1. SWEEPSTAKES TIMING: The Verizon Samsung Galaxy S21 Sweepstakes (the "Sweepstakes") begins at 4:30 PM Eastern Time ("ET") on February 2, 2021 and ends at 4:30 PM ET on February 3, 2021 (the "Sweepstakes Period"). Sponsor's clock is the official "timekeeper" of this Sweepstakes.
2. ELIGIBILITY: The Sweepstakes is open only to legal residents of the 48 contiguous United States and the District of Columbia (which excludes Alaska and Hawaii), who are 18 years of age or older as of the date of entry. Employees of Verizon Wireless (the "Sponsor"), Twitter Inc. ("Twitter"), Don Jagoda Associates, Inc. ("Administrator"), their respective parent companies, subsidiaries, affiliates, officers, directors, governors, owners, partners, distributors, retailers, advertising/promotion/service agencies, dealers, licensors, agents, suppliers, and independent contractors (collectively, the "Sweepstakes Entities") and each of their immediate family members and/ or those living in the same household (defined as spouses, parents, siblings and children and anyone else residing in their same household) are not eligible for the Sweepstakes. Void in Alaska, Hawaii and where prohibited or restricted by law. All federal, state and local laws and regulations apply.
3. HOW TO ENTER: To participate in the Sweepstakes, enter through your Twitter account by retweeting the "Samsung Galaxy S21" Sweepstakes post posted by Verizon. Once you retweet the post, you will receive one (1) entry into the Sweepstakes. Limit one (1) entry per person, per Twitter account. You may only use one (1) Twitter username account to enter. You must have a non-private Twitter account to enter the Sweepstakes and receive Direct Messages. If you do not have a Twitter account, you may create one for free, visit www.Twitter.com. Your Entry must comply with Twitter Terms of Use (https://twitter.com/tos?lang=en).
4. ENTRY GUIDELINES: To be eligible, the entry must be complete and in English. Any entry that is, in the Sponsor's sole discretion, obscene, profane, lewd, defamatory, or is otherwise objectionable, contains any content that is illegal, dangerous or unsuitable for advertising, or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand (except for Sponsor) or other proprietary right of any person living or deceased (including but, not limited to, rights of privacy or publicity or portrayal in a false light) or entity will not be considered and may disqualify the entrant. Any entry not in compliance with the above and that does not meet the Sweepstakes requirements will be disqualified. Entries must be in keeping with Sponsor's image and may not be offensive, as determined by Sponsor in its sole discretion, nor can it defame or invade publicity rights or privacy rights of any person, living or deceased, or otherwise infringe upon any person's personal or proprietary rights. All entries submitted become the property of the Sponsor and will not be returned. No information regarding entries, other than as otherwise set forth in these Official Rules will be disclosed.
Use of computer programs and other automatic means to enter the Sweepstakes is prohibited and will result in disqualification. Normal Internet access and phone/usage charges imposed by your online/phone service may apply. Standard data usage rates may apply. See your wireless provider for pricing plan details. Entries generated by script, macro or other automated means
and entries by any means which subvert the entry process are void. All entries become the sole property of the Sponsor and will not be returned.
5. Random Drawing: The random drawing will be conducted on or about February 8, 2021 to randomly select three (3) Grand Prize winners. Drawing will be conducted by Administrator, an independent judging organization, whose decisions are final on all matters relating to the Sweepstakes. Odds of winning depend on the number of eligible entries received.
6. GRAND PRIZES (3): A Samsung Galaxy S21 5G Ultra and a $250 Verizon Gift Card. Total ARV of each Prize is $1,450. Samsung Phones will be locked to Verizon for 90 days upon receipt of the phone and any customers that do not have Verizon service can use their gift card to sign up for a 3 month trial. Prize winner is not required to activate wireless service permanently with Verizon to keep the Samsung Galaxy phone. Total Max. ARV of all prizes is $4,350.
Prizes are not transferable or redeemable for cash. Limit one (1) prize per person/household. All federal, state and/or local income and other taxes on the prize are each winner's sole responsibility. Allow 3 to 4 weeks from prize notification for delivery of prize. Sponsor reserves the right, in its sole discretion, to substitute a prize with one of comparable or greater value should the prize become unavailable for any reason. Sponsor shall not have any responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with any prize provided pursuant to the Sweepstakes and/or any person's participation in the Sweepstakes.
7. WINNER NOTIFICATION/VERIFICATION: All prizes will be awarded provided a sufficient number of eligible entries are received. All potential winners are subject to verification of eligibility. Potential winners will be notified via Direct Message on or about February 10, 2021, to winner's Twitter handle and will be required to supply a valid email address and date of birth within 48 hours after notification or prize will be forfeited and an alternate winner selected, time permitting. Potential winners will then be sent, via email, an Affidavit of Eligibility, Release of Liability/Prize Acceptance Form and a Publicity Release (where lawful) and will be required to sign and return via email/fax within five (5) days of notification attempt or prize may be forfeited and an alternate winner may be selected, time permitting. If Sponsor is unable to reach the potential Grand Prize winners via DM or email, or if a potential Grand Prize winner does not want to accept the prize, he/she will be disqualified and an alternate winner will be selected and notified as stated above, time permitting. Return of any prize notification as undeliverable will result in disqualification and alternate selection (up to a maximum of three [3] alternates for each prize). All potential winners are subject to verification by Sponsor and/or Administrator, and verification of potential winners is final and binding in all matters related to the Sweepstakes. All entries submitted become the sole property of the Sponsor. In no event will the Sponsor be obligated to award more than the stated number of prizes. Use of automated entry devices or programs is prohibited. The Sponsor and its agencies assume no responsibility for any injury or damage to entrants or to any other person's computer or web-enabled device relating to or resulting from entering or downloading materials or software in connection with the Sweepstakes.
8. GENERAL RULES: By participating in the Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all aspects. Entrant agrees usage of their name and likeness for purposes of advertising and trade in any and all
media now known or otherwise developed without further compensation or review, including a winners list, unless prohibited by law. In the event there is a discrepancy or inconsistency between disclosures or other statements (in any and all media/medium) contained in any Sweepstakes materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. The Sponsor and its agencies are not responsible for technical, hardware, software or telephone incompatibility or malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the software, products, equipment or programming associated with or utilized in the Sweepstakes or by any human error which may occur in the processing of (or failure to process) the entries in the Sweepstakes or for any liability for damage to any computer system resulting from participation in connection with the Sweepstakes. In the event of a dispute as to any entry, the authorized account holder of the email address associated with winner's Twitter account will be deemed to be the entrant. The authorized account holder is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider, or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Winners may be required to show proof of being the authorized account holder of the account associated with the entry. Proof of submission of entry does not constitute proof of delivery or receipt of such information, or eligibility for the Sweepstakes. The Sponsor is not responsible for the failure of any entry to be received by the Sponsor for any reason. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes; violates the Official Rules; is suspected of cheating, fraud, or acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any entrant who is cheating or suspected of cheating or who uses or is suspected of using fraudulent means, unauthorized entry methods, or otherwise attempts to participate with multiple identities, e-mail and/or addresses will be disqualified. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, then the Sponsor reserves the right in its sole discretion to cancel or terminate the Sweepstakes and select the winners from among all eligible non-suspect entries received prior to such action. By participating in the Sweepstakes, the entrant agrees that the Sweepstakes Entities will have no liability whatsoever for, and will be released and held harmless by entrant for any threatened or actual claims, actions and liability for any bodily injury, loss, cost or damages of any kind to persons, including death and property, damages sustained due in whole or in part, directly or indirectly, from entry creation, the acceptance, possession, use or misuse of the prizes, if applicable, or participation in the Sweepstakes or in any related activity. By entering the Sweepstakes, you hereby represent and warrant that you have read these Official Rules and are fully familiar with its contents and agree to be bound thereto.
9. MISCELLANEOUS CONDITIONS: Except to the extent pre-empted by federal or other applicable state law, the Sweepstakes shall be governed by the laws of the State of New Jersey, without giving effect to any conflict of law provisions thereof. By participating in the Sweepstakes, entrants agree that any and all disputes which cannot be resolved between entrant and Sponsor, and causes of action arising out of or connected with this Sweepstakes,
shall be resolved individually, without resort to any form of class action, exclusively before a court located in New Jersey, having competent jurisdiction, which court shall apply the laws of the State of New Jersey without giving effect to any conflict of law provisions thereof.
10. PRIVACY: Except as otherwise contemplated in these Official Rules, and to the extent entrants may otherwise elect at the time of entry, personal information collected in connection with the Sweepstakes will be used in accordance with the online privacy policy of the Sponsor. Any communication or information transmitted to Sponsor through entry, by e-mail or otherwise is and will be treated as non-confidential and non-proprietary.
11. WINNERS LIST: For the names of the winners, available after February 28, 2021, send a stamped, self-addressed envelope postmarked by February 15, 2021, to: Verizon Samsung Galaxy S21 Sweepstakes Winners (Attn: NR), 100 Marcus Drive, Melville, NY 11747.
