TERMS AND CONDITIONS OF USE AND IMPORTANT SAFETY INFORMATION READ AND UNDERSTAND THESE WARNINGS BEFORE USING THE INTEL® Drone Link. Complete Terms and Conditions including translations can be found at www.intel.com/ content/www/us/en/support/articles/000025792/ drones/commercial-drones.html . Failure to follow these warnings and to operate within the operational limitations of the UAS could result in an accident and death, serious injury, property damage, or damage to the UAS. Glossary • UAV: Intel® Falcon™ 8+ Unmanned Aerial Vehicle (UAV) – includes the aircraft itself and all parts in, on, or attached to the aircraft when flown (e.g. batteries, payload). • CTR: Intel® Cockpit Controller – ground control station. • BMS: Intel® Powerpack Battery Management System – smart battery. • UAS: Intel® Falcon™ 8+ System or Intel® Falcon™ 8+ Unmanned Aircraft System (UAS) – Product including UAV, CTR, and all dedicated accessories. Intended Use Only use with Intel Falcon 8+ UAV. For use refer to Intel Falcon 8+ UAV terms and conditions. Intel® Drone Link Safety Comply with All Laws and Regulations. For safety refer to Intel Falcon 8+ UAV terms and conditions. These apply also for combined equipment. DANGER: Do not modify the Product. Any modifications may compromise safety features, increasing risk of injury, death, or property damage. There are no user serviceable parts inside this device. Refer all service to qualified Intel service personnel. WARNING: Do not install or remove any camera payload while the UAV is powered ON. Turn OFF the UAV before installing or removing a payload. The payload might get damaged when it is connected with an active power supply from the UAV to the payload. Please see the User Manual and Terms and Conditions of Sale for further details. Operating Limitations Always operate within the hosting UAS operating limitations. Privacy and Property Rights As the Operator of a UAS, you must comply with all applicable laws, especially privacy, property, and copyright laws. This includes the below common types of rules that may apply in the jurisdiction in which you operate. Always consult the laws of your jurisdiction before operating the UAS, as jurisdictions have different laws. • Monitoring and filming public areas where individuals are staying may be only permitted under limited circumstances, e.g. for safety reasons, and provided sufficient notice is provided. • Filming individuals and using their pictures (such as sharing them) may infringe an individual’s rights in his/her own image. • Under copyright laws, some pictures may only be used for private purposes. In addition, taking pictures of buildings may breach copyrights. • Take-offs and landings of the UAV may only be allowed with consent of the owner of the property on which the take-offs and landings occur. WARNING: Check airworthiness before each flight, paying special attention to proper fixing of any accessory device. Also refer to Intel Falcon 8+ UAV terms and conditions. • Make sure not to exceed reasonable noise level limits. • Understand and comply with state and local privacy laws where you operate. • Violation of these safety precautions results in the loss of the limited warranty included in the Terms and Conditions of Sale for this Product! Be respectful of the privacy of individuals and their property when you fly. • Be transparent with others about your flying and your purpose. • Collect only images or sensor data that is necessary to achieve your purpose and in compliance with law. TERMS AND CONDITIONS OF USE AND IMPORTANT SAFETY INFORMATION • Do not monitor and collect images or sensor data from private property where you do not have permission or consent to operate from any owner and, potentially, any residents or visitors. • Do not share or publish personal information collected from private property without consent. • Use good judgment when your flights might impact others and their property. Consider giving notice to others where possible. Violations of the laws and regulations referred to above may lead to penalties, damages claims from individuals, or even criminal prosecution. FCC Statements and Warnings CAUTION: Changes or modifications not expressly approved by Intel Corporation could void the user's authority to operate the equipment. FCC Part 15.105(b) Warning and Interference Statement. This equipment has been tested and found to comply with the limits for a Class B digital device, pursuant to part 15 of the FCC Rules. These limits are designed to provide reasonable protection against harmful interference in a residential installation. This equipment generates, uses and can radiate radio frequency energy and, if not installed and used in accordance with the instructions, may cause harmful interference to radio communications. However, there is no guarantee that interference will not occur in a particular installation. If this equipment does cause harmful interference to radio or television reception, which can be determined by turning the equipment off and on, the user is encouraged to try to correct the interference by one or more of the following measures: • Reorient or relocate the receiving antenna. • Increase the separation between the equipment and receiver. • Connect the equipment into an outlet on a circuit different from that to which the receiver is connected. • Consult the dealer or an experienced radio/TV technician for help. Equipment Operation Restrictions. Equipment may only be operated with antennas supplied by Intel. No additional items of any kind may be inserted between the provided antenna and the antenna port. Antenna Operation Restrictions. The Intel® Drone Link always has to be operated with the antennas facing away from the user. When the antenna is in use, it must be separated by a distance of at least 20 cm from all persons. Do not operate the ground control station in any other orientation. Compliance Statement (applicable in the U.S.). This Product complies with part 15 of the FCC Rules. Operation is subject to the following two conditions: (1) This Product may not cause harmful interference, and (2) this Product must accept any interference received, including interference that may cause undesired operation. RF Exposure (Specific Absorption Rate) Information (applicable in the U.S.) This Product is designed and manufactured not to exceed the emission limits for exposure to radio frequency (RF) energy set by the Federal Communications Commission (FCC) of the U.S. Government and Innovation, Science and Economic Development (ISED) (formerly Industry Canada (IC)). The RF exposure standard and category applicable to the CTR employs a unit of measurement known as the Specific Absorption Rate, or SAR. The SAR limit set by the FCC and ISED is 1.6 W/kg averaged over any 1 gram of tissue. The SAR limit adopted by the EU Commission is 2.0 W/kg averaged over any 10 gram of tissue. Tests for SAR are conducted using standard operating positions accepted by the FCC, ISED and EU Commission with the Product transmitting at its highest certified power level in all tested frequency bands. Although the SAR level is determined at the highest certified power level and duty cycle, the actual power level and duty cycle of the CTR while operating can be well below the maximum certified values. This is because the CTR is designed to operate at multiple power levels and to use only the power required to reach the network. While there may be differences between the SAR levels of various products and at various positions, Intel products meet the U.S. and ISED government requirements. Equipment Authorization has been granted to this model with all reported SAR levels evaluated and in compliance with the FCC and ISED RF exposure guidelines. US SAR information on this Product is on file with the FCC and can be found under the Display Grant section of www.fcc.gov/oet/ea/fccid. You can search this database using the FCC ID located on your Product. The Canada SAR information on this Product is on file in the ISED system. Using the Canada IC number located on your Product the SAR information can be found by searching the Industry Canada Radio Equipment List (REL) at www.ic.gc.ca/app/sitt/reltel/ srch/nwRdSrch.do?lang=eng. LIMITED WARRANTY, DISCLAIMER OF ALL OTHER WARRANTIES, AND LIMITATION OF LIABILITY 1. Limited Warranty (reprinted from the Terms and Conditions of Sale for this Product). (a) Product Warranty. Intel warrants to you that, (a) upon delivery, Product will be free from material defects in material and workmanship and (b) Product will materially conform to the relevant specifications (the published technical, design, and performance specifications applicable to the Product that are in effect when the Product is shipped to you (Specifications)) for one (1) year from the date of shipment to you by Intel. Battery cells shipped with or contained in the Product and battery chargers shall be subject to the foregoing warranty for a period of 6 months or150 cycles, whichever comes first from the date of Intel’s shipment to you. Intel provides no warranty on tearable parts (propellers). Unless an alternative warranty is set out in any applicable software license, Intel warrants to you that upon delivery Software will materially conform to the relevant Specifications for 90 days from the date of Intel’s shipment to you. This warranty is subject to Limited Warranty Sections 1 (d) through (g) below. For purposes of this Limited Warranty, Product means Intel-branded tangible equipment, devices, components or parts purchased by you under the Terms and Conditions of Sale for this Product. (b)Electronic Systems. Intel is not liable for any downtime or system interruption that may be attributed to your use of Intel’s electronic ordering or transaction systems or applications. (c) Third-Party Products. Any third-party products, software, or services that may be provided by or for Intel under any Purchase Order or otherwise in connection with any Product, are provided to you “AS IS,” without warranties of any kind. (d)Warranty Limitations. Intel does not warrant that Product will be failsafe, operate without interruption or error, or be free from design defects or errors, including from design defects, errors or “errata” that may cause the Product to deviate from Specifications. The warranty under Section 1(a) shall not apply in the following cases: (i) the Product is not stored, handled and used according to its Specifications; (ii) the Product is damaged due to carelessness, negligence, or wrong use by any person (other than Intel); (iii) for defects due to normal wear and tear; (iv) the Product has not been submitted to the preventive maintenance operations described in the operations and/or user manual or has been subject to unauthorized repair and maintenance; (v) Intel has not received all data and information in relation to the Product (including log files) as requested from you or you are unable to provide the log files (e.g. through removing both SD cards); (vi) the Product is modified by anyone other than Intel; (vii) the claims are attributable to any Technology (meaning inventions, creations, know-how, processes, designs, design information, databases, schematics, TERMS AND CONDITIONS OF USE AND IMPORTANT SAFETY INFORMATION layouts, RTL files, libraries, interface information, specifications, algorithms, software and other copyrightable material (in object code and source code format), technical information, IP blocks, and other developments and technology) designed, provided, or modified by you or not supplied by Intel; (viii) virus, infection, worm or similar malicious code not introduced by Intel; or (ix) your failure to apply Intel-supplied modifications or corrections. Intel makes no warranty that any Product will protect against all possible security threats, including intentional misconduct by third parties. Intel is not liable for any downtime or service interruption, for any lost or stolen data or systems, or for any other damages arising out of or relating to any such actions or intrusions. (e) Product Remedies. Upon notice of a valid Product warranty claim during the applicable warranty period, Intel will, at its option, within a reasonable period of time: (a) repair (or cause to be repaired) the applicable defect in the Product, (b) replace (or cause to be replaced) the non-conforming part in the Product with the same model for such part (or with a part of comparable functional performance), or (c) refund or credit (or cause to be refunded or credited) to your account the purchase price for the Product or the applicable component (e.g. UAV, CTR, or payload) which contains such applicable defect paid to you upon prompt return of the non-complying Product or such applicable component to Intel. In case of repair or replacement of a Product under points (a) or (b) in the prior sentence, Intel warrants the repaired or replaced parts (except for tearable parts) against material defects in materials and workmanship for the remainder of the applicable warranty period or six (6) months from the date of repair or replacement, whichever provides a longer coverage. To receive the benefit of the foregoing remedies, (i) you must follow Intel’s return instructions for the Product; (ii) you must promptly notify Intel in writing within the applicable warranty period that such Product is defective and furnish a written explanation of the non-compliance; (iii) the Product must be returned to Intel’s or its designee’s service facility at your risk and expense; (iv) Intel must be reasonably satisfied that claimed non-compliance exists and is covered by the applicable warranty under, as applicable, the terms and conditions of sale or written contract with you; and (v) you must have complied with any support and services guidelines in the Intel documentation for this Product. If Intel confirms the existence of a valid Product warranty claim and your compliance with this Section and otherwise under, as applicable, such terms and condition of sale or such written contract, Intel will pay expenses for return of defective Product or such applicable component to Intel. Returned Product that is not defective or that contains missing or damaged parts not caused by Intel is not subject to warranty coverage and will be returned to you at your sole cost and expense, without credit, repair, correction, or replacement. (f) Disclaimer. The warranties, conditions, other terms and remedies provided in the Terms and Conditions of Sale are instead of any other warranty or condition, express, implied or statutory, including, those regarding merchantability, fitness for any particular purpose, non-infringement, or any warranty arising out of any course of dealing, usage of trade, proposal, specification or sample. Intel does not assume (and does not authorize any person to assume on its behalf) any other liability. (g)The warranties hereunder are personal to you and you may not assign, transfer, or passthrough any Intel warranty to your direct or indirect customers and any attempted assignment, transfer, or pass-through is void. To the extent permitted by applicable law, Intel also disclaims all liability for any losses or damages (whether such losses or damages were foreseen, foreseeable, known, or otherwise): direct or indirect, arising from the use of the UAS (i) that is caused by any modification or addition of software or hardware, including re-design, made by the Operator or any other third party, (ii) in breach of Intel’s above Safety guidelines, Safety precautions or any other Intel documentation, (iii) in violation of any applicable laws or regulations, (iv) in violation of any of the operating limitations of the UAS, or (v) from any error of the Operator. (h)Exclusive Remedy. This Limited Warranty Section 1 states your sole and exclusive remedy, and Intel’s sole and exclusive liability, with respect to Product sold to you by Intel. In no event will Intel be liable for any monetary damages or other costs associated with warranty claims whether for the replacement or repair of Product, including labor, installation or other costs incurred by you and, in particular, any costs relating to the removal or replacement of any Product soldered or otherwise permanently attached to any printed circuit board. 2. Limitations of Liability (a) Except as otherwise noted in this Limitation of Liability Section 2, Intel will not be liable for any of the following losses or damages (whether such losses or damages were foreseen, foreseeable, known, or otherwise): TERMS AND CONDITIONS OF USE AND IMPORTANT SAFETY INFORMATION (i) loss of revenue; (ii) loss of actual or anticipated profits; (iii) loss of the use of money; (iv) loss of anticipated savings; (v) loss of business; (vi) loss of opportunity; (vii) loss of goodwill; (viii) loss of use of the Products; (ix) loss of reputation; (x) loss of, damage to, or corruption of data; (xi) cost of substitute equipment or additional costs incurred by you; (xii) claims by your customers or other third parties; or (xiii) any indirect, incidental, special, or consequential loss or damage however caused (including loss or damage of the type specified in this Limitation of Liability Section 2 (a)). (b)Except as otherwise noted in this Limitation of Liability Section, Intel's total cumulative liability to you, including for direct damages and any indemnification obligation under the Terms and Conditions of Sale (and whether the breach arises under contract, negligence, or under or from any other reason), will not exceed the sum paid or payable to Intel by you under the Terms and Conditions of Sale that is the subject of and directly affected by such claim. (c) You acknowledge that the limitations of liability provided in this document are an essential part of the Terms and Conditions of Sale. You agree that the limitations of liability provided in the Terms and Conditions of Sale with respect to Intel will be conveyed to and made binding upon any customer of yours that acquires the Product, alone or in combination with other items from you. To the extent permitted by applicable law, Intel also disclaims all liability for any damage, direct or indirect, arising from the use of the UAS (i) that is caused by any modification or addition of software or hardware, including re-design, made by the Operator or any other third party, (ii) in breach of Intel’s above Safety guidelines, Safety precautions or any other Intel documentation, (iii) in violation of any applicable laws or regulations, (iv) in violation of any of the operating limitations of the UAS, or (v) from any error of the Operator.
