(i ncl udi ng w i t hout l i mi t at i on damage caused by use of ot her t han Mer u
shi ppi ng cont ai ner s), or use of t he pr oduct s ot her t han as speci f i ed i n
t he appl i cabl e Mer u pr oduct document at i on (i ncl udi ng w i t hout
l i mi t at i on i ncompat i bl e oper at i ng envi r onment s and syst ems), or

of Mer u.
— Use of t he Pr oduct w i t h sof t w ar e, i nt er f aci ng, par t s or suppl i es not
suppl i ed by Mer u.
The warrant y on t he Product does not apply if t he Product is sold, or in t he case of
sof t ware, licensed, f or f ree f or evaluat ion or demonst rat ion purposes.
Meru expressly disclaims any warrant y or obligat ion t o support t he Product f or all
operat ing environment s – f or example, as illust rat ion and not limit at ion, Meru does
not warrant or ensure int eroperabilit y of t he Product wit h f ut ure t elecommunicat ion syst ems or ot her f ut ure sof t ware or hardware.
You underst and and acknowledge t hat t he Product s may generat e, use or radiat e
radio f requency energy and may int erf ere wit h radio communicat ions and/ or radio
and t elevision recept ions if is not used and/ or inst alled in accordance wit h t he
document at ion f or such product s. WHILE MERU USES COMMERCIALLY REASONABLE
EFFORTS TO ENSURE COMPLIANCE OF THE PRODUCTS WITH APPLICABLE UNITED
STATES FEDERAL COMMUNICATIONS COMMISSION AND PROTECT AGAINST HARMFUL
INTERFERENCES, YOU ACKNOWLEDGE AND AGREE THAT INTERFERENCES WITH
RADIO COMMUNICATIONS AND/ OR RADIO AND TELEVISION RECEPTIONS MAY OCCUR
AND THAT MERU WILL NOT BE LIABLE FOR ANY DAMAGES OR INCONVENIENCE BASED
ON SUCH INTERFERENCES.
Third Party Products - The above Limit ed Warrant ies are exclusive of product s
manuf act ured by t hird part ies (“ Third Part y Product s” ). If such t hird part y manuf act urer provides a separat e warrant y wit h respect t o t he Third Part y Product , Meru
will include such warrant y in t he packaging of t he Meru Product .
Ret urn procedures
To obt ain warrant y service you must : (a) obt ain a ret urn mat erials aut horizat ion
number (“ RMA#” ) f rom Meru by cont act ing rmaadmin@merunet works. com, and (b)
del iver t he Product , in accordance wit h t he inst ruct ions provided by Meru, along
wit h proof of purchase in t he f orm of a copy of t he bil l of sale including t he
Product ’ s serial number, cont act inf ormat ion, RMA# and det ail ed descript ion of t he
def ect , in eit her it s original package or packaging providing t he Product wit h a

degree of prot ect ion equivalent t o t hat of t he original packaging, t o Meru at t he
address below. You agree t o obt ain adequat e insurance t o cover loss or damage t o
t he Product during shipment .
If you obt ain an RMA# and ret urn t he def ect ive Product as described above, Meru
will pay t he cost of ret urning t he Product t o Meru. Ot herwise, you agree t o bear
such cost , and prior t o receipt by Meru, you assume risk of any loss or damage t o
t he Product . Meru is responsible f or t he cost of ret urn shipment t o you if t he Meru
Product is def ect ive.
Ret urned product s which are f ound by Meru t o be not def ect ive, ret urned out -of warrant y or ot herwise ineligible f or warrant y service will be repaired or replaced
at Meru’ s st andard charges and shipped back t o you at your expense.
At Meru’ s sole opt ion, Meru may perf orm repair service on t he Product at your
f acilit y, and you agree t o provide Meru wit h all reasonable access t o such f acilit y
and t he Product , as required by Meru. On-sit e repair service may be available and
is governed by t he specif ic t erms of your purchase.
All replaced part s, whet her under warrant y or not , are t he propert y of Meru.
Warrant y limit at ions
THE WARRANTIES SET FORTH ABOVE ARE EXCLUSIVE AND NO OTHER WARRANTY,
WHETHER WRITTEN OR ORAL, IS EXPRESSED OR IMPLIED BY MERU, TO THE MAXIMUM
EXTENT PERMITTED BY LAW. THERE ARE NO OTHER WARRANTIES RESPECTING THE
PRODUCT AND DOCUMENTATION AND SERVICES PROVIDED UNDER THIS AGREEMENT,
INCLUDING WITHOUT LIMITATION ANY WARRANTY OF DESIGN, MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE (EVEN IF MERU HAS BEEN INFORMED OF SUCH
PURPOSE), TITLE OR AGAINST INFRINGEMENT OF THIRD PARTY RIGHTS. IF ANY
IMPLIED WARRANTY CANNOT BE DISCLAIMED UNDER APPLICABLE LAW, THEN SUCH
IMPLIED WARRANTY SHALL BE LIMITED IN DURATION TO THE HARDWARE AND SOFTWARE WARRANTY PERIODS DESCRIBED ABOVE.
NO AGENT OF MERU IS AUTHORIZED TO ALTER OR EXCEED THE WARRANTY OBLIGATIONS OF MERU.
MERU SPECIFICALLY DOES NOT WARRANT THAT THE MERU SOFTWARE WILL BE ERROR
FREE OR OPERATE WITHOUT INTERRUPTION.
THE REMEDIES IN THIS LIMITED PRODUCT WARRANTY ARE YOUR SOLE AND EXCLUSIVE
REMEDIES, AND MERU’ S SOLE AND EXCLUSIVE LIABILITY, FOR BREACH OF THE HARDWARE OR SOFTWARE WARRANTY SET FORTH ABOVE.
Limitations of Liability
You acknowledge and agree t hat t he considerat ion which you paid t o Meru does not
include any considerat ion by Meru of t he risk of consequent ial, indirect or incident al damages which may arise in connect ion wit h your use of , or inabil it y t o use,
t he Product . THUS, MERU AND ITS RESELLER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING
WITHOUT LIMITATION LOST PROFITS, LOST BUSINESS, LOST DATA, LOSS OF USE, OR
COST OF COVER INCURRED BY YOU ARISING OUT OF OR RELATED TO YOUR PURCHASE
OR USE OF, OR INABILITY TO USE, THIS PRODUCT OR THE SERVICES, UNDER ANY
THEORY OF LIABILITY, WHETHER IN AN ACTION IN CONTRACT, STRICT LIABILITY,
TORT (INCLUDING NEGLIGENCE) OR OTHER LEGAL OR EQUITABLE THEORY, EVEN IF
MERU OR ITS RESELLER KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF
SUCH DAMAGES. IN ANY EVENT, THE CUMULATIVE LIABILITY OF MERU OR ITS
RESELLER FOR ALL CLAIMS WHATSOEVER RELATED TO THE PRODUCT OR THE SERVICE
WILL NOT EXCEED THE PRICE YOU PAID FOR THE PRODUCT OR SERVICES GIVING RISE
TO SUCH CLAIMS.

not apply.
This Limit ed Product Warrant y is t he ent ire and exclusive agreement bet ween you
and Meru wit h respect t o it s subj ect mat t er, and any modif icat ion or waiver of any
provision of t his st at ement is not ef f ect ive unless expressly set f ort h in writ ing by
an aut horized represent at ive of Meru.
