H OUSE COMMITTEE ON APPROPRIATION S FISCAL N OTE HOUSE BILL N O. 1803 FUND PRIN TERS N O. 3688 PRIME SPON SOR: Caltagirone COST / (SAVIN GS) FY 2011/12 FY 2012/13 General Fund $0 $0 Motor License Fund $0 ($150,000) Political Subdivision Funds $0 See Fiscal Impact SUMMARY: Perm its third class cities that have parking authorities to assign enforcem ent and ad m inistration of parking law s to the parking authority; am end s language relating to the Philad elphia Parking Authority (PPA); and extend s Philad elphia's red light cam era pilot program until Decem ber 31, 2016. This legislation w ou ld take effect in 60 d ays. AN ALYSIS: This legislation w ould am end Section 6109(h) of the Vehicle Cod e (relating to specific pow ers of d epartm ent and local authorities) to authorize third class cities to d elegate their pow er to ad m inister and enforce all ord inances and resolutions enacted in accord ance w ith the police pow ers set forth u nd er Section 6109(a)(1) and those certain stopping, stand ing and parking provisions provid ed in Sections 3351 (relating to stopping, stand ing and p arking outsid e of business and resid ence d istricts), 3353 (related to prohibitions in specified places) and 3354 (relating to ad d itional parking regulations) to the parking authority. This legislation w ould ad d subsection (g) to Section 6109 of the Vehicle Cod e w hich clarifies that the on-street parking regulations in Philad elphia w ill continue to be enforced by the PPA. Su bsection (g) w ould also u se language sim ilar to that in Title 53 §5508.1(q.1), w hich w ould sunset on 3/ 31/ 14. This new subsection w ould take effect on 3/ 31/ 14 and all net on-street parking revenue w ill continue to be d ivid ed betw een the City and the Philad elphia School District accord ing to existing m ethod ology. This legislation w ould am end Section 3116 to extend the PPA's Autom ated Red Light Enforcem ent (ARLE) cam era pilot program . The legislation w ould allow PennDOT to recoup ad m inistrative costs incurred . This legislation also ad d s a d efense for a violation if a person w as d riving a busload of passengers and that a sud d en stop could have injured them . All net revenues from the PPA shall be sent back to the state for d istribution back to any com m unity through a com petitive grant process. PennDOT shall not set asid e any specific am ount or percentage for any particular com m unity. A selection com m ittee w ould also be created for the state ARLE grant program , w ith four m em bers from PennDOT and four appointed by the mayor of Philad elphia. HB1803/PN 3688 -2FISCAL IMPACT: The changes to Section 6109(h) w ould have no ad verse fiscal im pact on Com m onw ealth or political subd ivision fund s. The ad d ition of Section 6109(g) w ould have no ad verse fiscal im pact on the Com m onw ealth, School District of Philad elphia, the City of Philad elphia, or the Philad elp hia Parking Authority as current revenues are consistent w ith the $35 m illion threshold . All net on -street parking revenue from the Philad elphia Parking Authority w ill continu e to be d ivid ed betw een the City of Philad elp hia and the Philad elphia School District accord ing to existing m ethod ology. For FY 2011, revenue from on -street parking regulations w as $41,785,000 w ith $34,185,000 going to the City of Philad elphia and $7,600,000 going to the School District of Philad elphia. The changes to Section 3116 w ould provid e som e fund ing for PennDOT for their role in the ARLE Program . Accord ing to PennDOT the d epartm ent incurs about 3% of the total program value to gather all the applications, review them , initiate all the ind ivid ual legal agreem ents and m onitor the ARLE program from a PennDOT perspective. The Governor’s Executive Bud get for 2012-13 projects $5 m illion in ARLE grants d uring the 2012-13 fiscal year. This w ou ld im ply that PennDOT w ill take $150,000 for the ad m inistration of the ARLE program . Accord ing to PennDOT, the new selection com m ittee w ill have no ad verse fiscal im p act on Com m onw ealth fund s. The requirem ent that all ARLE grants w ill be d istributed w ithout set asid e for the hom e m unicipality could result in the red uction of fund s to the City of Philad elphia d ue to the fact that the city w ould no longer be guaranteed 50% of the revenue subm itted to PennDOT. Philad elphia received $8,423,000 in 2010 ARLE grant fund ing and $1,500,000 in 2011 ARLE fund ing.
