OR OTHER EQUIPMENT USED INCONNECTION WITH THE SERVICES, INCLUDING, WITHOUTLIMITATION, LOST PROFITS, LOSS OF BUSINESS, OR COST OFREPLACEMENT PRODUCTS AND SERVICES. THIS SECTIONSURVIVES TERMINATION OF THIS AGREEMENT.IndemnificationYou indemnify and defend us, our partners, directors, officers,employees and agents from and against any claim, action, damage,liability and expense arising out of or in connection with: (1) your actsor omissions that occur in connection with your use of the Services orequipment used in connection with the Services, and (2) anycommunications you make or receive using the Services. Thisindemnification extends to and includes any attorney's fees and costsincurred by us arising from any actions or claims to which thisindemnification applies, or from the contesting of the applicability ofthis provision. This section survives termination of this Agreement.ARBITRATION OF DISPUTESANY CLAIM, CONTROVERSY OR DISPUTE, WHETHER SOUNDINGIN CONTRACT, STATUTE, OR TORT, INCLUDING FRAUD,MISREPRESENTATION, OR ANY OTHER LEGAL THEORY,RELATED DIRECTLY OR INDIRECTLY TO THE SERVICES,WHETHER BETWEEN THE COMPANY AND THE CUSTOMER ORBETWEEN THE COMPANY OR THE CUSTOMER, ON THE ONEHAND, AND EMPLOYEES, AGENTS OR AFFILIATED BUSINESSESOF THE OTHER PARTY, ON THE OTHER HAND, SHALL BERESOLVED BY ARBITRATION AS PRESCRIBED IN THIS SECTION.THE FEDERAL ARBITRATION ACT, NOT STATE LAW, GOVERNSTHE QUESTION OF WHETHER A CLAIM IS SUBJECT TOARBITRATION.A single arbitrator engaged in the practice of law will conduct the
arbitration under the rules of the American Arbitration Association. Thearbitrator will be selected in accordance with AAA procedures from alist of qualified people maintained by the AAA. All expeditedprocedures prescribed by the AAA rules will apply, and each party willbear their own costs and attorney's fees.No discovery will be permitted, except that the parties will exchange,thirty days prior to the hearing on their dispute, all documents to besubmitted to the arbitrator, including any reports or summaries, and alist of the names and addresses of those persons to be called to testify.Following exchange of this information, the parties may agree to waivea hearing.The arbitrator will have authority only to award compensatorydamages and will not have authority to award punitive damages, lostprofits, or other non-compensatory damages. The arbitrator's decisionand award will be final and binding, and judgment on the awardrendered by the arbitrator may be entered in any court with jurisdiction.The arbitrator's decision must not contain findings of fact orconclusions of law.If any party files a judicial or administrative action asserting a claim thatis subject to arbitration and another party successfully stays such actionor compels arbitration, the party filing that action must pay the otherparty's costs and expenses incurred in seeking such stay or compellingarbitration, including attorney's fees.NoticesYou may get our current address for written notice by calling Sprint PCSCustomer Care. Written notice to you is sent to your last known addressin our invoicing records. Written notice is deemed delivered 3 days afterdeposit in the U.S. mail, postage prepaid, and properly addressed.Unless required by this Agreement or Applicable Laws, (1) you maynotify us by calling Sprint PCS Customer Care, and (2) we may notifyyou by leaving a message for you on your Sprint PCS Phone, answeringmachine or with your answering service. Notice addresses may bechanged by giving notice as provided in this section.Choice of Law; JurisdictionThis Agreement is governed by and must be construed under federallaw and the laws of the State of Kansas, without regard to choice of lawprinciples. You agree to submit yourself to the personal jurisdiction ofthe courts in the State of Kansas.GeneralIf either of us does not enforce any right or remedy available under thisAgreement, that failure is not a waiver of the right or remedy for anyother breach or failure by the other party. Our waiver of anyrequirement in any one instance is not a general waiver of thatrequirement and does not amend this Agreement. If any part of thisAgreement is held invalid or unenforceable, that part is interpretedconsistent with Applicable Laws as nearly as possible to reflect theoriginal intentions of the parties and the rest of this Agreement remainsin full force and effect. Section headings are for descriptive purposesonly and are not used to interpret this Agreement. You may not assign
this Agreement to any other person or entity without our prior writtenapproval. This Agreement (including any referenced documents andattachments) makes up the entire agreement between you and us andreplaces all prior written or spoken agreements, representations,promises or understandings between you and us. The provisions of thisAgreement that are contemplated to be enforceable after the terminationof the Agreement survive termination of this Agreement. ThisAgreement is subject to any applicable federal and state law(collectively, “Applicable Laws”). If there is a conflict, the Service Plan(including any Term Service Plan) controls over the Terms.The following provisions are not generally applicable and applyonly to customers whose Service Plans include these terms:TravelingIf you are making or receiving calls outside you Home Service Area buton the Sprint PCS Network, you may be charged for Services at a“travel” rate for both outgoing and incoming traveling calls. Longdistance charges may not be included in the travel rate. Travelingcharges do not apply if you subscribe to a Home Rate USA plan or tobothToll-FreeUSAandHomeRateUSA.(SeeHomeRateUSAandToll-Free USA for more information.) You do not have to register yourNumber when traveling outside your Home Service Area.Home Rate USAThis service lets you make or receive calls from anywhere on the SprintPCS Network at your Home Service Area airtime rates.Toll-Free USAThis service lets you call from anywhere on the Sprint PCS Network toanywhere in the United States, Puerto Rico and the U.S. Virgin Islandsand be charged at your Home Service Area airtime rates, with noadditional long distance charges. If you have Home Rate USA but donot have Toll-Free USA, and if you make a long distance call outside ofyour defined local calling area, you are invoiced for the long distancecharges.Manufacturer's WarrantyDISCLAIMER OF WARRANTIES; EXCLUSION OF LIABILITY. EXCEPT ASSET FORTH IN THE EXPRESS WARRANTY CONTAINED ON THISWARRANTY PAGE, THE PURCHASER TAKES THE PRODUCT "AS IS,"AND SAMSUNG MAKES NO WARRANTY OF ANY KIND WHATSOEVERWITH RESPECT TO THE PRODUCT, INCLUDING BUT NOT LIMITED TOTHE MERCHANTABILITY OF THE PRODUCT OR ITS FITNESS FOR ANYPARTICULAR PURPOSE OR USE; THE DESIGN, CONDITION OR QUALITYOF THE PRODUCT; THE PERFORMANCE OF THE PRODUCT; THEWORKMANSHIP OF THE PRODUCT OR THE COMPONENTSCONTAINED THEREIN; OR COMPLIANCE OF THE PRODUCT WITH THEREQUIREMENTS OF ANY LAW, RULE, SPECIFICATION OR CONTRACTPERTAINING THERETO. NOTHING CONTAINED IN THE INSTRUCTIONMANUAL SHALL BE CONSTRUED TO CREATE AN EXPRESSWARRANTY OF ANY KIND WHATSOEVER WITH RESPECT TO THE
PRODUCT. ALL IMPLIED WARRANTIES THAT MAY ARISE BYOPERATION OF LAW, INCLUDING IF APPLICABLE THE IMPLIEDWARRANTIES OF MERCHANTABILITY AND FITNESS FOR APARTICULAR PURPOSE, ARE HEREBY LIMITED TO THE SAMEDURATION OF TIME AS THE EXPRESS WRITTEN WARRANTY STATEDHEREIN. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONGAN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAYNOT APPLY TO YOU. IN ADDITION, SAMSUNG SHALL NOT BE LIABLEFOR ANY DAMAGES OF ANY KIND RESULTING FROM THE PURCHASE,USE, OR MISUSE OF, OR INABILITY TO USE THE PRODUCT OR ARISINGFROM THE BREACH OF THE EXPRESS WARRANTY, INCLUDINGINCIDENTAL, SPECIAL, CONSEQUENTIAL OR SIMILAR DAMAGES, ORLOSS OF ANTICIPATED PROFITS OR BENEFITS, OR FOR ANY CLAIMBROUGHT AGAINST PURCHASER BY ANY OTHER PARTY.
